52.212-2 Evaluation-Commercial Products and Commercial Services. (Tailored) (Nov 2021)
As prescribed in , the Contracting Officer may insert a provision substantially as follows:12.301(c)
Evaluation-Commercial Products and Commercial Services (Nov 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Price
(b) . The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic Options requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
Addendum to Evaluation - Commercial Product and Commercial Services
FAR Clause 52.212-2 Evaluation of Commercial Items
The Government intends to award a Firm Fixed Price (FFP) contract as a result of this solicitation in accordance with FAR part 12. The award will be made on a sole source basis in accordance with FAR 12.102(a) after the price is determined to be fair and reasonable. The Government intends to evaluate and award a contract based on initial quote; therefore, the Quoter's initial quote should contain the Quoter's best terms from a price standpoint.
Since it is the intent to procure the required support services as a sole source direct award in accordance with FAR 12.102(a), non-price factors will not be evaluated.
Total price will be evaluated taking into account the total FFP for the base year and option periods. Price analysis using procedures of DFARS 212.204(a) will be used to evaluate price and reasonableness.
The Government may evaluate any and all information submitted by the vendor to support the reasonableness of the prices proposed. The method of evaluation used by the Contracting Officer is solely within the discretion of the Contracting Officer.
