THIS SOLICITATION IS FOR OEM NINTEX SUBSCRIPTIONS AND IS SET ASIDE FOR 100% SMALL
BUSINESSES
NOTICE TO ALL OFFERORS: The Government anticipates awarding a firm, fixed price contract in response to quotes/proposals received to this solicitation. As a result, the contract's pricing will not be subject to any adjustment on the basis of the contractor's increased costs due to COVID-19 and/or inflationary causes experienced during contract performance. Because a firm, fixed price contract places the maximum risk and full responsibility for all costs and resulting profit or loss on the contractor, offerors are advised to consider these risks when pricing their quotes/proposals.
1. This solicitation is for the procurement of NINTEX Subscriptions in support of SWFPAC. It is anticipated that this solicitation will result in an award/order of a Firm, Fixed-Price Supply type contract. Payment will be via WAWF.
2. The entire solicitation shall be filled out, signed, and returned as part of your quote. See block 8 on page 1 of the solicitation for the closing date and time.
3. The deadline for submission of questions regarding the solicitation’s terms, conditions, specifications, and/or the Statement of Work (SOW) / Performance Work Statement (PWS) is 2 days prior to the solicitation closing date.

4. Award will be made to the quote/offer that represents the best value to the Government. Note: the Government reserves the right to consider the past performance of all quotes/offers, conduct a price, past performance tradeoff, and award to other than the lowest price quote/offer. Additional Note: The Government may conduct a price realism analysis of any quote in response to this solicitation for the purpose of assessing whether an offeror’s price is so low as to evince a lack of understanding of the contract requirements or for assessing risk inherent in an offeror’s approach.
5. SINGLE AWARD FOR ALL ITEMS: Due to the interrelationship of supplies and/or services to be provided hereunder, the Government reserves the right to make a single award to the bidder whose quote is considered in the best interest of the government, price and other factors considered. Therefore, bidders who quote less than the entire effort specified herein may be determined to be unacceptable.
6. EXCEPTIONS: All bidders MUST note all exceptions from the solicitation’s terms conditions, specifications, and/or the statement of work / performance work statement, if any. It will be assumed that any quote without mention of any exceptions will take no exception from all specifications, terms and conditions, clauses, or provisions within the solicitation.
7. BRAND NAME: To be negotiated on a Brand Name basis for NINTEX Subscriptions per FAR 6.302. Interested persons may identify their interest and capability by responding to the requirement or submitting quotations prior to offer due date, which will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination not to compete this action based upon responses received to this notice is solely within the discretion of the government. The Brand Name Requirement is based on Annual subscription renewal of Nintex Automation Platform Enterprise edition. This is a software solution for custom forms and workflows for use in Microsoft SharePoint.

1. BACKGROUND:
SWFPAC currently has software solution for custom forms and workflows for SharePoint. SWFPAC hosts three SharePoint environments on separate networks (NIPR and SIPR). The newest environment, which hosts SharePoint Subscription Edition, consist of a servers running Windows Server 2022 and MS SQL 2019. SWFPAC has been using custom Nintex Forms and Workflows for mission critical programs and processes (NSO Monitor, Purchase Requests, SAAR approval routing) for several years so it is imperative that we maintain the solution in place to avoid the need for retraining IT staff on a new solution. Software must meet all General and Primary Technical requirements and majority of Supplemental Technical requirements listed below:
2. SCOPE/STATEMENT OF WORK:
Services to include:
1. Must provide technical support during normal business hours (Monday – Friday 8am -6pm Pacific Standard Time).
2. Must be able to provide on-site support, if requested.
3. Must be able to run on premise.
4. Must be able to be implemented easily.
5. Must be easily adapted by end users.
6. Must not require a new server (VM or HW).
7. Must be a no-code solution (not require coding experience).
3. DELIVERABLE ITEMS:
1. Vendor must be an established, reputable company. Verifiable by large customer base, industry Awards, partnerships, favorable 3rd party product reviews, etc.
2. Software must be able to operate on a DOD accredited network, to include, but not limited to DOD Public Key Infrastructure (PKI), Host Based Security System (HBSS) and Security Technical Implementation Guides (STIG).
3. COTS software must be already “USN approved” in Department of Navy Application & Database Management System (DADMS). https://www.dadms.navy.mil/.
4. Must have Proof of Support per SECNAVINST 5230.15, dated 10 April 2009 – “All commercial off the shelf software (COTS) require vendor support. The support shall be such that identified operational problems and security vulnerabilities are rapidly mitigated by vendor provided patches.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

252.232-7006 WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (JAN 2023)
(a) Definitions. As used in this clause—
“Department of Defense Activity Address Code (DoDAAC)” is a six position code that uniquely identifies a unit, activity, or organization.
“Document type” means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).
“Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.
“Payment request” and “receiving report” are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.
(b) Electronic invoicing. The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as authorized by Defense Federal Acquisition Regulation Supplement (DFARS) 252.232- 7003, Electronic Submission of Payment Requests and Receiving Reports.
(c) WAWF access. To access WAWF, the Contractor shall—
(1) Have a designated electronic business point of contact in the System for Award Management at https://www.sam.gov; and
(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.
(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/.
(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data Interchange, or File Transfer Protocol.

THE FOLLOWING NAVSUP LOCAL TEXT IS HEREBY MADE PART OF THE STATEMENT OF
WORK/PERFORMANCE WORK STATEMENT.
NAVSUP Fleet Logistic Center (FLC) Puget Sound (PS) may utilize contractor support through the AbilityOne Program, as needed, to perform contract closeout functions for this acquisition. Information, including business sensitive/confidential or proprietary data, that the offeror provides to the Government or information already in the possession of the Government may be viewed and utilized by the AbilityOne Program support contractor personnel during the course of its contract performance. The information that may be made available to the support contractor may include, for example, pricing and technical proposals, historical contract, pricing and performance information, Commercial Asset Visibility (CAV) reporting information and similar data/information.
By submission of a proposal in response to this solicitation, the offeror and its subcontractors consent to a release of their business sensitive/confidential or proprietary data to the Government's AbilityOne Program support contractor personnel in order to perform close out services. Prior to the release of any such information to the support contractor, the support contractor will have in place with the Government a Non-Disclosure/Non-Use Agreement in accordance with the terms of the AbilityOne Program support contract.
Offerors may execute their own Non-Disclosure Agreement with the AbilityOne Program (AbilityOne contact information available from the contracting point of contact). The support contractor must provide copies of the executed agreements to the Contracting Officer and the Contracting Officer's Representative (COR) for the support contract; and the offeror/contractor for this acquisition must provide copies of the executed Agreement to the Contracting Officer for this acquisition. If the offeror/contractor seeks such a Non-Disclosure Agreement with the AbilityOne Program support contractor, the Agreement must be executed no later than the date of final delivery under the resulting NAVSUP FLC PS contract.
