(a) The Government intends to award a Firm Fixed Price, Indefinite Delivery Requirements contract resulting from this solicitation to the Lowest Price Technically Acceptable (LPTA) Offer. Note: The Government intends to award solely on the information contained in the quote and sample. The Government is not obligated to seek completion or clarification of technical information. The following factors will be used to evaluate offers:

Selection of a vendor for award will be based on two parts, as follows:

i. Technical Capability (Oil Containment Boom Sample and Manufacturer’s Specifications Data Sheet)

ii. Price

TECHNICAL

Sample: The Government will evaluate each sample in terms of conformance with the specification enclosed in this solicitation.

Manufacturer’s Specifications Data Sheet: The manufacturer’s specifications data sheet will be used to evaluate the following two elements:

i. Skirt material has a minimum tensile strength of 440/340 lbs.

ii. Boom has a bottom tension of 5/16” hot-dipped galvanized grade 30 – proof coil chain with a minimum tensile strength of 7,600 lbs.

The Government will evaluate each vendor’s Manufacturer’s Specifications Data Sheet and their sample oil containment boom as acceptable or unacceptable:

Rating
Description
Acceptable
Clearly meets the minimum requirements of the solicitation.
Unacceptable
Does not clearly meet the minimum requirements of the solicitation.

The Government will not give any favorable consideration, preference, “extra credit,” or other positive evaluation to any matters contained in a section of the quote, which could be construed to exceed the minimum requirements of the Specifications.

Technical quotes that meet all of the criteria stated in the solicitation and have the technical capability to successfully deliver the required supply in accordance with the Government’s specifications will be given an “Acceptable” rating. Technical quotes that do not meet all of the minimum requirements stated in the solicitation and specifications will be rated as not having the required technical capability and will be issued an “Unacceptable” rating and will no longer be considered for further competition or award.

PRICE

Price quotes will be evaluated on the basis of price reasonableness. Quoter’s price will be evaluated based the unit price and extended price columns of the table above or provide all information contained in the table in the vendor’s standard quote format. The PCO may evaluate any and all information submitted by the vendor to support the reasonableness of prices quoted. Failure to submit the requested information may result in disqualification of the submitted quote.

(b) The Contracting Officer will review all of the quotations. Upon completion of the above, a single award for all items will be made to the quoter whose quotation, conforming to the solicitation, is considered acceptable, i.e. received an “acceptable” evaluation for Technical and whose offer is considered to be the lowest price. Any offer receiving an “unacceptable” in Technical will not be considered for award.

(c) The Government may determine that an offer is unacceptable if the prices quoted for each year within the ordering period are significantly unbalanced.

The Contracting Officer may ask the vendor to provide written acceptance of an order. In other circumstances the vendor may indicate acceptance by proceeding with the supplies ordered.
