PATUXENT RIVER, MARYLAND 20670

IN REPLY REFER TO:

CJ&A 17-0355

CLASS JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Systems Command (NAVAIR) Headquarters

2. Description of the Action Being Approved.

This Class Justification and Approval (CJ&A) authorizes and approves a sole source contract with AECOM (formerly URS Federal Technical Services, Inc.) for a base year plus two option years plus six months under FAR 52.217-8 Option to Extend Services clause to provide mission planning and mission support for collecting and analyzing sensor data from the BAMS-D unmanned aircraft systems in support of Overseas Contingency Operations. The estimated dollar value of this contract, including all options, is $26.6M.

Authority to act under this class justification expires 31 October 2021.

3. Description of Supplies/Services.

BAMS-D is an unmanned aircraft system that is a maritime Intelligence, Surveillance, and Reconnaissance (ISR) asset supporting United States Naval Forces in a forward deployed location to support on-going Overseas Contingency Operations.

Although the BAMS-D aircraft are deployed all mission command, control, data analysis, and dissemination of intelligence occur at the BAMS-D Ground Segment facilities, which include the Mission Control Element (MCE) and Tactical Auxiliary Ground Station (TAGS), CONUS. The TAGS is a Government-owned SPAWAR Systems Center Atlantic certified secure laboratory and the only facility in existence with the security clearances and capabilities to process ISR data from the sensors on the BAMS-D aircraft.

The contractor provides mission tactical planning support to the BAMS-D Liaison Officer (LNO), the BAMS- D air vehicle operators (pilots), and mission payload operators (sensor operators) to ensure that the flight plan maneuvers are able to collect the sensor data required by the customer. Additionally, the contractor analyzes the sensor signals in real time from the BAMS-D aircraft and provides intelligence back to the customer. The contractor may also be required to deploy to forward operating locations to provide BAMS- D and ISR insight and expertise to other Navy, Air Force, and Army operations.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

Per FAR 6.302-1(a)(2)(iii)(B), services may be deemed available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in unacceptable delays in fulfilling agency requirements. AECOM has provided mission tactical planning and real-time analysis of sensor data since the fielding of the BAMS-D in 2008 and, as a result, is the only company with the corporate knowledge and personnel who are currently trained and certified by the Government to provide these specialized services.

The skill set for personnel who provide mission planning and data analysis for the BAMS-D ISR data collection and analysis in the TAGS facility is not available outside the BAMS-D program. The personnel who process and analyze the sensor output require specialized training on the TAGS facility equipment that can be obtained only by working in the TAGS facility. Each person who works in the TAGS facility must receive extensive on-the-job training and is then tested to demonstrate proficiency in the function performed. In order to progress to positions of greater responsibility, additional on-the-job training and testing are required. Provision of mission planning support requires knowledge of the BAMS-D system capabilities and the TAGS operations. These requirements for mission planning and data analysis dictate a dedicated cadre of highly skilled personnel with the breadth and depth of knowledge and experience to effectively and efficiently collect, evaluate, and disseminate the ISR intelligence data products in near real-time.

Since the BAMS-D ISR mission provides direct operational support to forward deployed units supporting Overseas Contingency Operations, any delay in providing services to forward deployed units would be unacceptable and would result in missions being cancelled or missions taking place with greater risk to personnel due to lack of ISR data. Neither alternative is acceptable in relation to on-going Overseas Contingency Operations. For another contractor to be able to provide the specialized services, the contractor would have to find a way to train the personnel without disrupting on-going operations.

Furthermore, since any training would have to be done in real-time while an actual mission is being flown, the TAGS would not be available for a contractor to use to train personnel.

In summary, due to the nature of the specialized services and the lack of any alternative means of training personnel to provide these services, award to any other contractor would result in unacceptable delay in fulfilling the agency requirements.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

Waiver of DFARS PGI 206.302-1, Request for Information/Sources Sought Requirement, was signed on 28 June 2017. In accordance with FAR 5.201, a Presolicitation Notice was posted to the Federal Business Opportunities website on 6 July 2017. To date, no responses to this announcement have been received.

Any responses from interested sources will be evaluated by the Contracting Officer prior to contract award.

7. Determination of Fair and Reasonable Cost.

In accordance with FAR 15.402, the Contracting Officer shall ensure that all services and supplies provided under this contract are procured at a fair and reasonable price. If required, the contractor will submit a formal price proposal with certified cost and pricing data and sufficient information to support the accuracy and reliability of the cost estimate. The proposal will be reviewed by experienced technical analysts and contract specialists with the aid of field pricing support. The Contracting Officer will utilize cost and price analysis as the basis for negotiating a fair and reasonable price.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in paragraph 5, the Naval Air Systems Command has no plans at this time to compete future contracts for the type of supplies and services covered by this document. If another potential source emerges, the Naval Air Systems Command will assess whether competition for future requirements is feasible. Because this effort is a follow-on for supplies and services previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a)(i), the prior J&A was provided to the approval authority for review. Approval of this CJ&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(ii).
