About this file

This is a Sole Source Justification document for a bridge contract to continue HQ Information Technology Maintenance support services for Commander, Naval Surface Force Atlantic (CNSL). The bridge contract will be awarded to incumbent Delphinus Engineering Incorporated for $3,143,519.90 for a 12-month period from March 1, 2025 to February 28, 2026.

The scope includes providing CNSL HQ with real-time view of Navy ships readiness conditions and maintenance requirements, along with IT maintenance support covering network security, physical security, administration, operations, compliance and assessment. The justification cites new requirements including commercial internet capabilities for ships (with a successful pilot on 3 test ships), procurement of 18 Starlink antennas for deploying ships, and expanded 24/7 support using WINDAR devices for mobile SIPRnet access. The follow-on competitive contract will be solicited under FAR 16.5 fair opportunity to all Seaport-NXG vendors. The bridge is deemed necessary to prevent service interruption while these new requirements are incorporated into the follow-on contract's Performance Work Statement. The contract will be funded with FY25 Navy Operations & Maintenance (O&MN) appropriations.

SOLE SOURCE JUSTIFICATION

1.0 Identification of Agency and Contracting Activity.

Requiring Activity: Commander, Naval Surface Force Atlantic (CNSL)

Contracting Activity: Naval Supply Systems Command (NAVSUP) Fleet Logistics Center Norfolk (FLCN) Contracting Department: Code 212 Norfolk, Virginia 23511-3392 Requisition Number: N46581RC

2.0 Description of the Action Being Approved:

This is a sole source bridge action for the continuation of HQ Information Technology (IT) Maintenance support services. These services are currently performed under Contract N00l 78-04- D-4033, task order N00l 89-19-F- 3038. The task order was awarded 14 August 2019 on a firm fix priced competitive basis to Delphinus Engineering Incorporated, a large business. The current period of performance was awarded with a twelve (12) month base period and four (4) option periods to include the FAR clause 52.217-

-8 was fully executed for six (6) months with contract performance ending on 28 February 2025.

The purpose of this action is to extend the period of performance to provide interim support, while a competitive follow-on contract can be competed. The proposed bridge will provide the support services for a period of twelve (12) months beginning 1 March 2025 and ending 28 February 2026.

3.0 Description of Supplies/Services:

The scope of this requirement is to provide CNSL HQ a near real time view of Navy ships readiness conditions as well as a comprehensive picture of current and projected maintenance requirements for all CNSL subordinate commands. The Contractor also supports all facets of HQ Information Technology (IT) Maintenance Support (Network Security, Physical Security, Administration, Operations, Compliance and Assessment). The requirement also provides support of CNSL mission to provide ongoing Command and Control, Communications, Computers, Combat Systems and Intelligence (C5I) system life cycle engineering, technical, maintenance and computer resource management services for CNSL HQ, including all subordinate commands.

Performance for the bridge consists of twelve (12) months shown in the table below:

Performance Period Dates Total Bridge 1 March 2025- 28 February 2026 $3,143,519.90 Total $3,143,519.90

$3,143,519.90 $3,143,519.90

The resultant contract will be funded with FY25 Navy Operations & Maintenance (O&MN) appropriations.

These funds are currently available.

4.0 Statutory Authority Permitting Sole Source.

The statutory authority permitting this sole source action is 41 U.S.C. 1901, Simplified acquisition procedures - a sole source acquisition using simplified acquisition procedures for the acquisition of commercial items, as implemented by FAR 13.501 (a).

5.0 Rationale Justifying Use of Cited Statutory Authority:

A bridge contract is required due to unforeseen changes in the requirement that necessitated additional research and refinements, updates and additions of tasks within the Performance Work Statement (PWS) for the follow-on effort.

requirement for commercial internet while underway. As a result, CNSL initiated a pilot program onboard three (3) selected test ships to demonstrate the capability of utilizing commercial internet while underway, which is a first of its kind capability. This pilot program netted overwhelming positive feedback from sailors as they were able to use personal electronic devices (cell phones/laptops) while underway. This capability has significantly increased morale allowing Sailors to handle personal finances, complete online courses, and communicate with friends and families all while underway. Due to the success of this pilot program, CNSL plans to move forward with providing this capability to the majority of their 68 ships both Continental United States (CONUS) and Outside the Continental United States (OCONUS) over the next few years. As this technology is not managed by a formal Program of Record (POR), all configuration and troubleshooting is at the command level (CNSL). As this is related to current tasks under CNSLs HQ IT maintenance contract, support services to provide configuration management, end user management, data plan management, and information assurance policies on this technology are being added to the follow-on effort. Additionally, in October of FY24, CNSL had also began the planning and development of a requirement to procure 18 Starlink antennas to be utilized by upcoming deploying ships for Quality-of-Life networks, which will be supported from a technical standpoint under this same follow-on effort.

In addition, in October 2023 (FY24), due to real world conflicts the demand signal for real-time information spiked from normal business hours to 24x7 support for information. As result CNSL began developing a requirement and sourcing a solution which was through the procurement of Windows Data at Rest (WINDAR) devices from Defense Information Systems Agency (DISA). The WINDAR devices provide mobile Secret Internet Protocol Router Network (SIPRnet) capabilities for command staff and leadership. Additional tasks associated with the end user management, account creation, inventory of devices, and basic troubleshooting will also be included in the follow-on effort. CNSL has already increased this capability to several end users on staff and intends for this requirement to continue to grow, substantiating additional contractor support taskings.

The current contractor, Delphinus Engineering Incorporated continues to perform under FAR 52.217-8 through 28 February 2025. The support to be provided under the authority requested by this justification is crucial and necessary for CNSL to continue the HQ Maintenance support services. The incumbent contractor is the only firm that currently possesses the requisite skills and personnel capable of responding to this requirement on this short-term and emergent basis, thereby ensuring performance of the required services continue without delay or interruption while the follow-on contract requirement is executed.

A lapse in services is not feasible as the HQ Maintenance provides essential services to the ships, and a lapse would lead to an inability to complete mission functions, would incur significant additional costs and unacceptable schedule delays. In order to provide the customer with continuity of this critical support and maintain a stable program, a sole source bridge award is crucial. Given this information, issue a sole source award to Delphinus Engineering Incorporated, as they are the incumbent contractor, and are the single responsible source capable of performing the required support.

6.0 Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable:

This bridge is in support of an existing competitively awarded task order. The follow-on is anticipated and intended to be solicited under FAR 16.5 fair opportunity and open to all applicable Seaport-NXG vendors.

7.0 Determination of Fair and Reasonable Cost:

The Contracting Officer has determined that the anticipated cost to the Government of the supplies/services covered by this Justification will be fair and reasonable.

8.0 Actions to Remove Barriers to Future Competition:

As stated herein, the incumbent contractor, Delphinus Engineering Incorporated is the only contractor that has the available personnel, knowledge, experience, and expertise to immediately provide support of the required services without a break in service or negative impact to the Navy. Nonetheless, as mentioned in section 5 of this document above, it is intended that the follow-on effort will be competed and awarded under fair opportunity on an unrestricted basis in accordance with FAR 16.5, which will remove any such barriers to future competition.

9.0 Contracting Point of Contact.

The point of contact at NAVSUP Fleet Logistics Center Norfolk is Ms. Jill Joscelyn, Code 212, who may be contacted by e-mail at email jill.h.joscelyn-smith.civ@us.navy.mil
