QUESTIONS AND ANSWERS

Question 1

Potential Offeror currently operates three separate disposal facilities that can accept LLRW.

· Federal Waste Facility (FWF) – for federal waste as defined by the LLRWPAA of 1985

· Compact Waste Facility (CWF) – for compact (TX and VT), and out of compact waste(38 other states)

· Subtitle C RCRA Disposal Facility for exempt waste – for waste that meets the radioactive waste exemption limits. (no compact or Federal restrictions)

Each of the three disposal facilities requires different pricing (based on regulatory direction). Through our Federal Waste Facility, POTENTIAL OFFEROR can offer rates that are extremely competitive. For waste to be accepted in the FWF it must meet the definition of “Federal Responsibility” as defined in the LLRWPAA (below):

a) Low –level radioactive waste owned or generated by the Department of Energy

b) Low-level radioactive waste owned or generated by the United States Navy as a result of the decommissioning of vessels of the Unites States Navy

c) Low-level radioactive waste owned or generated by the Federal Government as a result of any research, development, testing, or production of any atomic weapon; and

d) Any other low-level radioactive waste with concentrations of radionuclides that exceed the limits established by the Commission for class C radioactive waste, as defined by section 61.55 of title 10, Code of Federal Regulations, as in effect on January 26, 1983.

POTENTIAL OFFEROR’s would like to limit our offer to waste that meets the definition of Federal Waste (above). This would allow POTENTIAL OFFEROR to provide all disposal services for the following facilities [based on (a) – above]:

· Kesselring Site (Kesselring), West Milton, NY

· Knolls Laboratory (Knolls), Niskayuna, NY

· Bettis Atomic Power Laboratory (Bettis), West Mifflin, PA

· Naval Reactors Facility (NRF), Idaho Falls, ID

In addition, POTENTIAL OFFEROR could provide disposal services for waste that meets the definition b) above – waste associated with the decommissioning of naval vessels.

Would limiting POTENTIAL OFFEROR’s offer to the four facilities listed above and waste associated with the decommissioning of naval vessels be considered non-compliant with the requirements of the solicitation?

ANSWER 1:

Please respond in accordance with the requirements of the solicitation.

Question 2

Would the NAVSUP Fleet Logistics Center Norfolk consider making two awards for NNPP disposal services under this solicitation? We believe – allowing two awards would be advantageous to the NNPP by minimizing risk associated with single point failure while supporting highly competitive pricing.

ANSWER 2:

No. This is not a multiple award contract.

Question 3

POTENTIAL OFFEROR is licensed to accept class A, B, and C LLRW/MLLRW for disposal for federal waste (as defined in question 1) or any waste that is not within a current compact (representing about 38 states including VA, ME, CA, GA, NY, PA).

Would NNSY consider allowing optional pricing for Class B, and C waste as part of our offer?

ANSWER 3:

No. This contract is required for disposal of Class A waste only.

Question 4

POTENTIAL OFFEROR has the capability to perform on-site dewatering of resins at our disposal facility, would NNPP consider allow alternate pricing for dewatering to be added as an addition line item to the contract? This would eliminate multiple truck trips to processing and disposal facilities for NNPP.

ANSWER 4:

Pricing for dewatering services is not required.

Question 5

Can the offer modify the pricing sheet to include surcharges such as cask handling charges?

ANSWER 5:

No. Attachment 3, the pricing worksheet cannot be modified.

Question 6

What if the disposal site is licensed by an agreement state and does not have NRC license nor is required to have a NRC approved quality assurance program, does this requirement apply to provide?

ANSWER 6:

Instructions to Offerors Addendum is hereby modified as follows:

I.a.

Documentation that the disposal facilities used by the offeror in the performance of the required effort are licensed to handle the quantity and type of waste materials being received under the terms of the resulting contract. Documentation shall include the Nuclear Regulatory Commission (NRC) license number or NRC Agreement State license number, as applicable, and applicable Environmental Protection Agency/State permit numbers.

I.e.

One (1) copy of the offeror’s current NRC license or NRC Agreement State license.

Question 7 Solicitation N00189-13-R-E001, Attachment 3 – Pricing Worksheet

Refer to Line Item 4, Radioactive Solid Waste Disposal Fees; Estimated quantity: 7,500 cubic feet, applicable to PWS Paragraph C.3.

Will it be acceptable to submit the pricing as multiple unit prices pertinent to specific waste types rather than as one singular unit price to cover all waste types as suggested by the pricing worksheet?

ANSWER 7:

Attachment 3, the pricing worksheet has been modified to illustrate specific waste types utilized by the NNPP.
