Other information to support a sole source / name brand buy:

The Maryland Department of Environmental (MDE) sets the guidelines for the Chesapeake Bay and the local protected watershed areas. The U.S. Naval Academy (USNA) and its Small Craft

Repair Facility (SCRD) falls under MDE environmental jurisdiction. USNA SCRD day to day operations is closely monitored and inspected for compliance with all local laws regarding the

Chesapeake Bay, especially environmental. Over the years we have procured industry standard antifouling bottom paints, which have high copper content. In the past, MDE has provided

USNA annual waivers; however, as of 2021 MDE will no longer provide USNA a waiver. To be within compliance and avoid hefty fines, USNA was directed by MDE and Naval Facilities

Engineering Systems Command (NAVFAC) to strip all crafts and vessels of bottom paint and replace using a special copper-free paint. The SEAVOYAGE COPPER FREE ANTIFOULING

BOTTOM PAINT has been approved by Naval Sea Systems Command (NAVSEA) Ships, Boats and Craft Program Office (PMS 325) and NAVFAC. Boat drawings and paint schedules have been updated to specify the SEAVOYAGE as the primary bottom paint that will be used moving forward. Please note this particular paint is not in the stock system. Two failed attempts have been made to procure required copper free paint as directed by Contractor Officers at Fleet

Logistics Center (FLC) Norfolk Office which resulted in loss of Government funding and money. This paint is critical to the Department of Waterfront Readiness mission at the US Naval

Academy.

I CERTIFY THAT STATEMENTS CHECKED, AND INFORMATION PROVIDED ABOVE, ARE

COMPLETE AND CORRECT TO THE BEST OF MY KNOWLEDGE. I UNDERSTAND THAT THE

PROCESSING OF THIS SOLE SOURCE / BRAND NAME JUSTIFICATION PRECLUDES THE USE

OF FULL AND OPEN COMPETITION.
