DEPARTMENT OF THE NAVY
NAVAL AIR SYSTEMS COMMAND AIRCRAFT DIVISION 21983 BUNDY ROAD
BUILDING 441, UNIT 7 PATUXENT RIVER, MARYLAND 20670
IN REPLY REFER TO:
J&A 17-0225
JUSTIFICATION AND APPROVAL
ONLY ONE RESPONSIBLE SOURCE IN ACCORDANCE
WITH FAR 6.302-1
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWC-AD) Patuxent River, MD
2. Description of the Action Being Approved.
This Justification &Approval (J&A) authorizes and approves this sole source acquisition to FilConn Incorporated, 3324 N. San Marcos Pl, Chandler, AZ 85225 to obtain specific components for modification of the LAU-118(V)1/A Missile Launcher used on the F/A- 18 and EA-6B aircraft in accordance with NAVAIR Engineering Change Proposal (ECP) 15BR003. This modification is required to mitigate store loss prevention of the AMRAAM and/or AAGRM missiles from departing the aircraft during an Aircraft Carrier arrested landing. FilConn provides the mechanical housing requirements assembly for this modification.
3. Description of Supplies/Services.
The proposed acquisition is for the Production Provisioning of components required to modify 1,800 LAU-118(V)1/A Missile Launchers for the F/A-18 (Domestic and Foreign Military Sales) and EA-6B Aircraft. The components required were selected and tested as a result of design and verification testing to replace an existing Critical Safety Item (CSI) cable harness assembly. The NAVAIR ECP 15BR003 specifically calls out the drawing number which contains the components required to modify 1,800 LAU-118(V)1/A Missile Launchers. This modification is in the safety of flight category and will be designated as a Critical Application Item (CAI) upon completion of the Technical Directive requirements. This ECP meets the Government requirements for form/fit/function, Electromagnetic Interference (EMI)/Electromagnetic Capability (EMC) and complies with the CAI requirements.
4. Statutory Authority Permitting Other Than Full and Open Competition.
FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
FilConn is the Original Equipment Manufacturer (OEM), and developer of the mechanical housing assembly which is part of FilConn kit part number: 49000-9001. The U.S. Navy does not own the data rights, as this is considered proprietary to the OEM. This housing assembly and kit were selected, qualified, and meets the needs for the CAI end item as identified in an engineering investigation to correct the problem outlined in paragraph 3 above. NAVAIR engineers confirmed that the Filconn Kit number 49000-90001 meets the Government standard after conducting tests over several months on a variety of assemblies and designs that did not meet the design constraint requirements. The test results confirmed that no other source could meet the Government requirements and therefore approved ECP 15BR003 with the Filconn Kit number to facilitate the modification of the 1,800 LAU-118 Missile Launchers.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable/Description of Market Research Conducted.
A market research analysis was completed with several manufacturers being contacted to determine if they could meet the Government requirement. The engineering review revealed that no other manufacturer had the technical capability to meet this requirement without a long lead time for a new design which would delay this capability from being delivered to the fleet to address this critical safety issue of stores departing the aircraft upon an Aircraft Carrier arrested landing.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract action are procured at a fair and reasonable price. The Contractor will submit a formal price proposal with sufficient information to support the accuracy and reliability of the estimate for prices paid in the commercial market for the same or similar items. FilConn’s proposal will be reviewed by an experienced technical analyst and contract specialist with the aid of field pricing support if necessary. The Contracting Officer will conduct an analysis of the proposal for negotiating a fair and reasonable commercial price.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NAWCAD Patuxent River, MD (AIR 5.1.6.8) has no plans at this time to compete future contracts for the types of supplies/services covered by this document. This is a one-time buy of a limited quantity and the Navy does not anticipate future procurements of this item. However, market research will continually be surveyed for future relays and relay mounts that meet the technical requirements described in Paragraph 6 for incorporation into the F/A-18 LAU -118 Missile Launcher, and if a decision should be made to replace or repair the relay and relay mounts, a competitive procurement will be considered at that time. Therefore, with industry technical improvements the Government may be able to utilize other relay and mounts that fit and operate in the LAU-118 missile launcher without modification.
