SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
The following have been modified:
PROPOSAL SUBMITTAL INSTRUCTION
1 GENERAL
A. Failure to provide all information required by this solicitation and any subsequent amendment(s) may render your offer to nonresponsive.
B. The Government intends to evaluate proposals and award a contract based upon initial proposals. Therefore, the Offeror’s initial proposal should contain its best terms in relation to the evaluation criteria. However, in accordance with the clause FAR 52.215-1, Instructions to Offerors - Competitive Acquisition, the Government may contact all or a limited number of Offerors with questions concerning its proposal.
C. With regards to L-215-H007, Submission of Questions by Offerors – Alternate I (NAVSEA)(FEB 2020), the point of contact for this solicitation is identified in Block 10 of the Standard Form 33 (SF33). Do not include Government drawings or Government protected information in the email unless the email is digitally encrypted per Federal Information Processing Standard (FIPS) Publication 140-3.
D. The solicitation is available only at SAM.gov. The Government may post additional information at SAM.gov relating to this solicitation (e.g. responses to questions, amendments, etc.). It is the Offeror’s responsibility to check the site for any such information.
E. With the exception of Attachment 1, Drawings, the Exhibits and Attachments identified in Section J are provided at SAM.gov. To obtain Attachment 1, Drawings, the Offeror must submit its request to the POC identified in Block 10 of the SF33. The request shall include company name; complete address; CAGE code;
DUNS number; and POC name, email address, and phone number. Attachment 1 is restricted by the Arms Export Control Act and Distribution Statement D. Attachment 1 will be provided only those companies that meet the following requirements:
1. K-227-W001, Instructions for Obtaining Export-Controlled Technical Data (NAVSEA)(OCT 2018). Only the POC identified in an active JCP certification found at https://public.logisticsinformationservice.dla.mil/jcp/search.aspx will be provided Attachment 1.
Instructions for completing and submitting the DD Form 2345 to request JCP certification can be found at https://www.dla.mil/HQ/LogisticsOperations/Services/JCP/DD2345Instructions/. The Government will not extend or delay the procurement for pending Contractor JCP certifications.
2. Per DFARS 252.024-7019, Notice of NIST SP 800-171 DoD Assessment Requirements, the National Institute of Standards and Technology (NIST) Special Publication (SP) 800-171 applies to this procurement. The Offeror shall have a current (not more than 3 years old), minimum Confidence Level assessment of “Basic” as identified in the NIST SP 800-171 Assessment Report within the Supplier Performance Risk System (SPRS). The Basic, Medium and High NIST SP 800-171 DoD Assessments are described in the NIST SP 800-171 DoD Assessment Methodology located at https://www.acq.osd.mil/dpap/pdi/cyber/strategically_assessing_contractor_implementation_of_NIST_SP_ 800-171.html. Guidance regarding the NIST SP 800-171 DoD Assessments can be found at https://www.sprs.csd.disa.mil/. The Government will not extend or delay the procurement for pending Contractor NIST SP 800-171 assessments.
F. In order to ensure compliance with all the specification requirements, the Offeror shall indicate in its offer and notify the Government in a cover letter, what specifications, if any, the Offeror does not intend to meet. The Offeror shall explain, in detail, how any proposed deviation/exception will nonetheless meet the Government's functional requirements; failure to do so may result in a rating of “unacceptable”. Failure to notify the Government of all exceptions prior to award may be grounds for contract termination. Should descriptive literature be supplied by the Offeror, it will be presumed that the Offeror intends to meet all of the specifications, regardless of the descriptive literature, unless the Offeror specifically notes its exceptions. If not exceptions are taken, clearly so state.
G. It is the Offeror’s responsibility to exercise due diligence to discover and to bring to the attention of the contracting officer at the earliest possible time, in writing, any ambiguities, discrepancies, inconsistencies, or conflicts in or between the specifications and the applicable drawings or other documents incorporated by reference herein.
H. Disposition of the Technical Data Package (TDP), including all drawings. All Offerors, except the awardee, shall destroy all copies/media of the TDP within 30 calendar days after notice of contract award, whether electronic or hard copy format. Offeror shall demonstrate past performance and the ability to deliver products of high quality by completing Attachment 4, Past Performance References, for up to three relevant contracts for the Offeror, and up to two relevant contracts for each major subcontractor. For purposes of this solicitation, a major subcontractor is defined as a subcontractor proposed to perform more than 30% of the per-unit cost for this requirement. The contracts identified must have been underway for at least six months or longer; been performed by the same CAGE Code or provide an explanation why the different CAGE Code is relevant past performance; and if completed, must have been completed within the past three years. If the Offeror does not have any Federal Government contracts, it may list State, local, commercial contracts, or performance on a subcontractor basis, in that order, to complete its Past Performance References. Offeror shall include an accessible point of contact, including name, telephone number, and email address for each reference provided. Failure to submit the Past Performance References may be considered certification that the contractor has no past performance for similar items for the Government to evaluate.
If the Offeror has not performed similar projects, it is requested to discuss other related projects that demonstrate its capability to perform work of similar size, scope, and complexity.
The Offeror is requested to include in its submittal the written consent from its proposed major subcontractors to allow the Government to discuss the subcontractor’s past performance assessment(s) with the Offeror.
2.3.3 Factor 3, Price

SECTION M - EVALUATION FACTORS FOR AWARD
The following have been modified:
PROPOSAL EVALUATION CRITERIA
1 GENERAL INFORMATION
A. The Small Business Subcontracting Plan shall be reviewed for compliance and adequacy for purposes of making a responsibility determination.
B. Lowest Price Technically Acceptable (LPTA) source selection procedures will be used for the evaluation of proposals received in response to this solicitation.
C. The Government may award to other than the Offeror with the lowest total price if the lowest price Offeror is found to be “Unacceptable” in any of the non-price factors.
D. Each factor will be evaluated on a stand-alone basis. However, information contained in one factor of the proposal may be used to assist the Government in evaluating the other factors of the proposal. Inconsistencies or disparities between the factors within a proposal may be considered an indication that the Offeror does not understand the requirements.
E. If it is determined that a proposal exceeds a Factor’s page limit identified in Section L, pages in excess of the specified page limit will be removed from the end of the submittal and will not be evaluated.
F. The Government intends to make award based on initial proposals without discussions, but reserves the right to conduct discussions if determined necessary (see FAR 52.215-1). Accordingly, Offeror is advised to submit its most favorable terms and conditions in its initial proposal. If unexplained discrepancies are identified, the proposal may not be considered for award.
G. It is the Offeror’s responsibility to provide clear indications of how its proposal meets the requirements of the
Statement of Work in Section C. If the proposal is not clear, it may be an indication that the Offeror does not understand the requirements.
H. Proposals may be evaluated without consideration of any proposed subcontractor that is deemed to have an organizational conflict of interest.
3 EVALUATION FACTORS FOR AWARD
The Government intends to award a contract resulting from this solicitation to the responsible Offeror whose proposal, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered. Proposals are evaluated for acceptability, but not ranked, using the non-price factors. The Offeror must be determined to have an “Acceptable” rating for all non-price factors before further consideration will be given.
The LPTA non-price factors include Technical and Past Performance. The Contracting Officer will select the proposal, in conformance with the solicitation, which is determined “acceptable” for Technical and Past Performance, and offers the lowest evaluated price.
A proposal that is rated “Unacceptable” for any non-price factor is unawardable. Therefore, if any non-price factor is rated “Unacceptable”, the Government reserves the right to not evaluate the remaining factors.
2.1 EVALUATION CRITERIA
2.1.1 Factor l, Technical
The Government will evaluate each Offeror's technical capability to perform the requirements in the solicitation and any subsequent amendments. The proposal will be evaluated for completeness, accuracy, quality of detail, and degree of demonstration for the following:
Subfactor 1a, Technical Capability
The quality of detail and the degree to which the proposal demonstrates the Offeror’s technical capability, approach, and unique skills or solutions to manufacture from the build to print drawing.
Subfactor 1b Technical Quality
The Offeror’s capability to provide a successfully implemented acceptable quality management system, including subcontractor oversight and material acquisition. A copy of the Offeror’s ISO 9001:2015, or comparable, certification.
Subfactor 1c, Technical Risk Management
1. The quality of detail and the degree to which the Offeror demonstrated its risk mitigation process, identified risk areas associated with this build to print requirement, and identified realistic, achievable risk mitigation strategies for the identified risk(s).
2. The quality of detail and the degree to which the Offeror addressed any constraints, anticipated difficulties, and assumptions that form the basis of its proposal.
Technical acceptability will be assessed according to Table M-1.
Table M-1: Technical Acceptable/Unacceptable Evaluation Ratings Rating Description Acceptable Proposal meets the minimum requirements of the solicitation.
Unacceptable Proposal does not meet the minimum requirements of the solicitation.
The Offeror’s technical proposal must be rated “Acceptable” to be further considered.
3.2 Factor 2, Past Performance
Past performance will be evaluated based on the Offeror’s demonstrated ability to satisfy its customers, deliver products and services of high quality, meet delivery schedules, and comply with applicable Federal, State, and local laws and regulations.
The Government may contact some or all of the Offeror’s references to ask questions such as: (1) was the Offeror is capable, efficient, and effective; (2) did the Offeror’s performance conformed to the terms and conditions of its contract; (3) was the Offeror was reasonable and cooperative during performance; (4) was the Offeror was committed to customer satisfaction; (5) did the Offeror meet proposed subcontracting goals, if applicable; and (6) did the Offeror hire and retain qualified personnel necessary for successful completion of the contract requirements.
The Government will evaluate up to three references for the Prime and up to two references for each proposed major subcontractor. References exceeding the quantity requested shall be removed from the end of the volume and will not be evaluated.
The Government may consider information obtained from sources other than those identified by the Offeror, including Federal, State and local Government agencies, better business bureaus, published media and any other sources available to the Government, to include, but not limited to, Contractor Performance Assessment Reporting System (CPARS), Supplier Performance Risk System (SPRS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), Federal Subaward Reporting System (FSRS), or other databases; the Defense Contract Management Agency; and interviews with Program Managers, Contracting Officers, and Fee Determining Officials.
The Government will consider recent and relevant past performance information obtained in relation to the scope of this requirement. It is the Offeror’s responsibility to relate its past performance to the requirements of this solicitation. Past performance, either positive or negative, which is considered by the Government to be more closely related to the scope of this effort will be given higher consideration in determining the Offeror’s past performance acceptability/unacceptability.
The Government will consider the Offeror’s past performance in complying with requirements of the clauses at FAR 52.219-8, Utilization of Small Business Concerns, and 52.219-9, Small Business Subcontracting Plan.
Relevancy, as it pertains to past performance information, is a measure of the extent of similarity between the product, complexity, dollar value, contract type, and subcontract/teaming, or other comparable attributes of past performance examples and the solicitation requirements; and a measure of the likelihood that the past performance is an indicator of future performance.
If the Offeror does not provide past performance information with its proposal, the Contracting Officer need not pursue further information if it is clear that the Offeror’s price is not competitive.
NOTE: In the case of an Offeror without a record of relevant past performance, or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (FAR 15.305(a)(2)(iv)). Therefore, the Offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral shall be considered “acceptable.”
Past Performance acceptability will be assessed according to Table M-2.
Table M-2: Past Performance Evaluation Ratings Rating Description Acceptable Based on the Offerors performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown. (See NOTE above.)
Unacceptable Based on the Offerors performance record, the Government does not have a reasonable expectation that the Offeror will be able to perform successfully the required effort.
The Offeror’s past performance must be rated “Acceptable” to be further considered.
3.3 Factor 3, Total Evaluated Price
The Offeror shall submit all pricing using SECTION B of the SF 33. The prices proposed in Section B of the SF 33, are contractually binding.
The Government will evaluate the Offeror’s price proposal for the following:
A. Completeness. An Offeror’s price proposal may be deemed non-responsive if, in the judgment of the
Government, the price proposal is incomplete, erred, or does not accurately reflect the Offeror’s proposed effort in meeting the technical requirements, thereby indicating that the Offeror does not understand the scope of the technical requirements. Any inconsistency, whether real or apparent, between promised performance and price shall be explained in the price narrative. Failure to submit a price on an item may result in the proposal being deemed non-responsive.
B. Balanced Pricing. The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between the base and option quantities and/or between line items. As defined in FAR 15.404, unbalanced pricing exists when, despite an acceptable total price, the price of one or more contract line items are significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.
C. Reasonableness. The Government anticipates making a determination of fair and reasonable pricing based on adequate competition. However, the Government may use any of the analysis techniques in FAR 15.404-1, either individually or in combination with each other, to determine that the final price is fair and reasonable.
D. Total Evaluated Price. The Government will evaluate proposals by determining the total evaluated price, calculated as follows:
1. For each Contract Line Item Number (CLIN), the quantity will be mulitplied by the proposed unit price to derive the total amount per CLIN.
2. Price Evaluation Preference for HUBZone Small Businesses per 52.219-4, Notice of Price Evaluation
Preference for HUBZone Small Business Concerns (Deviation 2020-O0008)(MAR 2020) will be applied, when applicable, to the sum of D.1 and D.2. This step adds 10% to all offers except HUBZone Small
Business concerns that have not waived the evaluation preference and otherwise successful offers from Small Business concerns.
3. The Total Evaluated Price will be the sum of all CLIN total amounts (D.1) plus the Price Evaluation Preference for HUBZone Small Businesses (D.2).
Evaluation of the option CLIN prices shall not obligate the Government to exercise the option.
Example: Total Evaluated Price
