About this file

This document includes a sole source justification and notice of intent to award a sole source contract. The Naval Computer and Telecommunications Area Master Station Atlantic requires leased local exchange access commercial network services including 12 PRI services terminating on an Avaya telephone switching platform at Naval Support Activity Mid-South in Millington, Tennessee. The one-year base period and five one-year option periods are currently provided by incumbent Millington Telephone Company under an existing contract. Document Number: N24-025.1

SOLE SOURCE JUSTIFICATION

1. Identification of Agency and Contracting Activity.

The requiring activity is Business Communications Office (BCO), Naval Support Activity (NSA), Mid- South Millington, Tennessee; the contracting activity is NAVSUP Fleet Logistics Center (FLC) Norfolk, Contracting Dept.

2. Description of the Action Being Approved.

This is a sole source action for the provision of leased local exchange access commercial network service supporting subscriber services that are currently performed under Contract N0018919P0653, as required by Naval Computer and Telecommunications Area Master Station Atlantic (NCTAMS LANT).

Contract N0018919P0653 was awarded 19 September 2019 on a sole source basis as a firm fixed-price contract to Millington Telephone Company, Inc. dba Ritter Communications, a small business; the existing contract expires on 30 September 2024.

This is a follow-on to a non-competitive requirement.

3. Description of Supplies/Services.

NCTAMS LANT and subordinate BCOs provide base level communications support to NSA Millington, Tennessee area. NCTAMS LANT requires leased local exchange access commercial network service, path/interface to the Public Switched Telephone Network (PSTN) to support simultaneous access, transmission and switching of voice, high-speed data and image services (video teleconferencing) and includes 12 NPC PRI services. Trunking service shall terminate on the Navy's Avaya SL8700 telephone switching platform located in the building 776 Naval Support Activity (NSA) Mid-South Millington, TN.

This requirement, as illustrated below in the table is for a five (5) period of performance with a 12 moth base year and provisions for four (4) twelve month option periods. The solicitation and resultant contract will also contain FAR 52.217-8, Option to Extend Services, thereby allowing a six (6) month extension if circumstances necessitate this option. The contract is estimated to be awarded prior to 30 September 2024, with full performance commencing 01 October 2024, and the Independent Government Estimate for the base period and all options including FAR 52.217-8 extension is as shown below.

The resultant contract will be funded with FY25 Navy Operations & Maintenance (O&MN) appropriations for the Base year. These funds are not currently available.

Options will be funded utilizing O&MN appropriations of the fiscal year in which the option year is exercised.

4. Statutory Authority Permitting Sole Source.

The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1) - the supplies or services needed by the agency are available from “only one responsible source” and no other type of supplies or services will satisfy agency requirements, as implemented by FAR 6.302-1.

5. Rationale Justifying Use of Cited Statutory Authority.

The required services are currently contracted under Firm Fixed Price (FFP) single-award contract N0018919P0653, as stated in paragraph 2.

Per a letter received from E. Ritter Communications, Inc. (Ritter Communications) dated 20 November 2023 (Attachment 1), Ritter Communications is a public utility and provides legacy telecommunications infrastructure to the US Navy, located at 5724 N Commitment Loop Bldg 776 in Millington, Tennessee, which is owned and operated solely by Millington Telephone Company. Ritter Communications does not utilize authorized resellers for legacy telecommunications, and there are no resellers of Ritter Communication legacy services.

Operational Impact: Due to the nature of these services, a lapse in the required services would result in a total loss of service, loss of network control, and loss of call processing capability.

Non-approval of this requirement will have an adverse effect on various other Navy missions and LEC Commercial Subscriber Lines that are provided to various Navy customers located at NSA Mid-South Millington, TN.

Therefore, due to the reasons stated above it is imperative that Millington Telephone Company who designed and installed dedicated infrastructure beyond standard commercial demarcation points to customer premises, continue to provide the required support services until such time that additional capable sources have been identified.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable, including a Description of Market Research, if applicable, and a List of Interested Sources, if any.

Based on the requirement of providing telecommunication services that are legacy in nature, NAVSUP FLC Norfolk contacted the infrastructure owner, Ritter Communications, to confirm if services could be provided by resellers. As indicated the sole source statement from Ritter Communications (Attachment 1) the required services are legacy, are only provided by the infrastructure owner, and are not available through resellers.

No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other Ritter Communications, to provide the required services.

The requirement will be synopsized and the solicitation will be posted on FEDBIZOPS via System for Award Management (SAM).

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined that the anticipated cost to the Government of the supplies/services covered by this Justification will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAVSUP Fleet Logistic Center (FLC) Norfolk has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, NAVSUP FLC Norfolk will assess whether competition for future requirements is feasible.

9. Contracting Point of Contact.

The point of contact at NAVSUP FLC Norfolk, is William S. Powell, Code 217.2, who may be contacted at commercial 252-621-2198 or by e-mail at william.s.powell14.civ@us.navy.mil, or Christopher Whiteside, Code 217.2, who may be contacted at commercial 757-443-0780 or by e-mail at christopher.d.whiteside2.civ@us.navy.mil.
