About this file

This document is a Justification and Approval (J&A) for the award of a sole source contract for the acquisition of various spares, repair/overhaul, modification, and data items for the CH-53K helicopter program. The contracting activity is NAVSUP WSS - Philadelphia.

The J&A cites the statutory authority under 10 USC 3204(a)(1) to award the contract on a sole source basis to Sikorsky Aircraft Division, the prime contractor for the CH-53K program. This is due to Sikorsky's position as the sole integrator and the only approved source of supply, as the program has not yet reached its Material Support Date (MSD) and the configuration and technical data required for competition has not been fully developed. The anticipated value of the contract is undisclosed. The contract action will be awarded no later than 2024-11-14.

This J&A is based upon the authority of 10 USC 3204(A) (1), only one or a limited number of responsible sources will satisfy agency requirements, as implemented by FAR 6.302-1

A/RMC 3,4

Acquire, for the second or subsequent time, directly from the actual manufacturer.

Acquire, for the first time, directly from the actual manufacturer.

A/RMSC H,Y

The Government physically does not have in its possession sufficient, accurate, or legible data to purchase this part/contract repair from other than the current source(s). This code is applicable only to parts under immediate buy/repair requirements and only for as long thereafter as the deficiency is under review for resolution and appropriate recoding. This code is only assigned at the conclusion of limited screening, and it remains assigned until the full screening process resolves physical data questions and results in assignment of a different A/RMSC. If one source is available, A/RMCs 3, 4, or 5 are valid. If at least two sources exist, A/RMCs 1 or 2 are valid.

The design of this part is unstable. Engineering, manufacturing, or performance characteristics indicate that the required design objectives have not been achieved. Major changes are contemplated because the part has a low process yield or has demonstrated marginal performance during tests or service use. These changes will render the present part obsolete and unusable in its present configuration. Limited acquisition/repair from the present source is anticipated pending configuration changes. If one source is available, A/RMCs 3, 4, or 5 are valid. If at least two sources exist, A/RMCs 1 or 2 are valid.

This acquisition will be solicited to

Sikorsky Aircraft Division (78286). This is pre-MSD and MSD is on or around 1 DEC 2023. Sikorsky Aircraft (SAC) is the Prime for the CH-53K and the only approved source of supply per NAVAIR. The CH-53K program is currently Pre-MSD/initial Operation Capability (IOC) phase of its development. At the IOC phase, the program has not reached the Material Support Date (MSD) projected for 01 December 2023, and the aircraft physical configuration audit has not been completed. Since the configuration and provisioning data have not yet been completely delivered to NAVAIR, all configuration changes are routed and approved via SAC. Presently, Technical Data (TD) is being updated as the platform configuration evolves, and the procedures, requirements, and instructions required to execute a competitive spares contract have not been fully developed. Technical Data (TD) in any form will not be fully developed/delivered until the program has reached MSD. SAC maintains all existing TD (drawings, repair manuals, depot level maintenance plans), specialized engineering skills, and the knowledge of the item(s) on this J&A. The components to be purchased are highly specialized, flight critical parts that must meet critical operational and reliability requirements.

SAC is the only integrator able to coordinate successful manufacture of these components and conduct detailed analyses of systems in order to integrate reliability improvements while maintaining configuration control prior to delivering the configuration to NAVAIR.

15 MAR 2019 Class Waiver of the Requirement to Post a Request for Information or Sources Sought Notice applies to this requirement

The proposed contract action was synopsized on the government-wide point of entry on 11/16/2023 and as a result

Market research was conducted in accordance with far part 10. The results of the market research conducted (or the reason(s) market research was not conducted) are as follows

7. Determination of Fair And Reasonable Cost

8. Actions to Remove Barriers to Future Competition

9. Any Other Facts Supporting Other Than Full & Open Competition

History

Competition cannot be supported for this platform (CH-53K) since SAC still owns the configuration, and the Technical Data (TD) in any form will not be fully developed/delivered until the program has reached MSD. In addition, the Initial Criticality Determination is not in JDRS for all but two of the items in the attachment; Line Items #2 and #4 are listed in JDRS as CAI with Sikorsky Aircraft Division (78286) as the approved source. Once the aircraft has reached MSD all AMC/AMSC will be re-evaluated based on Item Criticality and the availability of technical data provided to the government by SAC. The available technical data is insufficient for the development of new sources. Source Development Department files indicate no Source Approval Request (SAR) has been received from any party interested in becoming an approved source.

The contracting officer determines that the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.

For reasons set forth in Paragraph (5 & 6), NAVSUP WSS has no plans at this time to compete future contracts for the subject item covered by this document. If another potential manufacturing source emerges, NAVSUP WSS will assess whether competition for future requirements is feasible. Also, future requirements will be advertised on the government-wide point of entry.
