CLIN Total Labor hours
0001 259,200
(b) The estimated level of effort for each individual order will be established at the task order level.
(c) FAR Clause 52.232-20, "Limitation of Cost" applies to fully funded orders and FAR Clause 52.232-22, "Limitation of Funds" applies to incrementally funded orders. Nothing in this clause amends the rights or responsibilities of the parties hereto under either of those two clauses. In addition, the notifications required by this clause are separate and distinct from any specified in either FAR Clause 52.232-20 or FAR Clause 52.232-22.
(d) In the event that less than one hundred (100%) percent of the established level of effort of the contract/order is actually expended by the end of the performance period, the Government shall have the option of:
(1) Requiring the Contractor to continue performance, subject to the provisions of the FAR Clause 52.232-20 or

(d) The contractor agrees that effort performed in fulfillment of level of effort obligations under this contract shall include only verifiable effort in direct support of the work specified. It shall not include efforts such as work performed in transit to or from an employee's usual workplace, work during lunchtime activities, or effort performed at other non-work locations.

MAN-HOURS
CPFF Non-Performance Based/LOE (CLIN 0001-0005)
The Government estimate is 259,200 man-hours for the entire work effort (5 years) for CPFF Non-Performance
Based/LOE tasking. A work-year is defined as 1920 hours exclusive of holidays and leave.
ESTIMATED AND NEGOTIATED LABOR
Estimated and Negotiated Labor Rates:
Cost Plus Fixed Fee (CPFF)(Term and Completion) orders will be issued under this contract using the following streamlined procedures and the applicable Section B, B-1 Estimated and Negotiated Labor Rates.
These rates are estimates and are used in the development of task order ceiling values. Invoicing will be based on actual costs incurred.
(1) For each proposed CPFF order, the contracting officer will provide the contractor with a letter including an enclosed DD 1155 Task Order.
(2) Within three (3) working days of receipt of the letter and order, the contractor will respond with the signed DD
1155. If the requirement remains valid, the task order shall be considered negotiated and a bilaterally executed order will be issued to the contractor.
(3) If the contractor does not agree with the labor categories and associated hours identified for the order, a proposal will be submitted to the contracting officer within five (5) working days of receipt of the order, addressing only the specific areas of differences. Once the differences are resolved between the contracting officer and the contractor with regards to labor categories and hours, and the contracting officer determines that the price is fair and reasonable, a fully negotiated, priced order utilizing the Section B, B-1 Estimated and Negotiated Labor Rates will be issued to the contractor.

The Government Labor Categories correlating to Section C of the Government solicitation.
Composite Proposed Fully
Burdened Rate, Years 1 - 5
The average Fully Burdened Labor Rate per Hour is entered in the above table as proposed for each labor category during the applicable performance year (1-5) of the ordering period. Numbers only are entered, in U.S. dollar format ($###.##) rounded to the nearest cent. Fully Burdened Labor
Rates shall include direct labor cost, fringe, overhead, G&A, subcontractor pass-through rate, and fee on total cost, but should not include Fully Burdened Other Direct Costs (ODCs) such as
Materials, and Travel. This would be the total labor costs (the sum of both the prime and all subcontractors) costs for that labor category divided by the total number of labor hours for that category to arrive at the average (composite) Fully Burdened Labor Rate per Hour.
B-2 Fee:
The composite rates from B-1 will be used to develop the total estimated Cost Plus Fixed Fee. Fixed Fee will be calculated based on fee per hour and in accordance with 5252.232-9510 Payment of Fixed Fee (NAVAIR) (OCT
2005). The fee per hour is the total fee proposed for all periods divided by the total number of hours for all periods
(259,200). The non-performance based fee per hour is $______ (To be determined at contract award).
