WATER TESTING SERVICES
1.0 Background:
1.1 The mission of Naval Station Newport is to fulfill the diverse requirements of its tenant commands by providing the facilities and infrastructure that are essential to their optimum performance. NAVSTA Newport ensures that the highest standards of the Navy are incorporated into its efforts; that all tenant commands benefit from its continuous improvement; and that all hands work together to earn and maintain its reputation as the Navy's world-class Center of Learning Excellence.
1.2 To ensure operational sustainment, Naval Station Newport is required to follow Rhode Island state environment regulations for water testing. At this point in time, Naval Station Newport does not have the organic capability to perform their own environmental state approved lab testing on site and requires a commercial contract to sucessfully perform the required services.
2.0 Scope:
2.1 Naval Station Newport, RI (NAVSTA) requires support services for the environmental sampling of water to fulfill the requirements of state environmental compliance regulations. The government requires a certified analytical laboratory by the State of Rhode Island’s Health Department who is able to perform environmental analyses in accordance with existing local, state, and federal regulations.
3.0 Tasks:
3.1 The vendor shall coordinate with the NAVSTA Environmental Department for the specific time and place of samplings. The vendor shall provide all labor, materials, equipment, sample bottles, transportation of samples and supervision necessary to analyze water samples from locations at NAVSTA in accordance with the specifications listed herein.
3.2 Annual Sample (Samples done on one day at 2 locations in April) Vendor will deliver all bottles to the NAVSTA between April 1 and April 20, each year of the contract for ANNUAL SAMPLE identified below.

Test samples will be picked up at 11:30 AM on the first four Tuesdays of every month at building A-9. Samples need to go straight to the lab to meet holding times.
Any samples that test positive for Total Coliform Bacteria will need to be tested for Fecal Coliform (in accordance with standard test procedures) Vendor shall pick up any repeat samples that need to be tested after a positive result. Pick up of these samples need to be coordinated with environmental POC.
Positive samples must be reported within 2 hours of final results.
Lab must speak in person with Darlene Ward 841-6376 (work), Scott Abrham 401-405-7076 (cell), or Dave Dorocz 401-841-7671 (work) 401-862-8433 (cell) or 401-725-6762 (home) after receiving a positive Total Coliform test. Leaving a message on voicemail does not satisfy this requirement, Lab may be required to pick up and test samples during the weekends if needed for repeat samples NOTE: SAMPLES MAY HAVE TO BE DONE ON WEEKENDS AND THE VENDOR MUST HAVE A WEEKEND STAFF TO INSURE THAT SAMPLING AND TESTING CAN BE ACCOMPLISHED.
ROUTINE RESULTS WILL BE FOWARDED TO NAVAL STATION NEWPORT WITHIN 7 CALENDER DAYS.

Four sample sets need to be taken every month at two different locations. The sites are Outfall 005A and 008A in Tank Farm 3 and the “back yard” of Defense Fuel Support Point (DFSP) respectively. An estimated flow (in MGD) from each outfall needs to be made during each sample pull (estimate with pump cycle). The samples need to be taken as specified in the permit. Briefly explained “two samples need to be taken during wet ether, one sample to be taken immediately after wet weather and one sample to be taken during dry weather.” If the samples cannot be taken as specified then they must be taken in the final week of the month until all four samples have been taken. 4.0 Quality Assurance Surveillance Plan:
4.1 A report for each test as to when the samples were picked up and when the tests were started and completed will be given to the Government Technical Point of Contact (GTPOC). This will be used to determine if all performance measures as stated below, are being followed.
4.2 If the vendor does not perform as to the measures stated below and the vendor does not correct unsatisfactory work, to include but not limited to: incorrect testing, late retrieval, and non-disclosure of results, it will count negatively against overall performance standards. Depending on the circumstances, timely corrective action by the vendor may and as determined by the GTPOC, be marked favorably towards performance standards. The vendor shall notify the technical point of contact of any corrective actions taken to ensure proper measures.
5.0 Period of Performance:
5.1 The proposed contract is for a period of performance of one (1) base year and (4) option years with an additional optional six month period under FAR 52.217-8 Option to Extend as follows:

6.0 Performance Objective:
6.1 The vendor shall perform environmental sampling in accordance with State of Rhode Island Regulations and Naval Station Newport wastewater discharge permits. The samples are time sensitive and must be analyzed within applicable holding times and in accordance with Standard Methods for the Examination of Water and Wastewater or other relevant standard. In order to meet the time sensitive requirements, the vendor and it’s facility shall be physically located within 2 hours drive of Naval Station Newport.
7.0 Performance Measures:
7.1 A standard of 98% of all testing will be done within the timeframes identified herein. The vendor shall provide qualified personnel to perform the testing in a timely manner. The testing will commence on time as per Rhode Island State Regulations for a legitimate test.
8.0 Security:
8.1 The selected vendor shall provide a list of worker's full names, Social security number (SSN’s), Date of Birth (DOB's), and Security clearances to Deborah Moore 401-841-1790 to facilitate access.
8.2 All vendor equipment, personnel and vehicles are subject to inspection and search by US government security officials (or designated representatives) upon entry to any government owned and/or operated installations and facilities.
8.3 Vendor personnel shall comply with all local base/installation security procedures required to gain access to US Government ships, facilities and other assets.
8.4 If directed by US government security officials (or designated representatives), the vendor shall remove any equipment or personnel considered a security risk.
8.5 Government reserves the right to visit, inspect and travel with vendor assets that will be used in support of the requirement.
8.6 The vendor shall coordinate and comply with "all security requirements" regarding each personnel assigned to this project through the Government Technical Point of Contact (GTPOC).
9.0 Access Requirements To Us Navy Installations:
9.1 Individuals currently using an Nay Commercial Access Control System (NCACS) credential for Installation access are required to switch to a Defense Biometric Identification System (DBIS) credential no later than 14 August 2017. After 14 August 2017, the NCACS credential will no longer be valid for access to Navy Installations.
9.2 NCACS users may visit the local Navy Installation Visitor Control Center to obtain a DBIDS credential. There are no fees incurred by the contractor, vendor, or supplier to obtain a DBIDS credential.

10.1 The contractor shall report contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the water testing via a secure data collection site. Contracted services excluded from reporting are based on Product Service Codes (PSCs). The excluded PSCs are:
(1) W, Lease/Rental of Equipment;
(2) X, Lease/Rental of Facilities;
(3) Y, Construction of Structures and Facilities;
(4) D, Automatic Data Processing and Telecommunications, IT and Telecom- Telecommunications Transmission (D304) and Internet (D322) ONLY;
(5) S, Utilities ONLY;
(6) V, Freight and Shipping ONLY.
10.2 The contractor is required to completely fill in all required data fields using the following web address https://doncmra.nmci.navy.mil.
10.3 Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. Contractors may direct questions to the help desk, linked at https://doncmra.nmci.navy.mil.

52.209-11 REPRESENTATION BY CORPORATIONS REGARDING DELINQUENT TAX LIABILITY OR A
FELONY CONVICTION UNDER ANY FEDERAL LAW (FEB 2016)
(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--
(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or
(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (JAN 2017)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint.
