INFORMATION FOR OFFERORS
NOTE 1 - QUESTIONS: All questions and inquiries shall be sent in writing as soon as practicable after receipt of solicitation. Questions shall be submitted via E-mail to Gina Pinion at gina.pinion@navy.mil no later than three (3) days prior to the closing date of the solicitation.
NOTE 2 - PROPOSED EXCEPTIONS TO RFP: Any exceptions or deviations to the Government specifications included in this solicitation must be clearly identified in a cover letter and submitted as part of your proposal. If deviations are proposed, the offeror shall provide an explanation of how the proposed item/service meets the requirements of the specifications. Failure to notify the Government of all deviations prior to award may be grounds for contract termination.
NOTE 3 - PROPOSAL SUBMISSION: Proposals may be mailed or hand-delivered to the following address:
Naval Undersea Warfare Center, Division Keyport Attn: Gina Pinion, Contract Specialist 610 Dowell Street, BLDG 206 Keyport, WA 98345
Offers may also be emailed to gina.pinion@navy.mil, or faxed to 360-396-7036, so as to arrive by the date and time specified.
See “Proposal Submittal Requirements” in FAR Clause 52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999) for a full description of proposal requirements.
NOTE 4 – DISPOSAL COSTS: The quantity identified as the MAX QUANTITY in the schedule is the estimated amount of material that will be disposed of pursuant to Orders issued under the contract during the ordering period applicable to the CLIN. When proposing on this solicitation, on the line designated UNIT PRICE enter your proposed price for disposal per unit disposed (e.g. drum, each). Multiply this unit price by the MAX quantity for that CLIN to determine the figure to be placed on the line indicated as the MAX AMOUNT. The price proposed for Disposal should include all costs for disposal not otherwise provided for by separate applicable CLIN. After contract award, the amount to be invoiced and the amount the government will pay for disposal will be determined by multiplying the UNIT PRICE by the number of corresponding units disposed of. One invoice will be prepared for each task order.
NOTE 5 – TRANSPORTATION CHARGES: CLINS designated for Transportation Charges provide a method to pay for transportation of the material to be disposed of. Each UNIT of transportation includes all transportation related costs for a complete round trip pick-up and disposal run. To determine the rate for the transportation CLIN items, include initial delivery of the tank or truck to the pickup facility, loading drums, and return transport to the disposal facility. Transoceanic shipment may be accounted for in either the applicable transportation CLIN or the price per drum for disposal. Transportation CLINs will include the price for Certificate of Disposal for all material disposed of.
NOTE 6 – MINIMUM GUARANTEE: As this will be an Indefinite Delivery, Indefinite Quantity type contract, the established minimum guarantee shall be $5,000.00.

52.211-14 NOTICE OF PRIORITY RATING FOR NATIONAL DEFENSE, EMERGENCY PREPAREDNESS, AND ENERGY PROGRAM USE (APR 2008)
Any contract awarded as a result of this solicitation will be a DX rated order; X DO rated order certified for national defense, emergency preparedness, and energy program use under the Defense Priorities and Allocations System (DPAS) (15 CFR 700), and the Contractor will be required to follow all of the requirements of this regulation. [Contracting Officer check appropriate box.]
(End of provision)
52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
EVALUATION INFORMATION:
1. Factor 1 - Technical Acceptability: Offers must demonstrate the ability to perform the requirements described in the Statement of Work in the solicitation and any subsequent amendments. The offer must be determined to be technically acceptable before further consideration will be given. The ability to perform the work as specified in the proposal submittal requirements will be evaluated to determine if the proposed method(s) meets or exceeds the requirements as specified in the solicitation document. The proposal will be evaluated for completeness and accuracy of information and if the proposal addresses each specific area of the Statement of Work. Evaluation will consider each offeror’s demonstration of the following:
A. The offeror possesses adequate facilities, processes, expertise, and experience to provide the required services B. The proposal identifies a complete approach in the functional area of hazardous material collection, transport, and disposal C. The offeror and all subcontractors maintain the necessary permits and licenses for performance of this work and that proposed trucks/trailers meet Department of Transportation approval D. The offeror has an acceptable training plan E. The offeror has designated approved disposal sites and transporters established for performance
Should the technical information be insufficient to determine technical acceptability, the government reserves the right to use other options such as internet research on company websites for services offered/proposed.
2. Factor 2 - Past Performance Acceptability: Past performance will be evaluated on the offeror’s ability to satisfy its customers in the past and compliance with applicable Federal, State, and local laws and regulations. Past performance references for efforts providing applicable experience relative to the purchase order requirements will be given higher consideration.
The Government may contact some of each offeror’s customers to ask whether or not they believe: (1) that the offeror is capable, efficient and effective; (2) that the offeror’s performance conformed to the terms and conditions of its contract; (3) that the offeror was reasonable and cooperative during performance; (4) that the offeror was committed to customer satisfaction; and (5) that the offeror was able to hire and retain qualified personnel necessary for successful completion of customer requirements. Additionally they may ask if given a chance would they select the same or a different Contractor and/or other questions related to the offeror’s ability in the areas outlined for this Factor.
The Government may consider past performance information obtained from sources other than those identified by the offeror, such as published media and electronic databases. Only past performance that is relevant to the specified item will be evaluated. It is the responsibility of the offeror to relate past performance to the specifications. Government evaluators may utilize federal, state, and local past performance databases including, but not limited to, Past Performance Information Retrieval System (PPIRS), Contractor Performance Assessment Reporting System (CPARS), and DLA’s Mechanization of Contract Administration Services (MOCAS) system. The Government may research offeror performance on any federal, state, local, and commercial contract performance of the offeror that is known to the Government, but not included on a submitted “Past Performance Worksheet." Additionally, the personal experience and evaluator knowledge of offeror performance may be utilized.
The Government will consider the relevance of past performance information obtained in relation to the scope of this procurement. Past performance, either positive or negative, which is considered by the Government to be more closely related to the scope of this effort, will be given greater weight in determining offerors’ Past Performance acceptability/unacceptability.
In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or is so sparse that no meaningful past performance acceptability determination can be made, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance.
In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
Note that, if the contractor does not provide past performance information with its offer, the Contracting Officer need not pursue further information if it is clear that the offeror’s price is not competitive.
3. Factor 3 - Price: Offerors are required to submit prices for all line items included in the solicitation.
Failure to submit a price for any line items may result in the offer being rejected as unacceptable. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the options(s). The prices will be compared to the Government Estimate, other offers received and/or other independent price and cost information.
The offeror must be determined to have acceptable technical and past performance before further consideration will be given; that is, selection of the contractor is to be based on the establishment of minimum requirements to be evaluated on an “acceptable” or “unacceptable” basis. Proposals are evaluated for acceptability but not ranked using the non-price factors. In order to be considered awardable, there must be an “acceptable” rating in every non-price factor. Lowest Price Technically Acceptable (LPTA) non-price factors include Technical and Past Performance. The Contracting Officer will select the offer, in conformance with the solicitation, which is determined technically and past performance acceptable and offers the lowest price.
No award will be made at other than a fair and reasonable price.
PROPOSAL SUBMITTAL REQUIREMENTS:
1. Technical Acceptability: To determine technical acceptability, offerors must provide all necessary information for a comprehensive technical evaluation. The information must clearly demonstrate that the technical approach meets the requirements outlined in the statement of work. Offerors must submit a technical proposal, consisting of no more than five (5) 8 ½” x 11” pages, that clearly demonstrates the following:
A. The offeror possesses adequate facilities, processes, expertise, and experience to provide the required services B. The proposal identifies a complete approach in the functional area of hazardous material collection, transport, and disposal C. The offeror and all subcontractors maintain the necessary permits and licenses for performance of this work and that proposed trucks/trailers meet Department of Transportation approval (Offeror shall submit copies of all permits and documentation of Department of Transportation approval for all trucks; this is not included within the 5 page limit)
D. The offeror has an acceptable training plan (Offeror shall submit a copy of the training plan with the proposal; this is not included within the 5 page limit)
E. The offeror has designated approved disposal sites and transporters established for performance (Offeror shall provide a list of disposal sites and transporters established for performance; this is not included within the 5 page limit)
If the services proposed do not meet all requirements of the Statement of Work, the offeror must identify any “exceptions” and state precisely how the offered services differ from the applicable paragraphs. Failure to comply with this requirement may result in rejection of the offer.
2. Past Performance Acceptability: Offerors shall demonstrate past performance by completing the attached
Past Performance Reference sheet for up to five (5) recently completed Federal Government contracts for like or similar items under this solicitation. Offerors shall include an accessible point of contact, including name and telephone number, for each reference provided. Offerors who have no Federal Government contracts may list state, local, or commercial contracts, in that order, to complete the Past Performance Reference sheet. Offerors are encouraged to submit brief and concise responses. Failure to submit the Past Performance Reference sheet may be considered certification that the contractor has no past performance for like or similar items for the government to evaluate.
3. Price: Offerors are required to submit prices for all line items included in the solicitation. Failure to submit a price for any line items may result in the offer being rejected as unacceptable.
4. Each offeror’s proposal shall contain the following:
A. Cover letter containing the following:
- The solicitation number;
- The name, address, telephone and facsimile numbers, and e-mail address of the offeror;
- The DUNS Number and CAGE Code of the Offeror;
- A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and agreement to furnish any or all items upon which prices are offered at the price set opposite each item;
- Offerors shall indicate that prices are valid for 90 days from date of solicitation closing;
- Names, titles, phone numbers, facsimile numbers, and e-mail addresses of persons authorized to negotiate and sign on the offeror’s behalf with the Government in connection with this solicitation.
B. Completed solicitation package (Standard Form 1449), including pricing for all line items.
C. Technical Proposal, in accordance with Proposal Submittal Requirements described above, stating services proposed are in accordance with all requirements of the Statement of Work.
D. Completed Past Performance Reference Sheet, as described above.
