FOR OTHER THAN FULL AND OPEN COMPETITION
1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY:
| Requiring Activity: | U.S. Navy, Naval Support Activity, Northwest | |
| 1298 Olympic Avenue, Bldg 310 | ||
| Chesapeake, VA 23322 |
| Contracting Activity: | NAVSUP Fleet Logistics Center (FLC) Norfolk | |
| Contracting Department Code 245.1 | ||
| 1968 Gilbert Street, Suite 600 |
Norfolk, VA 23511-3392
2. NATURE/DESCRIPTION OF CONTRACT ACTION:
This is a non-competitive action submitted to award a Firm Fixed Price (FFP) contract to Piezo technology Inc. DBA MtronPTI (Piezo) for the procurement of radar filters to continue to support the Relocatable Over the Horizon (ROTHR) system for Forces Surveillance Support Center (FSSC) in Chesapeake, VA.
3. DESCRIPTION OF REQUIRED SUPPLIES/SERVICES:
This requirement is to acquire Piezo Model Part Numbers 7695, 7698, Bandpass Crystal Filter Assemblies in order to sustain logistical and operational support for the ROTHR system. The ROTHR system is at an end of its life cycle phase. FSSC’s current ROTHR System configuration uses unique RF Receiver Electrical components within the system Radar, Sounder, and Spectrum Monitor receiver groups (subsystems) for radar signal wave and detection. The required Crystal Filter Assemblies are original electrical design specification RF Crystals QPL, which are qualified for the Navy’s ROTHR system under SOCN G318134-M in form and fit. They are functionally identical in characteristics. They are also consistent in both configuration and compatibility to the radar system receiver interfaces including P. C. mount architecture, mechanical, electrical and signal intermodulation frequency requirements. These units were designed to be used in the Radar, Sounder, and Spectrum Monitor Receivers throughout the ROTHR system life cycle.
4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION: 41 U.S.C. 1901(e)(2), a sole source acquisition under the authority “Simplified Acquisition Procedures for Certain Commercial Items” as implemented by FAR 13.501(a).
5. RATIONAL JUSTIFYING USE OF THE CITED STATUTORY AUTHORITY:
These parts are integrated into a sub-assembly in FSSC’s ROTHR system in which the system incorporates RF Receiver Electrical components that interface and support high frequency surface mount signal detection processing assemblies to meet current specifications. Utilizing an alternate product source would necessitate additional system modifications in terms of implementing system hardware/software changes, maintenance and logistics support updates which would impact system availability as well as program support costs.
The supply support posture of these parts is experiencing Diminishing Manufacturing Sources, Material Shortages (DMSMS) in terms of long production run lead times, set-up costs, sourcing build materials and ROTHR system on-hand quantity attrition of less than 18 months stock duration.
6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY OFFERORS AS PRACTICAL:
Market research revealed these parts to be commercial in nature. The Requiring Activity’s Contracting Specialist researched GSA schedules using the GSA Advantage website. The Crystal Filters were not found to be available. The requiring activity certifies that the requirement can be met by commercial items. The parts required are not available from a mandatory or preferred source. Historical market research revealed that the Receiver Crystal Filters were initially provisioned in 1992 as part of the ROTHR system production via Raytheon and its suppliers. Raytheon provided a list of suppliers that could possibly fulfill the crystal filters for a final supply purchase. Only Piezo responded to the request for information. This procurement serves as a last time buy of these parts which supports life cycle sustainment of the ROTHR system.
To locate capable sources and in accordance with Procedures, Guidance, and Information (PGI) 206.302-1(d), a Sources Sought was posted to NECO and FedBizOpps from 23 May 2018 to 29 June 2018 that resulted in zero (0) responses.
In summary, market research revealed that this requirement can be fulfilled as a Sole Source requirement from Piezo.
7. DETERMINATION OF FAIR AND REASONABLE COST:
A determination of fair and reasonableness of price will be based on the Procuring Contracting Officer’s price analysis and in accordance with FAR 13.106-3 paragraph (a) subparagraph (2) (i)(ii)(iii)(iv) or any combination thereof.
8. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION:
A Sources Sought Notice was published on the GPE with no further feedback provided by closing. The synopsis required by FAR 5.201 will be published on the GPE. The sole source solicitation will be made available in accordance with FAR 5.102(a)(3) along with the post award Justification and Approval in accordance with FAR Part 13.501(a)(iii).
9. CONTRACTING POINT OF CONTACT:
The contracting point of contact is Mr. Paul Cofield, who can be reached at 757-443-1454 or email at paul.cofield@navy.mil.
