DEPARTMENT OF THE NAVY

NAVSUP FLEET LOGISTICS CENTER SAN DIEGO

3985 CUMMINGS ROAD

SAN DIEGO, CA 92136-4000

IN REPLY REFER TO

J&A 200/070

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

1. CONTRACTING ACTIVITY:

The contracting activity is the NAVSUP-FLC San Diego, Regional Contracts Department, Seal Beach Division. The requiring activity is the Naval Air Station (NAS), Fallon, NV.

2. DESCRIPTION OF THE ACTION BEING APPROVED:

The use of other than full and open competition to acquire Telecommunication services from C.C. Communications, DBA Churchill County Telephone (CC Communications), Fallon, NV. The type of contract is a firm-fixed-price contract, Indefinite Delivery/Indefinite Quantity.

3. DESCRIPTION OF SUPPLIES/SERVICES:

This requirement is for telecommunication services to include the use of the Base Telephone Systems (BTS), to include engineering, furnishing, installing and testing (EFI&T), maintaining, providing upgrades and enhancements, and making operational all hardware and software necessary to meet the requirements for the (BTS) already provided and in use at the NAS Fallon. The BTS also interconnects with the Defense Switched Network (DSN) and the Networx Universal to provide a comprehensive set of telecommunication network services to meet Government requirements for National Security and Emergency Preparedness (NSEP) and will provide migration to an Integrated Services Digital Network (ISDN).

The total estimated cost of the proposed procurement is $2,843,160.00 including option years as shown below;

Base Year:

$947,720.00

Option Year 1:

$947,720.00

Option Year 2:

$947,720.00 FY14 Operation & Maintenance, Navy appropriation will be utilized for the base period and option periods will be funded with appropriate fiscal year appropriation.

4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION:

The statutory authority permitting other than full and open competition is Section 4202 of the Clinger-Cohen Act of 1996. This procurement is conducted using the authority of the test program for commercial items, FAR 13.5.

5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY:

NAS Fallon is responsible for the operation and maintenance of the BTS. CC Communications owns, operates, maintains and administers the existing BTS (inclusive of the switching equipment, network services (i.e. DSN) and distribution cable plant.

The Government can only acquire the telecommunication services and maintenance described above on a sole source basis from CC Communications as they are the owners and operators of the existing system and its equipment. CC Communications is the only company that can provide the services and the hardware and software maintenance (including any necessary upgrades and equipment) for the BTS.

For the reasons stated above, it is not feasible to competitively procure the services described above from any source other than CC Communications. CC Communications System retains proprietary rights to the existing system, as well as to any upgrade or enhancements of the CC Communications-owned equipment, software, distribution cable, etc. In addition, CC Communications is the local exchange carrier that provides dial tone for the BTS.

The communication equipment is currently installed at NAS Fallon which is approximately 70 miles from the nearest metropolitan area and currently CC Communications is the only source that is able to provide telecommunication services to this remote area.

The telecommunication services described in the PWS, to include critical hardware and software maintenance, are required to continue to ensure supporting the Naval Air Station and its tenants with telecommunication services twenty-four (24) hours per day, seven (7) days per week. For the reasons described above, CC Communications is the only source capable of providing these services.

6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY OFFERORS AS PRACTICABLE:

The proposed contract has been synopsized at the NECO and FEDBIZOPS web sites. No additional market research was conducted because it is not practicable for the reasons discussed in paragraph 5 above for any company other C.C. Communications to provide the required supplies and services. Until such time as new hardware systems are introduced, and those systems have differing architecture/underlying software systems, no other firm can provide the required telecommunication services.

7. DETERMINATION OF FAIR AND REASONABLE COST:

The contracting officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. ACTIONS BEING TAKEN TO REMOVE BARRIERS TO COMPETITION:

For the reason set forth in Paragraph 5, NAVSUP FLC has no plans at this time to compete future contracts for the types of services covered by this document. If another potential source emerges, NAVSUP FLC, will assess whether competition for future requirements is feasible.

9. CONTRACTING ACTIVITY POINT OF CONTACT:

The NAVSUP FLC Seal Beach Division points of contact are: Contract Specialist, Cindy Tafoya, 562-626-7378 and Division Director, Caron Rigali, 562-626-7384.
