Amended Questions and Answers for N00421-16-R-0047 as of 20 December 2016

The Government has updated its previously issued responses to select questions regarding facility clearances. Please be advised the current draft DD Form 254 (Attachment 1) remains in effect. Item 1a. requires a SECRET Facility Clearance (FCL).

Question (3) - Is the prime required to have a facility clearance at time of award? At time of proposal submittal?

Answer (3) – The prime is not required to have a facility clearance at the time of proposal submittal. A facility clearance is required when the contractor must access classified information or classified spaces for contract performance (regardless of performance location). Please be advised the current draft DD Form 254 (Attachment 1) remains in effect. Item 1a. requires a SECRET Facility Clearance.

Question (4) - Does the prime have to have the facility clearance? Or may a subcontractor's or team member's facility clearance be used by the team to meet this requirement?

Answer (4) - As the contractor requires access to classified information or classified spaces for contract performance (regardless of performance location), then the contractor will be required to have a facility clearance of at least SECRET. The current draft DD254 in the solicitation remains in effect. If a subcontractor or team member is required to have access to classified information, then a facility clearance is required for each of the individual subcontractor or team member’s company.

Question (5) - If a CTA is formed, is it compliant if any member of the CTA has the clearance?

Answer (5) – As the contractor requires access to classified information or classified spaces for contract performance (regardless of performance location), then the contractor will be required to have a facility clearance of at least SECRET. The current draft DD254 in the solicitation remains in effect. If a subcontractor or team member is required to have access to classified information, then a facility clearance is required for each of the individual subcontractor or team member’s company.

Question (6) -Will NAVAIR sponsor the facility clearance for the awardee if they do not have one?

Answer (6) – Yes, NAVAIR will sponsor the facility clearance for the awardee, if applicable. The justification for an FCL must demonstrate a bona fide procurement requirement to access U.S. Government classified information.

Question (7) - If NAVAIR is providing work stations and GFE for contractor staff on Navy site, why is the contractor required to have a Secret facility clearance?

Answer (7) – As the contractor requires access to classified information or classified spaces for contract performance (regardless of performance location), then the contractor will be required to have a facility clearance of at least SECRET. The current draft DD254 in the solicitation remains in effect.

Question (27) - Can you tell me if a facility clearance is required for the prime prior to contract award?

Answer (27) – The prime is not required to have a facility clearance prior to contract award. A facility clearance is required when the contractor must access classified information or classified spaces for contract performance (regardless of performance location). Please be advised the current draft DD Form 254 (Attachment 1) remains in effect. Item 1a. requires a SECRET Facility Clearance.
