JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity. The contracting activity for this action is NAVSUP Fleet Logistics Center (FLC) Norfolk, Philadelphia Office.
2. Description of the Action Being Approved. This is a sole source action to be awarded as a new firm fixed price contract to TSI, Incorporated (CAGE: 24575) of Shoreview, MN in support of the United States Naval Academy (USNA), Annapolis, MD.
3. Description of Supplies/Services.
This action is to procure a Laser Doppler Velocimetry (LDV) system, which will be provided and installed as a direct replacement of an existing system located at USNA.
The LDV system will include the following components:
Coherent DPSS continuous wave lasers, beam combination optics for Coherent DPSS lasers, laser feet for Coherent DPSS lasers, FiberLight Multicolor Beam Generator with fibervoptic couplers, 24 x 48-inch Breadboard with 1" hole spacing, Multibit Digital Burst Correlator for velocity, 100 MHz maximum Doppler frequency, 400 MHz.sampling rate, 2 channels, Firewire interface, Two-channel Photo Detector Module for velocity, Dell Precision 7920 Tower XCTO, Dual Intel Xeon Silver 4110 Processors, Nvidia NVS 310 graphics card, 512GB solid state hard drive, 2TB 7200 RPM SATA Hard drive, 16GB RAM, 22" monitor, mouse, keyboard, Flowsizer software package for LDV and PDPA systems using the FSA processor, Windows 7 64-bit OS (or better), Single fiber optic probe Mount Kit; mounts & rotation plates for attaching a single fiber optic probe to a 90 x 90 mm Rail, 90 x 90 mm Bosch rail kit; 1.5 m long compatible with existing T3D traverse system, 83 mm dia. two-component fiber optic transceiver probe, 61 mm clear aperture 350 mm F.D: lens, 15 m cable, various lens, external beam expander for 83 mm diameter probes, and on-site installation and training.
The estimated dollar value of the procurement includes hardware, shipping, installation, and training. The procurement will be funded with FY2019 Other Procurement Navy (OPN) appropriations.
4. Statutory Authority Permitting Other than Full and Open Competition. The statutory authority permitting other than full and open competition is 41 USC 1901(e)(2) – a sole source acquisition under the authority of the Special Rules for Commercial Items, as implemented by FAR 13.501(a).
5. Rationale Justifying Use of Cited Statutory Authority. Only one responsible source and no other source can provide the supplies that will satisfy the needs of the agency. The U.S. Naval Academy presently owns a suite of LDV system equipment including single and multi-component fiber probes, beam displacer, multi-component underwater fiber probes, and a three-axis traverse manufactured and/or supplied by TSI. Included are unique custom-made components that will continue to be utilized.
The new system exhibits software compatibility with the current automated three-axis traversing system (TSI part number T3D) owned by USNA. The new system's software (part number FLOWSIZER64) is specifically designed to interface and communicate with the current traverse system. The new system must allow for the accessing, viewing, and re-processing of data files obtained using the current system. Only TSI’s software exhibits backwards compatibility in this capacity. Components of the new system must also be hardware compatible with the current system. For example, TSI part numbers M-L1 and BRL150 are used to mount TR260-1 to the existing traverse system. All of these components are designed and built by TSI. TSI designs and builds all hardware for these LDV systems to ensure compatibility, and many aspects of the designs have been in place and largely unchanged for decades. Therefore, accessory mechanical parts from the old system which are still sound could be re-purposed for use with the new system. For example, lenses already owned by USNA could be used on the new system's probe (TSI part number TR260-1). USNA currently owns several components which were custom-designed by TSI for use with the old system, including a single-beam displacer prism (TSI part number LDV00143) and an accompanying adapter (TSI part number LDV00195). The new system is also compatible with these items; no other vendor can supply a system that will allow USNA to continue to make use of these components, which are required for USNA's experiments. Specifically, the following part numbers from the new system exhibit this compatibility: TR260-1, TLN06-250, TLN06-500, TLN06-750, and XPD60. These existing components would not be compatible with an LDV system from another manufacturer, rendering them inoperable. TSI, Inc. is the only known source that can provide the required supplies
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable. Research efforts by the USNA have revealed that is it not practical for the reasons discussed in paragraph 5 above for any source other than TSI, Inc. to provide the required system. Members of the USNA Hydromechanics Laboratory have current knowledge of other LDV system manufacturers and the capabilities of their systems; to date none have been identified which can provide the required capabilities.
7. Determination of Fair and Reasonable Cost. The Contracting Officer has determined that the anticipated cost to the Government will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition. Pursuant to DFARS PGI 206.302-1(d), a sources sought notice was issued on 30 January 2019; to date no other sources have express an interest in this requirement. An LDV system has been previously purchased by USNA, however the existing system was purchased 15 years ago and no information is known concerning the procurement. Therefore, no previous justification exists for the approval authority to determine whether the planned actions to remove barriers to competition have been completed in accordance with DFARS PGI 206.303-2(b)(i)(B).
Additionally, the contracting office contacted the requiring activity to determine whether the requirement could be revised to improve competition. The requiring activity advised that the requirement represents their minimum needs: therefore, they could not be revised in that regard. The requiring activity will continue to perform market research to try to identify an additional source for future requirements.
9. Contracting Activity Point of Contact. The NAVSUP FLC Norfolk point of contact is Michael Placido, Code 270.3C who may be contacted by telephone: DSN 442-9654, Commercial (215) 697-9654 or e-mail: michael.placido@navy.mil image1.png
