About this file

This Limited-Sources Justification (LSJ) document outlines a sole-source task order procurement by NAVSUP Fleet Logistics Center Norfolk for Naval Construction Battalion Group (NCBG) One and Two. The acquisition is for InVeris Training Solutions, Inc. to provide specialized training simulator equipment, including 28 FATS® M4A1 Rifle Simulators, 28 FATS® Sig M18 Pistol Simulators, 5 FATS® BlueFire® Fill Station Adapters, and 8 FATS 100MIL Systems with US Navy software. The total procurement is a one-time, firm-fixed-price order to be funded by FY23 Reserve National Guard and Reserve Equipment (NGREA) appropriations.

The justification for the limited source is based on InVeris Training Solutions' proprietary software that is uniquely installed on the NCBG's Fire Arms Training Simulator (FATS) system, with similar simulator weapons unable to operate with this software. The Navy argues that these equipment upgrades are critical to ensure personnel receive realistic training on weapons they will use in the field, and that failure to fund these upgrades could be catastrophic for personnel. The requirement will be posted on SAM.gov and GSA E-buy, though it is anticipated no other potential sources will express interest in the requirement.

LIMITED-SOURCES JUSTIFICATION (above SAT)

1. Identification of Requiring Activity and Contracting Activity.

The requiring activity is Naval Construction Battalion Group (NCBG) One and Two under Navy Expeditionary Combat Command, Virginia Beach, Virginia; the contracting activity is NAVSUP Fleet Logistics Center (FLC) Norfolk, Contracting Department – Fleet Directorate.

2. Nature and description of contract action.

This acquisition is conducted under the authority of the Multiple Award Schedule Program (Title 41 U.S.C. 152 (3) and Title 40 U.S.C. 501, Services for Executive Agencies). This is a limited source action to be awarded as a new task order to InVeris Training Solutions, Inc., a large business, identified in paragraph 3 below. The placement of a firm-fixed-price order is anticipated.

The action is considered a new requirement.

3. Description of Required Supplies/Services.

The proposed acquisition is to award a sole source, firm fixed price task order to InVeris Training Solutions, Inc., 296 Brogdon RD Suwanee, Georgia 30024-8615. It is intended to acquire the below items and quantities listed below. This is a one-time procurement in the amount of .

Funding for the task order will use FY23 Reserve National Guard and Reserve Equipment (NGREA) appropriations.

4. Identification of the Justification Rationale and/or Demonstration of Contractor’s Unique Qualifications to provide the required supply or service.

The statutory authority which permits restricting consideration of schedule contractors to fewer than that required in FAR 8.405-1 (Ordering procedures for supplies and services not requiring a statement of work) or 8.405-2 (Ordering procedures for services requiring a statement of work) is 41 U.S.C. 251 et seq., as implemented by FAR 8.405-6.

The proposed requirement is to acquire upgrades to hardware, software, pistol and rifle simulators required to ensure personnel receive realistic training while building the correct habit patterns. There are significant differences between the current weapons and the ones the Navy has transitioned to in FY25. Failure to fund these upgrades will lead to personnel continuing training on weapons that they will not discontinue to utilize in the field. This could be catastrophic for personnel on the battlefield.

The justification for limiting sources is:

(ii) FAR 8.405-6(a)(1)(i)(B) – Only one source is capable of responding due to the unique or specialized nature of the work.

The above-mentioned authority is applicable because the Government’s need can only be satisfied by InVeris Training Solutions, Inc. due to software developed and owned by InVeris Training Solutions, Inc. This proprietary software is installed on NCBG’s Fire Arms Training Simulator (FATS) system. Similar simulator weapons are unable to operate with this software.

Additionally, services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to recovered through competition.

5. Determination of the Best Value.

GSA has determined the prices of supplies of the schedule contracts to be fair and reasonable for the purpose of establishing the schedule contract. Per FAR 8.404(d) DEVIATION, GSA’s determination does not relieve the ordering activity contracting officer from the responsibility of making a determination of fair and reasonable pricing for individual orders. Therefore, ordering activities are responsible to make a separate determination of fair and reasonable pricing for individual orders, BPAs, and orders under BPAs. The Contracting Officer will determine, using the procedures in FAR 15.404-1, that the prices are fair and reasonable and will document such determination with a level of detail commensurate with the complexity and circumstances of each order. By placing an order against a schedule contract, the ordering activity contracting officer concludes that the order represents the best value to the Government.

6. Description of market research among schedule holders and the results or a statement of the reason market research was not conducted.

The requirement will be posted and synopsized at the Government-wide Point of Entry – SAM.gov website. The synopsis will function as a market survey, will advise industry of pending procurements and will solicit inquiries from interested parties. It is anticipated no other potential sources will express interest in this requirement.

In accordance with FAR 8.405-6(b)(3)(i)(B) this document will be posted with the solicitation at GSA E-buy.

7. Any other facts supporting the justification. This procurement uses a GSA Schedule and will be solicited and awarded in accordance with FAR Subpart 8.4.

8. Actions the Agency may take to remove or overcome barriers to competition.

For the reasons set forth in Paragraph 4, the contracting activity has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, NAVSUP FLC Norfolk will assess whether competition for future requirements is feasible.

9. Contracting Point of contact.

The point of contact at NAVSUP Fleet Logistics Center Norfolk, Contracting Department – Fleet Directorate is Sherell Brown, Code 212.1, who may be contacted by e-mail at sherell.g.brown.civ@us.navy.mil; or Morgan Olszak, Code 212.1, who may be contacted by e-mail at morgan.e.olszak.civ@us.navy.mil.
