NOTICE TO OFFERORS
THIS SOLICITATION IS IN ANTICIPATION OF A SOLE SOURCE FIRM FIXED-PRICE PURCHASE FOR
MAINTENANCE OF RESCUE POWER TOOLS
The Government anticipates awarding a firm, fixed price contract in response to quotes/proposals received to this solicitation.
As a result, the contract's pricing will not be subject to any adjustment on the basis of the contractor's increased costs due to
COVID-19 and/or inflationary causes experienced during contract performance.
Because a firm, fixed price contract places the maximum risk and full responsibility for all costs and resulting profit or loss on the contractor, offerors are advised to consider these risks when pricing their quotes/proposals.
1. This solicitation is for the procurement of MAINTENANCE in support of CNRJ FIRE AND EMERGENCY
SERVICES. It is anticipated that this solicitation will result in an award of a FIRM, FIXED-PRICE SERVICE type contract.
2. The entire solicitation shall be filled out, signed, and returned as part of your quote. See block 8 on page 1 of the solicitation for the closing date and time.
3. The deadline for submission of questions regarding the solicitation’s terms, conditions, specifications, and/or the Performance Work Statement (PWS) is 48 hours prior to the solicitation closing date.

4. Award will be made to the quote/offer that represents the best value to the Government. Note: the Government reserves the right to consider the past performance of all quotes/offers, conduct a price, past performance tradeoff, and award to other than the lowest price quote/offer.
5. SINGLE AWARD FOR ALL ITEMS: Due to the interrelationship of supplies and/or services to be provided hereunder, the Government reserves the right to make a single award to the bidder whose quote is considered in the best interest of the government, price and other factors considered. Therefore, bidders who quote less than the entire effort specified herein may be determined to be unacceptable.
6. EXCEPTIONS: All bidders MUST note all exceptions from the solicitation’s terms and conditions, specifications, and/or the statement of work / performance work statement, if any. It will be assumed that any quote without mention of any exceptions will take no exception from all specifications, terms and conditions, clauses, or provisions within the solicitation.
7. SHIPPING INFORMATION: Important - all cargo shall be palletized in an appropriate manner. All cargo in the freight container shall be forklift accessible. Due to material handling safety reasons, cargo shall never be stacked on other cargo without appropriate safe method. Freight container with unsafe cargo stacking shall be rejected at receiving point. SCOPE OF WORK (MAINTENANCE OF RESCUE POWER TOOL)
Title: Perform annual inspection and testing of CNRJ powered rescue tools
List of tools is attached.
1. Maintenance work is provided by Manufacture certified technician in accordance with current edition of
NFPA1936 Standard on Powered rescue tool, Chapter 4.3. Maintenance report/certification of inspection/maintenance to be provided to CNRJ within 14 days after work completion. List of tools for maintenance/inspection is attached.
2. General: Unless otherwise specified hereinafter, the contractor shall furnish all labor, material, equipment, transportation and supervision necessary to provide all the maintenance.

4. Term of Contract and Required Completion Date: Work schedule to be determined after contract is awarded and shipping repair/maintenance parts and tools. The work shall be completed no later than 30 JUN 2024.

6. Work Schedule: The work shall be performed from 0800 to 1700, Monday through Friday except U.S.
Government holidays. The Contractor shall arrange his work so as not to cause interference with normal occurrence of the Government business.
7. Pre-Performance Conference: Prior to commencing work, the Contractor shall meet in conference with the
CNRJ FIRE representative at each location to discuss and develop mutual understandings relative to scheduling and administering the work.
8. Activity Regulations: Obey activity regulations, including fire, traffic, safety, energy conservation, security, and environmental regulations. Personnel employed at the activity shall keep within the limits of the work (and avenues of ingress and egress) and shall not enter any restricted areas unless required to do so and are cleared for such entry.
Wear hard hats, with the Contractor’s name prominently displayed, in designated hardhat areas. The contractor’s hours for the contractor’s work shall conform to para. ”Work Schedule” of this specification.
9. Examination of Premises: Offerers or quoters are expected to satisfy themselves as to the general and local conditions that may affect the cost of the performance of the work to the extent that such information is reasonably obtainable. It is considered impractical to determine, without inspection, the exact nature of the work and site conditions under which the work is to be performed. The government will arrange the site visit for the offerers or quoters, and give the notice to them.
10. Existing Work: Protect existing work which is to remain in place, be reused, or remain the property of the
Government. Repair items which are to remain, and which are damaged during performance of the work to their original condition, or replace with new. Repair, reinforcement, or structural replacement shall have CNRJ FIRE representative approval. All work of this nature shall be performed at the contractor’s expense and shall be performed as directed by the CNRJ FIRE representative. At the completion of all operations, existing work shall be in a condition equal to or better than that which existed before the work started.
11. Temporary Work: Unless otherwise indicated, all existing objects which interfere with new work shall be removed temporarily and reinstalled upon completion of new work.
12. Clean-up: All debris in work areas shall be cleaned up daily or more frequently as necessary. Construction debris may be temporarily located in an approved location; however garbage accumulation must be removed each day.
13. Disposal: All rubbish resulting from the work under this contract shall be disposed of by the contractor at his expense off U.S. Government property and at approved facilities for such disposal in accordance with Japanese Law, Japan Environmental Governing Standards (JEGS), and local regulations.
14. Fire Protection: The Contractor shall not be permitted to use heat or spark producing equipment and tools and heated products within hazardous area, except approved by the CNRJ FIRE representative. The contractor shall be fully responsible to prevent life and fire hazards. No smoking is allowed except in designated area.
15. Public Safety: Whenever the contractor’s operations create a condition hazardous to traffic or to public, the contractor shall furnish at his/her expense and without cost to the government, such flagmen and guards as necessary to give adequate warning to the public of any dangerous conditions to be encountered, and the Contractor shall furnish, erect, and maintain such fence, barricades, lights, signs and other devices as are necessary to prevent accidents and avoid damage or injury to the public.

52.203-18 PROHIBITION ON CONTRACTING WITH ENTITIES THAT REQUIRE CERTAIN INTERNAL
CONFIDENTIALITY AGREEMENTS OR STATEMENTS--REPRESENTATION (JAN 2017)
(a) Definition. As used in this provision--
Internal confidentiality agreement or statement, subcontract, and subcontractor, are defined in the clause at 52.203-
19, Prohibition on Requiring Certain Internal Confidentiality Agreements or Statements.
(b) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing
Appropriations Act, 2015 (Pub. L. 113-235) and its successor provisions in subsequent appropriations acts (and as extended in continuing resolutions), Government agencies are not permitted to use funds appropriated (or otherwise made available) for contracts with an entity that requires employees or subcontractors of such entity seeking to report waste, fraud, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.
(c) The prohibition in paragraph (b) of this provision does not contravene requirements applicable to Standard Form
312, (Classified Information Nondisclosure Agreement), Form 4414 (Sensitive Compartmented Information
Nondisclosure Agreement), or any other form issued by a Federal department or agency governing the nondisclosure of classified information.
(d) Representation. By submission of its offer, the Offeror represents that it will not require its employees or subcontractors to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting waste, fraud, or abuse related to the performance of a Government contract to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information (e.g., agency Office of the Inspector General).

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph
(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and
Records--Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the
Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

“Department of Defense Activity Address Code (DoDAAC)” is a six position code that uniquely identifies a unit, activity, or organization.
“Document type” means the type of payment request or receiving report available for creation in Wide Area
WorkFlow (WAWF).
“Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.
“Payment request” and “receiving report” are defined in the clause at 252.232-7003, Electronic Submission of
Payment Requests and Receiving Reports.
(b) Electronic invoicing. The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as authorized by Defense Federal Acquisition Regulation Supplement (DFARS) 252.232-
7003, Electronic Submission of Payment Requests and Receiving Reports.
(c) WAWF access. To access WAWF, the Contractor shall—
(1) Have a designated electronic business point of contact in the System for Award Management at https://www.sam.gov; and
(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.
(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training
Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/.
(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data
Interchange, or File Transfer Protocol.
(f) WAWF payment instructions. The Contractor shall use the following information when submitting payment requests and receiving reports in WAWF for this contract or task or delivery order:
(1) Document type. The Contractor shall submit payment requests using the following document type(s):
(i) For cost-type line items, including labor-hour or time-and-materials, submit a cost voucher.
(ii) For fixed price line items—
(A) That require shipment of a deliverable, submit the invoice and receiving report specified by the Contracting
Officer.

(B) For services that do not require shipment of a deliverable, submit either the Invoice 2in1, which meets the requirements for the invoice and receiving report, or the applicable invoice and receiving report, as specified by the
