Performance Work Statement
1. General. This is a service contract to provide personnel, supervision, supplies and other items and services necessary to perform the cleaning, cashier, food service, and operation of the sculleries defined in this Performance Work Statement (PWS), except as specified in Section C-3 as government furnished property and services at Nutrition Management Department, Building 1, Naval Medical Center, San Diego (NMCSD), CA 92134.
1.1. Scope of Work. The quality of service provided by the Contractor is expected to meet or exceed the current recognized standards established by The Joint Commission and all applicable provisions of law of all Government authorities pertaining to regulation of food service personnel, medical treatment facilities, workplace safety and the regulations and standards of Nutrition Management Department and Naval Medical Center San Diego (NMCSD). The Contractor shall adhere to and comply with all Department of Navy (DoN), Bureau of Medicine and Surgery (BUMED) and NMCSD instructions and notices, which may be in effect during the term of the contract. See section 6.0 of this PWS.
1.1.1. These specifications require Contractor performance of all actions necessary and proper for, or incidental to, the contracted functions. Anything not directly specified, but necessary to the carrying out of the intent of this contract, and the complete and proper execution of the services, shall be performed by the Contractor as if it had been specifically described. Should equipment problems or unusual circumstances require alternative methods of accomplishing the tasks in this contract, the Contractor shall continue to perform required functions. The estimated quantities of work are contained in Technical Exhibits 2a and 2b.
1.1.2. The major tasks incorporated under this contract include, but are not limited to the following:
1.1.2.1. Clean and sanitize the cafeteria, dining room, serving lines and self-serve areas, scullery, pot & pan room, rear platform, passageways, lavatories, offices, front platform and walkway/entryway spaces, staging and storage areas shown in Technical Exhibit 3. This includes the furnishings (inside and outside), equipment and patient carts in these spaces.
1.1.2.2. Clean and sanitize of all partitions, floors, drains, walls, baseboards, ceilings, louvers, vents, fans, doors (interior and exterior), furniture, fixtures, bright work, windows/glass (interior and exterior) and food service equipment in assigned areas.
1.1.2.3. Clean and sanitize dining ware and food preparation items using scullery and pot & pan equipment.
1.1.2.4. Distribute clean food service equipment, utensils, dinnerware, condiment containers, carts and trays for the gallery, dining room and patient use to point of use before, during and after each meal service.
1.1.2.5. Police all tables during meal periods to ensure continuous cleanliness and availability for use by patrons. This includes bussing all tables of materials not cleared by customers in all dining areas. Contractor can expect to bus no more than 1% of patron trays in cafeteria dining areas.
1.1.2.6. Cashier all meal periods and collect cash for after-hours meals for hospital patients and guests. For meal periods, man cash registers thirty minutes prior to lunch only (including Thanksgiving and Christmas days), during meals, and ten minutes after all galley meal hours. Contractor Manager/Supervisors shall accept payment for special and/or guest meals after meals service hours but only during Contractor normal working hours.
1.1.2.7. Obtain beverages and paper products from storage for meal service and ensure that the areas are replenished in a timely fashion during meal service.
1.1.2.8. Place all condiments on tables and serving areas before meals and remove all items at end of meal service and place is proper storage area.
1.1.2.9. Practice environmental compliance by properly collecting/disposing recyclable products collected from meal service, food waste collected for the utilization of compost, minimizing trash and utilizing environmentally safe chemicals in the cleaning process.
1.1.2.10. Provide additional food service workers during contingency situations, i.e. military manning shortages and deployments. Historically, the department loses fifty-percent of its Culinary Specialists to the USNS Mercy for an extended period of time every one to two years. The additional food service workers allow the continuation of food services.
1.2 Personnel
1.2.1. General. The Contractor shall furnish managerial, administrative, and direct labor personnel to accomplish all work required. The work force shall be adequately trained and under the Contractor’s supervision at all times. An on-site manager shall be assigned as a full-time manager with authority to manage the entire operational contract work force. In the absence of the on-site manager, a designated supervisor or lead food service worker shall be placed in charge of operations. The Contractor shall furnish the names of on-site manager and other key supervisors in writing, including written notice to the COR stating who is acting manager-in-charge in the absence of the on-site manager. The duties and qualifications for on-site personnel shall be:
1.2.2. On-Site Manager. This individual shall be responsible for the overall management and coordination of this contract and shall act as central point of contact with the Government. He/she shall not (except in emergencies) perform a dual role as the contractor service employees. Minimum qualifications for this position are at least five (5) years of working experience in Government/commercial galley/kitchen and dining room facilities with equipment and operations equivalent to that involved in the performance of this contract. A minimum of three (3) consecutive years of such work experience must have been in a Food Service operation with a volume exceeding 1,000 meals per day within the last five (5) years. Additionally, the on-site manager shall have at least one year of experience administering Joint Commission standards as related to Food Service and evidence of complying with those standards.
1.2.2.1. The On-Site Manager, or alternate, shall be available during normal duty hours to meet on the installation with Government personnel designated by the Contracting Officer or COR to discuss problem areas. After normal operating hours, the manager or designated alternate shall be available within three (3) hours.
1.2.2.2. The On-Site Manager, and alternates, shall effectively communicate in the English language, to include speaking, reading and writing.
1.2.2.3. In case of termination of the On-Site Manager, temporary use of an alternate on-site manager shall not exceed six (6) weeks before a new, fully-qualified on-site manager is employed and functioning on-site.
1.2.3. Mess Attendant/Food Service Worker Supervisor(s). Assigned as full‑time, on the job, first-line supervisors responsible for supervising the performance of all required mess attendant functional duties assigned by the On‑Site Manager. He/she shall not (except in emergencies) perform a dual role as a Mess Attendant. Minimum acceptable qualifications for this position shall include at least three (3) years of working experience, within the last five (5) years, in Government/commercial galley/kitchen and dining room facilities with equipment and operational equivalent to that involved in the performance of this contract. A minimum of one (1) year of such work experience within the last three (3) years must have been as supervisor in such operation or as a combination of mess attendant lead worker in all the different functional areas, plus specialized supervisory training which equated to such supervisory experience.
1.2.3.1. Under this contract, a contractor supervisor shall be present during all hours while contract employees are working.
1.2.4. Other Contractor personnel requirements
1.2.3.1. All personnel shall be able to speak and understand the English language.
1.2.3.2. Cashiers shall be able to effectively utilize mathematical concepts, such as addition, subtraction, division and multiplication, and shall be able to effectively operate Government-furnished cashiering equipment.
1.2.5. Uniforms. Contractor personnel shall present a neat appearance and be easily recognized. They shall wear the Contractor-furnished uniforms when on duty. Uniforms shall be well fitting, laundered, and of good repair. Employees shall wear a clean uniform each day. The standard of dress for supervisors shall be approved by the Contracting Officer’s Representative (COR) before the contract start date. Shoes shall be of sturdy construction and shall cover the foot to meet sanitation and safety requirements. Open-toed shoes, sandals, canvas sneakers and heels higher than two (2) inches, shall not be worn.
1.2.5.1. Uniforms shall not contain commercial advertising except ball cap hats and name tags, which may contain the Contractor’s company name. All personnel shall wear visible name tags furnished by the Contractor with a minimum of the last name. In addition, the tags worn by the On-Site Manager and supervisors shall indicate their job title.
1.2.5.2. The Contractor is responsible for laundering and replacing Contractor employee uniforms. Hair nets, ball caps, facial masks and aprons shall be supplied by the Contractor and shall be worn by all personnel where appropriate to meet sanitation and safety requirements.
1.2.5.3. All shoes shall have non-skid soles to minimize slippage on wet floors. Employees working in the scullery or pot & pan areas are required to wear safety shoes and ear plugs. Safety shoes, with a built-in protective toe box, will conform to American National Standards Institute (ANSI). All shoes and ear plugs shall be supplied by the Contractor as required by the Contractor’s OSHA-compliant safety program.
1.2.5.4. The employee’s uniform shall consist of: white shirt, blue trousers, socks, blue apron/smock, dark blue or black shoes, name tag and NMCSD security ID badge.
1.2.5.5. In addition to contractor furnished name tags, NMCSD requires a hospital security ID badge be worn by all employees once security clearance procedures are complete. These badges shall be visibly worn at all times while at NMCSD. Hospital security badges will be provided by the Government.
1.2.6. Medical Fitness. The Contractor shall furnish personnel who are medically fit, trustworthy, competent and well qualified for their work. Prior to the Contract start date, the contractor shall furnish, at his expense, a current medical certificate for each employee in the kitchen, dining room and food handling facilities, or who in any way, comes in contract with the handling of food in carrying out provisions of this contract. The certificate shall certify that the employee is free from any communicable disease (especially evidence of tuberculosis and hepatitis A). Contract personnel shall be, at all times, subject to inspection and physical examination by Government medical authorities to insure that proper sanitation standards are maintained. Serology and stool examinations shall be accomplished at the discretion of the medical officer. Personnel who are ill or have open cuts or infectious lesions, particularly of the hands, arms, face or neck or acne or boils of the face, shall be prohibited from performing food service duty. All food service personnel who have been away from their duties for thirty (30) days or more shall have a medical examination prior to resumption of duty. If any of the Contractor’s employees are found medically unfit to perform their duties under this contract, the Contractor shall promptly remove and replace them with medically-examined and fit persons.
1.2.7. Personnel Sanitation Requirements. The Contractor shall follow NAVMED P-5010, Chapter 1 Food Service Sanitation, and all NMCSD instructions and policies on sanitation and health standards. The Contractor shall ensure that employees meet the following personal hygiene requirements:
1.2.7.1. Employees shall wash their hands and exposed portions of their arms, in accordance with Navy Preventive Medicine standards (using soap, warm water and vigorous rubbing for at least 20 seconds), as often as necessary to remove soil and contamination and to prevent cross contamination when changing tasks. Washing hands is required at the following times: upon reporting for work; after touching bare body parts; immediately after visiting or cleaning a lavatory; after coughing, sneezing, using a handkerchief, eating or drinking; after smoking; after taking a break; after handling soiled equipment or utensils; immediately before working with food, clean equipment or utensils: and after handling garbage or otherwise soiling their hands. Always wear plastic gloves when in direct contact with food.
1.2.7.2. Employees shall remove wrist watches, necklaces, bracelets, dangling earrings and rings (plain wedding band is permitted) while preparing and serving food.
1.2.7.3. Employees fingernails shall be kept clean and trimmed short so that they do not extend beyond the end of the fingers. Fingernail polish (including clear nail polish) and fake nails are not authorized in food preparation and serving areas.
1.2.7.4. Employees shall not smoke, use tobacco in any form, eat or drink except during break periods in designated areas.
1.2.7.5. Employees shall trim facial hair to one (1) inch or less and wear appropriate snood guards at all times while cleaning and sanitizing food contact surfaces.
1.2.7.6. Employees shall wear acceptable hair restraints (hats, caps, hair nets, which are provided by the contractor) to prevent loose hair from falling into food or onto food contact surfaces. Hair must be effectively restrained by appropriate head covering in the front, back, and sides.
1.2.8. Training General. The Contractor shall develop and be responsible for the cost and provision of all training necessary to perform the work in this contract, unless specified as government-furnished. The Contractor shall also comply with all NMCSD command training requirements, to include, but not limited, to maintenance of records and attendance at Command Orientation. Maintenance of records and competency training must meet Joint Commission standards.
1.2.8.1. Scope. Initial instruction and subsequent semiannual refresher training shall be given to all food service personnel employed for periods of 30 days or longer. Those personnel assigned food service duties for less than thirty (30) days shall be given at least two (2) hours of on‑the‑job training by competent supervisors. Permanent food service personnel shall receive continuous on‑the‑job training and instruction.
1.2.8.2. Food Sanitation Training. All contract employees require a minimum of four (4) hours of initial food sanitation and safety training and four (4) hours of annual refresher training, as described in the Tri-Service Food Code, NAVMED P-5010-1. New contract personnel shall receive this training within the first thirty (30) days of employment. The Contractor’s On-Site Manager and supervisors must attend the Government-conducted Food Manager Course upon hire and every three years thereafter.
1.2.8.2.1. Sanitation training may be conducted by medical department personnel, environmental health officers, environmental sanitation officers, preventive medicine technicians or other Government personnel qualified to conduct food sanitation training.
1.2.8.3. Training Requirements. Training specified in 1.2.8.2 shall in no way limit the amount of training necessary to meet specific requirements for the food service facility. When feasible, a portion of the training program shall be presented in the food service area. This provides an effective means whereby actual food service equipment and utensils can be utilized to demonstrate correct and incorrect usage.
1.2.8.3.1. Training shall include, at a minimum, the following topics:
1.2.8.3.1.1. Familiarization with all written Contractor technical and quality control procedures and instructions.
1.2.8.3.1.2. Basic bacteriological concepts, including how disease is caused, transmitted and prevented, reduced or contained through proper housekeeping methods.
1.2.8.3.1.3. Infection control relating duty function to all requirements of this contract.
1.2.8.3.1.4. Proper safe use, and handling of germicidal detergents, supplies, equipment and cleaning supplies.
1.2.8.3.1.5. Proper care and maintenance of all Contractor and Government-furnished equipment and property.
1.2.8.3.1.6. Familiarization with local command policies, such as fire prevention, safety, disaster preparedness, English in the work place and sexual harassment.
1.2.8.3.1.7. Employee personal hygiene.
1.2.8.3.1.8. Energy conservation practices.
1.2.8.3.1.9. Customer service and patient satisfaction.
1.2.8.3.1.10. Familiarization with dietetic service standards specified by The Joint Commission.
1.2.8.4. Each contract employee may receive one (1) hour of Government-provided developmental training as necessary throughout the contract period. Developmental training shall be structured to correct deficiencies in Contractor employees’ performance found as a result of supervisory review.
1.2.8.5. Each contract employee shall attend at least two (2) hours per year of Government‑provided fire prevention lectures as scheduled by the Food Service Officer (FSO), to be held between 0800‑1630 Monday thru Friday, at no additional cost to the Government or Contractor. It is up to the Contractor to schedule employees for the lecture. Space will be provided to the Contractor sufficient to hold these training sessions.
1.2.8.6. Contract employees are required by NAVMEDCEN SANDIEGOINST 1572.1C to complete Command Orientation within thirty (30) days of employment.
1.2.8.7. The Contractor shall maintain an individual training record for each contract employee. Training records shall be furnished to the Government for review, upon request. Training records should include, at a minimum, the position description, sanitation training card, and all training attended by the employee.
1.2.9.
Security Clearance. The Contractor shall furnish the FSO or COR the names of all personnel hired to perform work under this contract. The names are to be accompanied by a brief personal history statement, to include but not limited to:
(a) Statement of facts of any criminal convictions other than minor traffic violations
(b) Statement and facts of any conviction in a military or civil court
(c) Statement and facts of membership in any organization which advocates the overthrow of the United States Government
(d) A record of employment covering the immediate proceeding year
1.2.9.1. NMCSD’s Security Officer, or his/her designated representative, will determine the suitability and qualifications of each employee for security approval. For all persons considered qualified, the Security Officer will issue identification as required for access to the activity. For all persons not considered qualified, the Contractor will be notified in writing of such rejection. The Contractor may furnish additional names and personal histories of substitute employees for consideration. No person may perform services under this contract until approval has been granted by the Security Officer. Identification furnished for acceptable employees will be returned to the FSO immediately when such employees are no longer employed under this contract.
1.2.9.2. Material Management Department will provide each qualified Contract employee a hospital identification badge, as required to access the activity. No person may perform services under this contract until approval has been granted by the FSO or COR. Once a contractor is no longer employed under this contract, their identification badge will be returned to the Material Management Department immediately when such employees are no longer employed under this contract.
1.2.9.3. All personnel employed by the Contractor in the performance of this contract, or any representative of the contractor entering the government installation, shall abide by all security regulations of the installation. The Government reserves the right to direct the removal of an employee for misconduct or security reasons. This action does not relieve the Contractor from total performance of the contract tasks specified herein.
1.2.9.4. Keys. The contractor may be provided keys or allowed access to all buildings and rooms requiring services specified in this PWS. The Government may choose to accompany Contractor personnel when in certain secured areas. Keys provided to the Contractor shall not be duplicated or removed from premises. Only managerial/supervisory personnel will be issued keys and they shall be in their possession while they are on duty. Any keys lost by Contractor personnel shall be replaced by the Government at the Contractor’s expense. In the event a key is lost or duplicated, all locks and keys on that lock system shall be replaced by the Government, and the total cost shall be deducted from the monthly payment due to the Contractor. If a key to a single area is lost, the lock for that area shall be replaced by the Government, and the total cost shall be deducted from the monthly payment due to the Contractor. The contractor shall immediately report the loss of a key to the FSO.
1.2.10. Status of Employment. All employees of the Contractor employed in the performance of work under this contract shall be employees of the Contractor at all times and not employees of the Government. Only employees approved for and specifically hired to work in the food service area will be allowed to perform work under this contract. No alien shall be employed who does not have a valid U.S. Immigration and Naturalization Service Form I-151 (Alien Registration Card). The Contractor shall not employ any alien in the performance of work under this contract; it would be in violation of the immigration laws of the United States.
1.2.10.1. The Contractor is specifically prohibited from hiring active duty military personnel to perform work under this contract.
1.2.11. Temporary Use of Military Personnel to Supplement Contractor Personnel. The Contractor is prohibited from hiring military personnel to perform services under this contract. If the Contractor fails to adequately perform any essential tasks or does not furnish the number of employees required to perform the services called for in this contract, the Commanding Officer of the activity may assign military personnel to perform services. Such action by the Government will not relieve the Contractor of his responsibility for performance. The Government may invoke termination for cause for work not performed. The Contractor shall compensate the Government for the services of such military personnel as may perform work under the contract. The compensation shall be either (1) the rates then set forth in the Navy Comptroller Manual, par. 035750, as amended, or (2) the cost to the Contractor for personnel performing the work which it was found necessary to assign military personnel to perform, whichever is the greater. The amount of compensation will be deducted from the Contractor's invoices for services performed under the contract, or in such other manner as the Contracting Officer may direct.
1.2.12. Employee’s Meals General. Contractor personnel working in the dining facility during meal periods may, at the Contractor’s discretion, purchase and consume meals while on duty during designated break times. The Contractor will be charged the full, established rate for the applicable meal period for any Contractor employee observed consuming Government subsistence (snacking).
1.2.13. Miscellaneous
1.2.13.1. The use of tobacco and tobacco products by Contractor personnel during break periods will be confined to those areas which have been designated by the activity Commanding Officer as smoking areas.
1.2.13.2. Carrying aboard or use of alcoholic beverages or illegal drugs by Contractor personnel is strictly forbidden and any violation shall be cause for an immediate order for removal of the offender(s) by the Contractor from further work under this contract and subject to any applicable Federal laws. The Government may also impose civil and criminal penalties for such actions upon trial and conviction. Contractor employees will be subject to Government drug surveillance procedures.
1.2.13.3. Contractor employees shall not loiter in any working or patron area. Upon completion of their assigned shift, employees shall promptly depart from the food service facilities.
1.2.13.4 At times the Contractor will perform services in spaces where other persons may be working or passing through. The Contractor shall perform the services in a manner which will not endanger, interfere with, nor delay the activities of the other persons, and arrangements shall be made so that the activities of the Contractor shall be in harmony with the activities of the other persons.
1.2.13.5. In performing the services required hereunder, Contractor employees shall use provided lavatory, toilet and dressing room facilities. The use of such provided spaces is governed by regulations established by the Commanding Officer and such regulations shall be strictly enforced by the Contractor or his authorized representatives.
1.3. Quality Control
1.3.1 General. The Contractor shall establish and maintain a complete quality control program to assure the requirements of the contract are provided as specified. An updated Quality Control Plan shall be submitted to the contracting officer as changes occur thereafter. The plan shall include:
1.3.1.1. An inspection system covering all the services required by this contract. It must specify the areas to be inspected on either a scheduled or unscheduled basis, how often inspections will be accomplished, and the title of the individuals who will perform the inspection.
1.3.1.2. The methods for identifying and preventing defects in the quality of services performed before the level of performance becomes unacceptable.
1.3.1.3. Written Instructions and Procedures. The Contractor’s Quality Control Program shall include written work instruction and procedures to complete the work specified in this contract. These work instructions and procedures shall comply with the standards established by The Joint Commission for dietary services. The FSO shall be on the document distribution list for all changes to written Contractor instructions and procedures.
1.3.1.4. On-site records of all inspections conducted by the Contractor and necessary corrective action taken. This documentation shall be made available to the Government during the term of the contract.
1.4. Quality Assurance
1.4.1.
The Government will evaluate the Contractor’s performance under this contract in accordance with Technical Exhibit 1, Performance Requirements Summary (PWS) and associated QA documents.
1.4.2.
Sanitation Inspections. In addition to inspections of Contractor performance by the COR and Quality Assurance Evaluators (QAE), medical services personnel will also inspect for compliance with sanitary standards. In writing, both QAEs and medical services personnel report any Contractor discrepancies causing unacceptable performance to the COR who will take the appropriate action. Sanitary deficiencies require immediate correction and may be cause for shutdown of the facility until sanitary standards can be restored.
1.4.3. Meetings
1.4.3.1. Performance Evaluation Meetings. The On-Site Manager may be required to meet at least weekly with the Material Management Department, QAE, COR and FSO during the first month of the contract. Meetings will be as often as necessary thereafter as determined by the COR and FSO. In addition, if requested by Contractor or Government, a meeting will be held whenever a Contract Discrepancy Report is issued. The written minutes of these meetings, prepared by the COR, shall be signed by the On-Site Manager, FSO, and the COR. Should the Contractor not concur with the minutes, the Contractor shall state any areas of non-concurrence in writing to the COR within seven (7) calendar days of receipt of the signed minutes.
1.4.3.2. When scheduled through the Department Head or COR, the On-Site Manager shall attend meetings related to the performance of the requirements of this contract.
1.4.4 Patron Surveys. The Government conducts customer surveys and solicits customer comments in other ways.
1.4.4.1. Survey Representatives of the Naval Supply Systems Command, or other Department of Defense representatives, may survey the services from time to time during the period of this contract. Contractor personnel shall cooperate fully with such representatives during survey visits.
1.5. Hours of Operation
1.5.1.
The normal operating hours for the dining facility are listed in Technical Exhibit 2A. Contractor employees will normally perform their duties between 0500 and 2000. The galley will be secured at 2000; no Contractor employee will be permitted to stay late. Cleaning of the serving areas shall not start until Government personnel are satisfied the serving areas are no longer required for patron service (normally 15 minutes after the end of posted meal hours).
1.5.2. The FSO may change the meal hours by giving the Contractor notice twenty-four (24) hours in advance of such change.
1.5.3 Special Meals. The Nutrition Management Department serves special celebratory meals and is open for lunch on Thanksgiving and Christmas Day. Increased patronage can be expected and extended meal hours may be necessary. Schedule changes due to special occasions or holidays will be made available to the Contractor at least five (5) days prior to the date.
1.5.4. Dining and Executive Dining Room Functions. The dining rooms may be used for special functions, such as the enlisted advancement exams. The preparation and cleaning of the dining rooms will need to be scheduled to accommodate such functions. The Contractor will be given notice at least twenty-four (24) hours in advance. The Contractor may be tasked with set-up and breakdown of a special function and clean special event dinnerware such as listed in Technical Exhibit 5C.
1.5.5.
Authorized Guests. Department of Defense (DOD) personnel and their guests are permitted to eat in the dining facilities as authorized by the installation commander. These patrons, except as noted by the FSO, will be handled as other patrons of the general mess.
1.6. Contingency
1.6.1. Emergency Service. Emergency situations (for example: Accident and rescue operations, civil disturbances, weather warnings, installation alerts) may require the dining facility to operate on an extended basis of up to twenty-four hours per day. The Contractor shall provide these services when required by the FSO.
1.6.2. Mobilization Support. The Contractor shall support contingency requirements as set forth in Nutrition Management Department’s Contingency Plan, upon direction of the Contracting Officer.
1.6.3. On occasion, the Contractor’s service may be required at a different level of service (i.e. alerts, disaster situations, structural fire, rescue operations, etc.). The Contracting Officer will notify the contract manager or alternate if this should occur.
1.6.4. The Contractor shall be familiar with the MTF’s Emergency Management Program (NAVMEDCEN SANDIEGOINST 3440.5B) and shall participate in exercises at no additional cost to the Government.
1.6.5. The Contractor shall establish an emergency recall system for Contractor employees who may be required to work in the event of a disaster. The Contractor’s emergency recall system shall require that the Contracting Officer, COR, or FSO notify only one Contractor representative of a disaster situation to initiate the Contractor’s recall system.
1.6.6. The Contractor’s instructions and procedures manual shall include written guidance on the services that are anticipated to be required of Contractor personnel during various disaster scenarios.
1.6.7. As specified in 1.1.2.10, provide additional food service workers to allow the continuation of food services.
1.6.7.1. Assist cooks and military Watch Captains with meal preparation; set-up all serving lines (speed, main, soup and salad bar) and serve cafeteria meals to all authorized patrons using standardized rationed portion control.
1.6.7.2. Deliver patient meal carts to their respective wards. Pass trays to patients verifying two patient identifiers, full name and date of birth (DOB).
1.6.7.3. Clean and sanitize the serving lines and assigned work space areas, shown in Technical Exhibit 3. This includes equipment and patient carts in kitchen and serving spaces.
1.7. Safety Rules and Regulations. In performing the services required hereunder, the Contractor shall conform to all safety rules and regulations applicable to the MTF in effect during the time of performance of this contract and shall take such other precautions as may be reasonably required hereunder to assure accident-free performance. All accidents, however, which may arise out of or in connection with the performance of services required hereunder, and which result in injury, death or property damage, shall be reported in writing to the FSO with a copy to the COR within twenty-four (24) hours after such accident occurs. Such reports shall give full details of the accident involved, including statements of witnesses. If any claim is made by a third party against the Contractor on account of any accident which occurs in connection with performance of this contract, the Contractor shall promptly report the facts, in writing to the COR.
1.8. Reporting. The Contractor shall submit employee work schedules to the COR or FSO by the 20th of each month for the following month and as changes occur.
1.8.1. The contractor shall report all contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract via a secure data collections site. The contractor is required to completely fill in all required data fields using the following web address: http://www.ecmra.mil/
1.8.1.1. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2018. DEFINITIONS
Acceptable Quality Level (AQL). The AQL is the maximum percent defective, the maximum number of defects per hundred units, or the number of defects in a lot on the average that may occur before the Government will affect the price computation system in accordance with the Performance Requirement Summary and the Inspection of Services clause. An AQL does not allow a contractor to knowingly offer defective services, but limits reduced payment to circumstances in which defective performance results in a measurable reduction in the value of services rendered.
Contracting Officer’s Representative (COR). An individual appointed in the contract who functions as the representative of the Contracting Officer in the administration of the contract and who monitors the contractor performance. The specific COR duties are outlined in the Contract Administration Plan. The COR may be the Food Service Officer and may also serve as the QAE, both of which are defined below.
Deck. All floor areas.
Defective Service. A unit of service which contains one or more defects, or non-conformance with specified requirements.
Director, Security Department, of the Activity. Designated as the official representative of the Contracting Officer to determine security clearance and enforce the traffic and security regulations.
Disaster Control Plan. A contingency plan developed by the Government to handle potential major and minor disruptions in services caused by hurricanes, floods, utility failures, strike, and/or loss of personnel resulting from military pullout.
Early Feeding. A period of time before the dining room opens when Nutrition Management staff and Contract employees are allowed to purchase and consume their meals. NMCSD has early feeding before the lunch meal.
Equipment. Items used in the storage, preparation, cooking, transporting, and serving of food. It also includes items used in cleaning and sanitizing, as well as those for transportation and storage of supplies.
Food Handlers. Food service personnel, who work where unsealed food or drink is handled, processed, prepared, or served, and who touch food or food contact surfaces in any way. Excluded are food service manager and cashiers who do not handle unwrapped food or touch food contact surfaces.
Food Service Officer (FSO). An Officer, non-commissioned Officer, or civilian responsible for matters relating to food service in the Nutrition Management Department. Serves as the focal point for the Government’s surveillance of the food service contract. Advises the Contracting Officer on matters relating to the contract. May act as the COR or an alternate COR. May also be a QAE or be responsible for assigning a QAE.
Galley. The main food preparation area also referred to as the kitchen.
Garbage. Animal, vegetable and other waste resulting from handling, preparing, cooking and consuming food.
General Mess. Portion of building under contract, also referred to as dining facility.
Lot. The total number of service outputs in a surveillance period, as defined in the AQL column of the Performance Requirements Summary.
Major (Second Echelon) Maintenance. The maintenance and repair of equipment, including the restoration or replacement of parts, as needed because of wear and tear, damage, failure of parts, or the like.
Master-at-Arms (MAA). Active duty military person appointed by the Activity to maintain good order and discipline during meal serving hours. The MAA will ensure that patrons adhere to command policies during meal hours and provide information, customer service and conflict resolution.
Meal Serving Hours. Hours designated by the Government when the dining facility is open for service.
Medical. Medical Officer of the Activity, the cognizant Regional Medical Center and/or Environmental Preventive Medicine Unit are designated as an official representative of the Contracting Officer to perform sanitation inspection of the Contractor’s performance and to rate such performance.
Medical Treatment Facility (MTF). An activity providing outpatient and/or inpatient healthcare services for authorized personnel.
Minor (First Echelon) Maintenance. Normal operator care of equipment which is recommended by the manufacturer. It is limited to cleaning, oiling, greasing, tightening of nuts and bolts, and other minor tasks.
Patient Tray Line (PTL). Assembling, portioning and labeling food for delivery to inpatient units.
Performance Requirements Summary (PRS). A list of the primary products (i.e. service outputs) of the contract that will be evaluated by the Government to assure contract performance standards are met by the Contractor.
Performance Work Summary (PWS). A summary of general facility spaces, equipment and utensils listing minimum cleaning technique and routines required.
Public Works Officer of the Activity. Designated as the official representative of the Contracting Officer to order necessary repair to Government equipment and to notify the Contractor if any responsibility relative thereto, as set forth in the “Use, Conservation, and Responsibility for Government Property” clause.
Quality Assurance. Those actions taken by the Government to assure services meet the requirements of the Performance Work Statement (PWS).
Quality Assurance (QA) Assessment. QA is the method used by the Government to provide some measure of control over the quality of goods purchased and/or services received, as required by this contract.
Quality Assurance Evaluator (QAE). A Government person(s) responsible for surveillance of contractor performance. The QAE may also serve as the COR.
Quality Assurance Surveillance Plan (QASP). An organized written document used for quality assurance surveillance. The document contains specific methods for performing surveillance of the Contractor.
Quality Control. Those actions taken by a Contractor to control the performance of services so that they meet the requirements of the Performance Work Statement (PWS).
Sanitizing Solution. For use on fixed equipment, 100 parts per million chlorine solution, or other solution approved by the medical authority.
Scullery. Dish washing machine and pots and pans wash room.
Serving Line. This term refers to the location and equipment used in dining facilities to serve food. It includes equipment such as hot food counters, salad bars, bread warmers, beverage dispensers, and ice cream freezers.
Subsistence. Food items, including beverages and condiments.
Supplies. Expendable items, including but not limited to paper and paper products, cleaning and janitorial materials, kitchen utensils, and tableware.
The Joint Commission. National organization dedicated to improving the care, safety and treatment of patients in healthcare facilities, and publishers of the accreditation and certification manuals.
Trash. Any non-salvageable waste material other than garbage, rocks, or dirt. This includes but is not limited to metal, paper, glass, cardboard, crockery, floor sweepings, cartons and similar materials.
GOVERNMENT FURNISHED PROPERTY AND SERVICES
3. General. The Government will provide, without cost, the facilities, fixtures, equipment, supplies, and services listed below.
3.1. Property
3.1.1. Facilities. The Government will make available facilities described in Technical Exhibit 4. No alterations to the facilities shall be made without permission from the Contracting Officer. The Contractor shall return the facilities to the Government in the same condition as received, fair wear and tear and approved modifications excepted. These facilities shall be used in the performance of this contract only.
3.1.2 Equipment. The Government will furnish the equipment listed in Technical Exhibit 5A, which is used for inventory purposes only. The quantities listed are expected to vary over the life of the contract. Any such variance is considered to be within the scope of the contract and the Contractor will not be entitled to additional compensation if the listed quantities change over the life of the contract or prove to be inaccurate. The Government may replace equipment when it is no longer usable for its intended purpose due to fair wear and tear. The Government may add equipment not presently included in Technical Exhibit 5A. It is the intent of the contract that the Contractor clean all the equipment contained in spaces shown in Technical Exhibit 4.
3.1.2.1 Equipment Inventory. By the contract start date, the Contractor and Government representative shall conduct a joint inventory for all Government-furnished equipment listed in Technical Exhibit 5A, and the Contractor shall receive a list of all such equipment. The Contractor and a Government representative shall jointly determine and record the working order and condition code of all equipment. If the Contractor does not participate in the inventory, the Contractor must accept as accurate the listing and stated condition of equipment provided by the Government. All inventoried equipment shall remain on at NMCSD at all times. At the completion or extension of the contract a joint inventory shall again be conducted by the Contractor and a Government representative.
3.1.2.2. Equipment Loss or Damage. The Contractor shall be liable for loss or damage to Government-furnished property beyond fair wear and tear in accordance with FAR 52.245-1 – Government Property. Compensation shall be effected either by reduced amounts owed to the Contractor or by direct payment by the Contractor, the method to be determined by the Contracting Officer. In case of damaged property, the amount of compensation due to the Government by the Contractor shall be the actual cost of repair, provided such amount does not exceed the economical repair cost. Any failure of the Contractor to agree with the Contracting Officer’s determination shall be treated according to the clause of this contract entitled “Disputes.”
3.1.2.3. Use, Conservation and Responsibility for Government Property. In the event Government fixtures, facilities equipment or materials in are not available for use, the Contractor will not be held responsible for any delays in performance. The Contracting Officer shall, upon timely written request made by the Contractor, make a determination of the delay time and shall equitably adjust the hours of operation or contract price. Any other contract provision affected by such delay will be modified as above. Documentation will be in accordance with the procedures provided for in the clause of this entitled "Changes."
3.1.2.4. Title. Title to all Government‑owned fixtures, facilities and equipment used by the Contractor and all material and subsistence issued to the contractor, shall remain with the Government.
3.1.2.5. Care. The Contractor shall use due care in the use of all Government‑owned fixtures, facilities, and equipment to prevent undue wear and breakage. The Contractor shall be responsible for the proper conservation and use of all food, subsistence and materials issued to it by the Government and, except for normal spoilage and waste for this type of operation, shall be liable for any loss thereof except as such food, subsistence and materials are consumed in performance of this contract.
3.1.2.6. Repairs. All repairs to Government‑owned fixtures, facilities, and equipment not specifically assigned to the Contractor for repair will be made by the Public Works Department or at Government expense. If the Contracting Officer determines that repairs were necessitated by negligence, misuse or carelessness on the part of the Contractor's personnel, the Contractor will be issued a written notice to this effect, and the Contractor shall be liable to the Government for the cost for repair.
3.1.3 Supply
3.1.3.1. Subsistence. All food materials necessary to perform the food handling services hereunder.
3.1.3.2. Food Serving Supplies. The Government will furnish an initial inventory of food preparation and serving utensils, tableware, and other supplies such as those listed in Technical Exhibit 5B. These supplies may be jointly inventoried at the start of the contract by the Contractor and a Government representative. Food serving supplies will be inventoried twice a month by the Government (the Contractor may participate if desired). The Government will continue to provide these supplies for the duration of the contract, including option periods. At the end of the contract, the Contractor shall return all residual inventories to the Government. Technical Exhibit 5B is for inventory purposes only and the quantities listed are expected to vary over the life of the contract. Any such variance is considered to be within the general scope of the contract and the contractor will not be entitled to additional compensation if the listed quantities change over the life of the contract.
3.1.3.2.1. Food Serving Supplies Breakage/Loss. The Contractor may be liable for broken/lost Government property beyond a normal breakage/loss rate as determined by the FSO according to the Government Property clause of the contract. The Government and Contractor will conduct an inventory each week. Any failure of the Contractor to agree with the Contracting Officer Representative’s determination shall be referred to the Contracting Officer.
3.2. Services
3.2.1.
Utilities. All utilities required to perform under this contract will be provide by the Government, with the exception of telephone services.
3.2.2.
Building Maintenance and Repairs. The Government will furnish repair and maintenance service to the facilities.
3.2.3.
Refuse Collection. All refuse removal will be provided by the Government.
3.2.4.
Insect and Rodent Control. Services (except area preparation) will be provided by the Government. Contractor is not required to perform.
3.2.5.
Grounds Maintenance. Service will be provided by the Government except as noted in section 4.0 of this PWS.
3.2.6.
Equipment Maintenance. Major maintenance and repair of Government-furnished food service equipment will be provided by the Government. Major maintenance includes repair of all inoperable equipment and replacement of components parts. Repair includes electrical and plumbing work as it applies to the equipment.
3.2.7. Police and Fire Protection Phone Numbers. 619-532-8500 or 9-911.
3.2.8.
Transportation. Those vehicles and drivers needed to transport any contractor-furnished items.
3.2.9.
Spaces. The Contractor shall keep in sanitary condition the following spaces and furnishings provided for Contractor use: dressing space, suitable lavatory and toilet space, storage space for janitorial supplies, office space for On-Site Manager/alternate supervisor.
3.2.10. Mail Distribution. The Government will provide a box, within the Nutrition Management Department, for incoming mail addressed to the Contractor, at no cost. This service should not be utilized for personal use.
3.2.11. Good Order and Discipline. The Government will provide a Master-at-Arms (MAA) during all meals hours. The MAA will maintain good order and discipline, resolve customer disputes, and ensure that patrons follow prescribed dining facility rules. Contractor personnel shall refer all patron-related issues to the MAA.
CONTRACTOR-FURNISHED ITEMS AND SERVICES
4. General. Except for those items or services specifically stated as Government-furnished in Section C-3, the Contractor shall furnish everything required to perform this contract.
