About this file

This document is a Justification for an Exception to Fair Opportunity for a hardware supply contract. The key details are:

The minimum specifications listed are specific to Dell desktop systems that are currently installed and performing at NCDOC. The Allied Telesis Adaptor Cards are also required, as the current system configuration relies on the 100bmps fiber optical Network Interface Cards (NICs) that support the Preboot Execution Environment (PXE) boot. The required Dell workstations and associated Dell components are peculiar to only one manufacturer, Dell Inc., and no other manufacturers can fulfill the NCDOC mission requirement. The contracting officer has determined the anticipated cost to the Government will be fair and reasonable. This procurement will be solicited and awarded through a Government-wide Acquisition Contract (GWAC) in accordance with FAR Subpart 16.5. The point of contact is Justin Hall at NAVSUP Fleet Logistics Center Norfolk.

Source Selection Information – See FAR 2.101 and 3.104 existing Dell desktop systems presently installed and performing at NCDOC. The minimum specifications listed are specific to Dell only. No other desktop brand (apple, HP or Toshiba) will fit into the environment due to the different configuration changes required for firmware and operating system updates. NCDOC retains knowledgeable technicians on-site that tailor the Dell laptops and desktops for implementation into the NCDOC system. A change to another brand would change the existing platform and NCDOC would be required to go through the Authority to Operate (ATO) approval process again resulting in negative impact on the Tactical Warfighting Network and on NCDOC’s ability to perform as the CSSP.

The Allied Telesis Adaptor Cards are required as the current system configuration relies on the 100bmps fiber optical Network Interface Cards (NICs) that support the Preboot Execution Environment (PXE) boot that is built within the system and desktops. The Allied Telesis Adaptor Cards work in the NCDOC network environment reliably as all current and previous Allied Telesis adaptor cards have been installed successfully in the system. Any other brand of adapter card would not be compatible with the current NCDOC network environment and could cause negative impact to supporting the missions of NCDOC.

The required Dell workstations and associated Dell components are peculiar to only one manufacturer, Dell Inc. As such, no other manufacturers can fulfill the NCDOC mission requirement.

5. Determination of Fair and Reasonable Cost.

In accordance with FAR 16.505(b)(2)(ii)(B), the contracting officer has made the determination that the anticipated cost to the Government will be fair and reasonable.

6. Any other facts supporting the justification. This procurement uses a Government-wide Acquisition Contract (GWAC) and will be solicited and awarded in accordance with FAR Subpart 16.5.

7. Actions Taken to Remove Barriers to Competition.

As stated in paragraph four (4) the required supply is brand specific and is only available from the manufacturers authorized distributors. The current requirements will be competed amongst the manufacturer’s authorized distributors. If another potential source emerges, the Government will assess whether competition for future requirements is feasible. All future requirements will be researched on a case-by-case basis.

8. CONTRACTING POINT OF CONTACT. The point of contact at NAVSUP Fleet Logistics Center Norfolk, is Justin Hall, Code 200, at justin.d.hall12.civ@us.navy.mil.
