DEPARTMENT OF THE NAVY
NAVSUP FLEET LOGISTICS CENTER NORFOLK
1968 GILBERT STREET SUITE 600
NORFOLK VA 23511-3392
IN REPLY REFER TO
20 MAR 2018
J&A# 18040
JUSTIFICATION & APPROVAL
OTHER THAN FULL AND OPEN COMPETITION
(SOLE SOURCE)
1. Requiring and Contracting Activity:
Requiring Activity: Commander, Naval Air Forces (COMNAVAIRPAC) San Diego, CA 92132
Contracting Activity: NAVSUP Fleet Logistics Center Norfolk (FLCN)
Contracting Department, Code 200 Norfolk, Virginia 23511-3392
Requisition Number: TBD
2. Description of the Action Being Approved: This is a sole source firm fixed price/cost plus fixed fee bridge modification to fulfill the requirements directed by the Department of the
Navy’s Naval Air Forces for systems engineering and support services for the Sierra Hotel
Aviation Readiness Program (SHARP) Enterprise.
3. Description of Supplies/Services: The scope of the Performance Work Statement
(PWS) is to provide systems engineering, software design, development, and modification, integration, testing, installation, training, life cycle maintenance, procurement support, help desk services, management support, and system documentation for the SHARP Enterprise
Suite. These systems provide operational management tools which allow shipboard and squadron units to monitor, track, and report aviation squadron and CVN training. They are designed to capture and display detailed individual and unit readiness data from combatant and support commands to assess current and projected Navy warfare mission capabilities. The unique skills and experience required in providing these services place significant barriers to enter into the market by other service provides.
The Contract will be a Firm Fixed Price (FFP)/ Cost Plus Fixed Fee (CPFF) type bridge contract with a required award date on or before 28 March 2018. The total estimated dollar value of this acquisition is approximately The period of performance of the bridge will be a four (4) month base period from 29 March 2018 through 28 July 2018.
4. Statutory Authority Permitting SOLE SOURCE: 10 U.S.C. 2304(c)(1) or 41 U.S.C.
3304(a)(1).- a sole source acquisition under the authority implemented by FAR 6.302-1(a).
5. Rationale Justifying Use of Cited Statutory Authority: The Sierra Hotel Aviation
Readiness Program (SHARP) Enterprise contract encompasses three separate software applications; SHARP, CV SHARP and ACTS/SHARP LMS. Commander, Naval Air Forces
Pacific (CNAP) and Commander, Naval Air Forces Atlantic (CNAL) jointly fund SHARP and
CV SHARP. United States Naval Air Systems Command (NAVAIR) funds ACTS/SHARP
LMS. Commander, Naval Air Force Reserve (CNAFR) provides a small amount of funding for
SHARP Reserve Customer Support and Command Pacific Fleet (CPF) provides a small amount of funding for developing an interface between SHARP and DCAST. After submission of the follow-on requirement, Chief of Naval Air Training (CNATRA) notified the contracting office of its need to revise the PWS to include development of a new version of SHARP (to be called
T-SHARP) that would be adapted to the needs of the aviation training commands. T-SHARP is a requirement in the follow-on contract and is not within the scope of the current contract, or any bridge action. However, the development of this new T-SHARP capability contributed to the delay in a final, legally sufficient PWS of approximately six months. Upon receipt of the revised PWS, NAVSUP FLC San Diego worked diligently to award the competitive follow-on, and did so on 01 June 2017.
As a result of the protest, NAVSUP FLC San Diego took corrective action and awarded to
Innova. The additional bridge is needed for NAVSUP FLC San Diego’s adjudication of the protest.
N00104-13-D-Q122 supports the Commander, Naval Air Forces (CNAF), San Diego, CA, and
NAVAIR, Patuxent River, MD. The contract provides systems engineering, software design, development/modification, integration/testing, installation, training, life cycle maintenance, procurement support, help desk services, management support and system documentation for the
SHARP Enterprise Suite. These systems provide operational management tools which allow shipboard and squadron units to monitor, track and report aviation squadron and training. They are designed to capture and display detailed individual and unit readiness data from combatant and support commands to assess current and projected Navy warfare mission capabilities.
Continuity of services is essential to the success of readiness reporting for aviation squadrons and aircraft carriers. Without SHARP, readiness reporting would rapidly deteriorate. SHARP requires daily uploads of data by the contractor. SHARP data flows are maintained via numerous customer support actions every month. Due to the complexity of the system and lead time required to halt system upgrades for transition, only the incumbent contractor, Innova, has the necessary resources and staffing in place to perform services during this bridge period. A lack of contractual coverage would cause a break in services, an unacceptable gap in readiness reporting capability, and introduce other risks to the program without continued support services.
No new or additional work will be authorized under this bridge action. As mentioned above, the follow-on contract includes requirements known as T-SHARP that expands capabilities of the program to aviation training commands.
CNAF required support under the current bridge action (N0018917C0019) for the entire period of 1 October 2017 through 28 February 2018 to continue normal operations and support as defined in contract N00104-13-D-Q122. A no-cost extension was issued from 1 March 2018 through 28 March 2018 due to an underrun on costs with no performance required between 1
March 2018 and 14 March 2018. Due to receipt of another protest, which is pending adjudication, an additional bridge from 29 March 2018 to 28 July 2018 is required to ensure that support coverage is not lapsed for this critical program while adjudication occurs.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
NAVSUP FLC San Diego is processing the follow-on contract on a full and open competition basis. This sole source bridge action is needed to provide required continuity of services until the follow-on is in place and the follow-on task order(s) can be properly awarded. No further limitations on competition apply.
DFARS PGI 206.302-1(d) states “[W]hen utilizing the authority at FAR 6.302-1, the contracting officer shall post a request for information or a sources sought notice, and shall include the results of this inquiry in the justification required by FAR 6.303. This requirement to post may be waived by the Head of the Contracting Activity, or designee.” It is the considered opinion of the Contracting Officer that it is not in the best interest of the Government to issue a Request for
Information or a Sources Sought synopsis for the instant action. Specifically, the competitive follow-on has been awarded, but protested; the proposed bridge is intended to allow continuation of services pending protest resolution. Requesting information and evaluating capability statements for potential solicitation and award to other than the incumbent contractor is considered an inefficient and ineffective use of Government resources as it would be duplicative of the efforts already expended in awarding the competitive follow-on requirement. During the requested bridge period, only the incumbent contractor can perform the services required, and only the incumbent contractor has the expertise, personnel, and security clearances in place to continue performance for the interim period. The waiver of the requirement was included in the
Request for a Bridge Contract (RABC) #18040 signed by the Head of the Contracting Agency
(HCA).
7. Determination of Fair and Reasonable Cost: A determination of fair and reasonableness of price will be based on the Contracting Officer’s cost and price analysis of the contractor’s proposal and/or a comparison of previous pricing history and published price list of the same or similar items in accordance with FAR 13.106-3.
8. Actions to Remove Barriers to Future Competition: As noted above, NAVSUP FLC San Diego is processing the follow-on contract on a full and open competition basis. This sole source bridge action is needed to provide required continuity of services until the follow-on is in place and the follow-on task order(s) can be properly awarded. No further limitations on competition apply.
9. CONTRACTING POINT OF CONTACT: The point of contact at NAVSUP Fleet Logistic Center Norfolk is Heather Coleman, who can be reached at (757) 443-2066 or by email at Heather.coleman@navy.mil.
