PERFORMANCE WORK STATEMENT

1.0 TASK

1.1 Task Title: Conservation Assessment and Move Plan for Selected Artifacts on Display at the

National Museum of the United States Navy.

1.2 Definition of Need and Proposed Resolution: The National Museum of the United States Navy (NMUSN) will exhibit macro artifacts, currently on display in BDLG 76, within the new museum. These artifacts may require substantial conservation prior to being exhibited and specialized moving equipment and mounts to exhibit within the new museum. The contractor is required to assess the artifacts for their condition and provide a move plan for each artifact.

1.3 Resolution: The contractor shall provide a conservation assessment for each artifact and a move plan for each artifact, to include: specifications/considerations and suggestions on how to mount and exhibition display requirements for the artifacts which are currently on display at NMUSN.

2.0 DETAILS/SPECIFICATIONS

2.1 Contractor shall provide all materials, supplies, labor and equipment for assessment of artifacts.

2.2 The contractor shall provide a comprehensive conservation assessment for each artifact.

The plan shall include: full documentation, to include photography of the artifacts current condition;

highlight specific areas of concern; and identify any hazardous material that may be present. The plan shall include scalable treatment options for each artifact. Conservation assessments shall be provided in PDF format to the POC’s and also 2 copies in DVD format.

2.3 The contractor shall provide a comprehensive written move plan for each of the artifacts, including: all steps required to properly pack for shipment and reassembly of artifacts in a new location. The location is to be determined but will be confirmed during the period of performance of this contract. Contractor shall provide recommendations on artifact mounts reflecting current methodology and museum best practices.

The artifacts shall not be moved at this time.

2.4 The contractor shall supply any and all equipment necessary to fulfill this contract and safely assess artifacts in Bldg 76, as needed. This may include, but is not limited to: scissor lifts, and/or articulating man lifts. All personnel operating (MHE) must be licensed operators.

2.5 Contractor shall use appropriate tools and methods in accordance with commercial museum conservation standards. NHHC’s Collections Management Division Branch Head will approve all work.

Any new treatment required shall be reported by the contractor.

2.6 Contractor shall cause no damage to museum objects, exhibits, or building. Any damages incurred by the contractor shall be repaired at the contractor’s expense.

2.7 Contractor shall provide a list of relevant conservation work with professional references

3.0 PERIOD OF PERFORMANCE

3.1 The desired performance period for work is 18 September 2023 – 17 September 2024.

4.0 QUALIFICATIONS

4.1 Contractor principal and/or project manager shall have a Master’s degree in Conservation.

4.2 Contractor shall have at least 10 years’ experience in the conservation of large macro artifacts.

4.3 Contractor and/or sub-contractor shall have at least 10 years’ experience in the handling and movement of macro artifacts.

5.0 PERFORMANCE LOCATION

6.0 HOURS OF WORK

6.1 On-site work will be conducted between 8:00-4:00 M-F excluding federal holidays.

7.0 SECURITY

7.1 Base access will be required. Visitors to the Washington Navy Yard will not be accepted on-site without prior coordination and approval to include a background check. Requests for admission to the base will be coordinated through personnel/points of contact list in Section 9.0, primarily Mr. Brian Sitko.

8.0 LOCATION CONSIDERATIONS

8.1 There is limited parking on the WNY, contractors are advised to car share when possible

9.0 Travel

Travel is not required for this purchase order

10.0 Security

All contractor personnel shall be U.S. citizens. The contractor shall ensure that all personnel requiring access to any DoD information system meet the minimum criteria specified in DoD 5200.2-R, DoD Personnel Security Program.

All contractor personnel requiring access to the Government workspaces will complete a National Agency Check with Local Agency Check and Credit Check (NACLC). Contractor personnel should be aware at all times of any unusual persons or packages in their work area and immediately report those to the building security staff. If contractor personnel become aware of any person seeking unauthorized access to Controlled Unclassified Information materials, they should immediately report this to the Security Officer. Contractor personnel will be in compliance with the Navy Information Assurance Security Publication IA Pub 5239-26 of May 2000.

The Contractor shall escort visitors through NHHC facilities. All requests by the Contractor for non-duty access (outside normal work hours) shall be coordinated through the Government’s designated personnel.

The Contractor shall comply with restricted areas regulations, rules, instructions, directives, procedures, mandates and other requirements. Certain NHHC designated office spaces are “off-limits” or restricted.

Contractor personnel shall not enter any “off-limits” or restricted spaces within NHHC designated office areas without specific permission.

All contractor personnel performing under this PWS, or any representative of the Contractor entering NHHC designated office space shall abide by all security regulations, rules, instructions, directives, procedures, mandates and other requirements of Chief Naval Office and NHHC. The Contractor shall coordinate with the designated NHHC representative for Government-furnished building passes and Common Access Cards (CACs).

The Contractor will be entrusted with building passes, badges and/or the use of access devices for facility access.

The Contractor shall prohibit the use of Government-issued building passes, badges and/or access devices throughout the facility by any person other than authorized Contractor personnel. The Contractor shall not permit entrance to locked areas by any person other than Contractor personnel assigned to the activity where the Contractor is performing work, without written authorization by the Government’s designated security personnel. Building passes, badges and/or access devices shall only be issued by government personnel to Contractor personnel performing services under this PWS. The Contractor shall report to the Government’s designated security personnel immediately any occurrences of lost passes, badges and/or access devices.

All Contractor personnel shall comply with the security guidance of the DD Form 254 in this contract. Proof of security clearance shall be provided to the Government prior to the start of the task order.

11.0 Government Furnished Property

The Contractor will be provided all necessary equipment and software in which to perform their duties. This includes, but is not limited to, desk, phone, computer/laptop, necessary office supplies, etc. Government furnished property shall not be removed from the workspace without the written approval from the COR, in such events as inclement weather.

13.0 Personal Services

This is a non-personal services contract. No government employee shall direct the Contractor in the performance of tasks. This contract does not create a supervisor/employee relationship with the Contractor’s employee, and if such relationship occurs, it shall be brought to the attention to the COR immediately.

14.0 Performance Issue/Replacement of Personnel

In the event of sub-par performance by the employee, the Company shall replace the employee within five (5) working days. If the employee decides to leave NHHC for another position, the Contractor shall provide the COR with a two

(2) week written notification of the employee’s last day, and shall provide a replacement employee one (1) business day after the employee leaves. If the Contractor is unable to provide qualified personnel, the COR will notify the Contracting Officer and report the unsuccessful performance.

15.0 Validation of Qualifications

The government retains the right to request the Contractor’s employee’s resume to validate qualifications after contract award. If the resume does not reflect the qualifications as cited above, the government may request the employee be replaced, and request the replacement employee’s resume. However, as stated above, this is not a personal services contract, and the government will not conduct employee interviews or make an employee selection on behalf of the Contractor. The government is not authorized to request the hiring of an employee.

16.0 Contractor Appearance and Behavior

16.1 Personal Appearance.

The contractor shall be neat, clean, well-groomed, and in appropriate attire clothing when in public areas.

16.2 Ethical Conduct.

The contractor, although in fact not a Government employee, shall comply with Executive Order 11222 of May 8, 1965, “Prescribing Standards of Ethical Conduct for Government Officers and Employees,” and shall also comply with Department of Defense (DOD) and Department of Navy (DON) regulations implementing this Executive Order.

In addition, the contractor shall adhere to all DOD, Navy, and Command policies and regulations during the performance of their duties. Contractor shall not accept tips and / or donations for services rendered. In the event that donations are offered all such donations shall be referred to the general offerings of the NHHC.

16.3 Identification of Contractor Employees

In accordance with DFAR 211.106, there shall be a clear distinction between Government employees and service contractor employees. Service contractor employees shall identify themselves as contractor personnel by introducing themselves or being introduced as contractor personnel. Contractor personnel will be required to obtain and wear badges or other visible identification for meetings with Government personnel to provide a clear distinction between service contractor employees and Government personnel. In addition, contractor personnel shall appropriately identify themselves as contractor employees in telephone conversations and in formal and informal written correspondence.

They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.

16.4 In the Event of an Emergency

A worker with a bona fide medical emergency occurring while on duty, or with an on-the-job injury, will be provided stabilizing medical care according to the procedures of the NHHC. The contractor shall reimburse the Government for all medical services provided unless the worker is otherwise entitled to Government medical services.

16.5 Use of Illegal Drugs

The Secretary of the Navy has determined that the illegal possession or use of drugs and paraphernalia in a military setting contributes directly to military drug abuse and undermines Command efforts to eliminate drug abuse among military personnel. The policy of the Department of the Navy (including the Marine Corps) is to deter and detect drug offenses on military installations. Measures to be taken to identify drug offenses on military installations, and to prevent introduction of illegal drugs and paraphernalia, include routine random inspection of vehicles while entering or leaving, with drug detection dogs when available, and random inspection of personal possessions on entry or exit.

If there is probable cause to believe that a worker has been engaged in use, possession, or trafficking of drugs, the worker may be detained for a limited period of time until he/she can be removed from the installation or turned over to local law enforcement personnel having jurisdiction. When illegal drugs are discovered in the course of an inspection or search of a vehicle operated by a worker, the worker and vehicle may be detained for a reasonable period of time necessary to surrender the individual and vehicle to appropriate civil law enforcement personnel. Action may be taken to suspend, revoke, or deny clinical privileges as well as installation driving privileges. Implicit with the acceptance of this contract is the agreement by the worker to comply with all Federal and State laws as well as regulations issued by the Commander of the military installation concerning illegal drugs and paraphernalia

16.6 Government Regulations.

The contractor shall become acquainted with and obey all pertinent Command, Navy, and DOD regulations, shall perform in a manner which precludes any waste of utilities and shall not use government equipment for personal business. The contractor shall comply with government policies and regulations in regard to identification badges, parking, and professional decorum. Eating and smoking by the contractor are restricted to designated areas.

16.7 Failure or Inability to Perform

A worker demonstrating impaired judgment will be removed from providing services. The Government reserves the right to remove any employee who, in the judgment of a licensed physician, is impaired by drugs or alcohol. In the event of removal, the Contractor shall provide a replacement within (5) working days.

The contractor and all workers shall comply with all NHHC checkout processes. These processes include returning government property, i.e., identification badges, pagers, cellular phones, etc., to the NHHC upon a worker’s last day of service. Failure to do so promptly may result in delay of payment to the contractor.

17.0 Privacy Act

Pursuant to Title 5 United States Code 552a(m)(l), the contractor and all employees of the contractor working under this contract are required to comply with the requirements of 5 U.S.C. 552a (“The Privacy Act of 1974”).

18.0 Contractor Access to Classified Information

This contract does require a Common Access Card. Contractor will have access to sensitive information, information technology (IT) systems, or protected health information.

19.0 Contractor’s Security Representative

The Contractor shall designate an employee to serve as the Contractor’s Security Representative. Within three work days after contract award, the contractor shall provide to the requiring activity’s Security Manager and the Contracting Officer, in writing, the name, title, address and phone number for the Contractor’s Security Representative. The Contractor’s Security Representative shall be the primary point of contact on any security matter. The Contractor’s Security Representative shall not be replaced or removed without prior notice to the Contracting Officer and Command Security Manager.

20.0 Background Investigation

Contractor employee whose work is unclassified and non-sensitive (e.g., performing certain duties such as lawn maintenance, vendor services, etc. ...) and who require physical access to publicly accessible areas to perform those duties shall meet the following minimum requirements:

Must be either a US citizen or a US permanent resident with a minimum of 3 years of legal residency in the United States (as required by The Deputy Secretary of Defense DTM 08-006 or its subsequent DoD instruction) and jMust have a favorably completed National Agency Check with Written Inquiries (NACI) or T1 investigation equivalent including a FBI fingerprint check prior to installation access.

To be considered for a favorable trustworthiness determination, the Contractor’s Security Representative must submit for all employees each of the following:

- SF-85 Questionnaire for Non-Sensitive Positions

- Two FD-258 Applicant Fingerprint Cards (or an electronic fingerprint submission)

- Original Signed Release Statements

The contractor shall ensure each individual employee has a current favorably completed National Agency Check with Written Inquiries (NACI) or T1 equivalent investigation, or ensure successful FBI fingerprint results have been gained and investigation has been processed with OPM

Failure to provide the required documentation at least 30 days prior to the individual’s start date may result in delaying the individual’s start date.

* Consult with your CSM and ISSM/IAM for local policy when IT-III (non-sensitive) access is required for non-US citizens outside the United States.

21.0 Wage Determination

Wage Determination # 2015-4281 Revision 27 dated June 30, 2023 or its latest version is incorporated into this PWS.

THE FOLLOWING NAVSUP LOCAL TEXT IS HEREBY MADE PART OF THE STATEMENT OF

WORK/PERFORMANCE WORK STATEMENT.

Contractor Unclassified Access to Federally Controlled Facilities, Sensitive Information, Information Technology (IT) Systems or Protected Health Information

Homeland Security Presidential Directive (HSPD)-12, requires government agencies to develop and implement Federal security standards for Federal employees and contractors. The Deputy Secretary of Defense Directive-Type Memorandum (DTM) 08-006 – “DoD Implementation of Homeland Security Presidential Directive – 12 (HSPD-12)” dated November 26, 2008 (or its subsequent DoD instruction) directs implementation of HSPD-12.

This clause is in accordance with HSPD-12 and its implementing directives.

APPLICABILITY

This clause applies to contractor employees requiring physical access to any area of a federally controlled base, facility or activity and/or requiring access to a DoN or DoD computer/network/system to perform certain unclassified sensitive duties. This clause also applies to contractor employees who access Privacy Act and Protected Health Information, provide support associated with fiduciary duties, or perform duties that have been identified by DON as National Security Position, as advised by the command security manager. It is the responsibility of the responsible security officer of the command/facility where the work is performed to ensure compliance.

Each contractor employee providing services at a Navy Command under this contract is required to obtain a Department of Defense Common Access Card (DoD CAC). Additionally, depending on the level of computer/network access, the contract employee will require a successful investigation as detailed below.

ACCESS TO FEDERAL FACILITIES

Per HSPD-12 and implementing guidance, all contractor employees working at a federally controlled base, facility or activity under this clause will require a DoD CAC. When access to a base, facility or activity is required contractor employees shall in-process with the Navy Command’s Security Manager upon arrival to the Navy Command and shall out-process prior to their departure at the completion of the individual’s performance under the contract.

ACCESS TO DOD IT SYSTEMS

In accordance with SECNAV M-5510.30, contractor employees who require access to DoN or DoD networks are categorized as IT-I, IT-II, or IT-III. The IT-II level, defined in detail in SECNAV M-5510.30, includes positions which require access to information protected under the Privacy Act, to include Protected Health Information (PHI). All contractor employees under this contract who require access to Privacy Act protected information are therefore categorized no lower than IT-II. IT Levels are determined by the requiring activity’s Command Information Assurance Manager. Contractor employees requiring privileged or IT-I level access, (when specified by the terms of the contract) require a Single Scope Background Investigation (SSBI) which is a higher level investigation than the National Agency Check with Law and Credit (NACLC) described below. Due to the privileged system access, a SSBI suitable for High Risk public trusts positions is required. Individuals who have access to system control, monitoring, or administration functions (e.g. system administrator, database administrator) require training and certification to Information Assurance Technical Level 1, and must be trained and certified on the Operating System or Computing Environment they are required to maintain.

Access to sensitive IT systems is contingent upon a favorably adjudicated background investigation. When access to IT systems is required for performance of the contractor employee’s duties, such employees shall in-process with the Navy Command’s Security Manager and Information Assurance Manager upon arrival to the Navy command and shall out-process prior to their departure at the completion of the individual’s performance under the contract.

Completion and approval of a System Authorization Access Request Navy (SAAR-N) form is required for all individuals accessing Navy Information Technology resources. The decision to authorize access to a government IT system/network is inherently governmental. The contractor supervisor is not authorized to sign the SAAR-N;

therefore, the government employee with knowledge of the system/network access required or the COR shall sign the SAAR-N as the “supervisor”.

The SAAR-N shall be forwarded to the Navy Command’s Security Manager at least 30 days prior to the individual’s start date. Failure to provide the required documentation at least 30 days prior to the individual’s start date may result in delaying the individual’s start date.

When required to maintain access to required IT systems or networks, the contractor shall ensure that all employees requiring access complete annual Information Assurance (IA) training, and maintain a current requisite background investigation. The Contractor’s Security Representative shall contact the Command Security Manager for guidance when reinvestigations are required.

INTERIM ACCESS

The Navy Command's Security Manager may authorize issuance of a DoD CAC and interim access to a DoN or DoD unclassified computer/network upon a favorable review of the investigative questionnaire and advance favorable fingerprint results. When the results of the investigation are received and a favorable determination is not made, the contractor employee working on the contract under interim access will be denied access to the computer network and this denial will not relieve the contractor of his/her responsibility to perform.

DENIAL OR TERMINATION OF ACCESS

The potential consequences of any requirement under this clause including denial or termination of physical or system access in no way relieves the contractor from the requirement to execute performance under the contract within the timeframes specified in the contract. Contractors shall plan ahead in processing their employees and subcontractor employees. The contractor shall insert this clause in all subcontracts when the subcontractor is permitted to have unclassified access to a federally controlled facility, federally-controlled information system/network and/or to government information, meaning information not authorized for public release.

CONTRACTOR’S SECURITY REPRESENTATIVE

The contractor shall designate an employee to serve as the Contractor’s Security Representative. Within three work days after contract award, the contractor shall provide to the requiring activity’s Security Manager and the Contracting Officer, in writing, the name, title, address and phone number for the Contractor’s Security Representative. The Contractor’s Security Representative shall be the primary point of contact on any security matter. The Contractor’s Security Representative shall not be replaced or removed without prior notice to the Contracting Officer and Command Security Manager.

AUTHORIZED CHANGES ONLY BY THE CONTRACTING OFFICER

(a) Except as specified in paragraph (b) below, no order, statement, or conduct of Government personnel who visit the Contractor's facilities or in any other manner communicate with Contractor personnel during the performance of this contract shall constitute a change under the "Changes" clause of this contract.

(b) The Contractor shall not comply with any order, direction or request of Government personnel unless it is issued in writing and signed by the Contracting Officer, or is pursuant to specific authority otherwise included as a part of this contract.

(c) The Contracting Officer is the only person authorized to approve changes in any of the requirements of this contract and notwithstanding provisions contained elsewhere in this contract, the said authority remains solely with the Contracting Officer. In the event the Contractor effects any change at the direction of any person other than the Contracting Officer, the change will be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in charges incurred as a result thereof. Ability One

NAVSUP FLCN may utilize contractor support through the AbilityOne Program, as needed, to perform contract closeout functions for this acquisition. Information, including business sensitive/confidential or proprietary data, that the offeror provides to the Government or information already in the possession of the Government may be viewed and utilized by the AbilityOne Program support contractor personnel during the course of its contract performance.

The information that may be made available to the support contractor may include, for example, pricing and technical proposals, historical contract, pricing and performance information, Commercial Asset Visibility (CAV) reporting information and similar data/information.

By submission of a proposal in response to this solicitation, the offeror and its subcontractors consent to a release of their business sensitive/confidential or proprietary data to the Government's AbilityOne Program support contractor personnel in order to perform close out services. Prior to the release of any such information to the support contractor, the support contractor will have in place with the Government a Non- Disclosure/Non-Use Agreement in accordance with the terms of the AbilityOne Program support contract.

Offerors may execute their own Non-Disclosure Agreement with the AbilityOne Program (AbilityOne contact information available from the contracting point of contact). The support contractor must provide copies of the executed agreements to the Contracting Officer and the Contracting Officer's Representative (COR) for the support contract; and the offeror/contractor for this acquisition must provide copies of the executed Agreement to the Contracting Officer for this acquisition. If the offeror/contractor seeks such a Non- Disclosure Agreement with the AbilityOne Program support contractor, the Agreement must be executed no later than the date of final delivery under the resulting NAVSUP FLCN contract.
