LIMITED SOURCE JUSTIFICATION FOR MAC ORDER (above SAT)
1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY: This is a Limited Source Justification. The requiring activity is the Naval Education Training Center (NETC), located in Pensacola, FL, in conjunction with Office of the Chief of Naval Operations (OPNAV); the contracting activity is the NAVSUP Fleet Logistics Center Norfolk, Philadelphia, Office.
2. NATURE/DESCRIPTION OF CONTRACT ACTION: This acquisition is conducted under the authority of 10 U.S.C. 2304a through 2304d. This is a limited source action to be awarded as a modification of an existing order to General Dynamics Information Technology (GDIT) (other than small business concern) identified in paragraph 3 below. The order is a level of effort, cost-plus-fixed-fee type. The order was issued to GDIT on a best value, competitive basis where 5 quotes were received in response to the RFQ.
As a result of the evaluation, GDIT’s quote was determined to be most advantageous and the order was issued on 11 September 2012 in the total amount of $4,695,340.47, inclusive of options.
3. DESCRIPTION OF REQUIRED SUPPLIES/SERVICES: The proposed acquisition is to add similar and interrelated work to the existing order issued to GDIT. It is intended to acquire additional support for OPNAV’s Navy Operational Stress Control Mobile Training program. Currently, the order provides for instructor support of four teams (12 people total) – 2 teams in Norfolk, VA and 2 teams in San Diego, CA. These teams travel extensively to military installations providing training support. OSC program works across the Enterprise to prevent stress injuries by building solid psychological resilience in Sailors, their families, and their units; to decrease the stigma associated with seeking care for stress-related injuries; to foster effective responses to stress reactions; and to work to facilitate healing from stress injuries with the goal of providing the right level of support to keep the Sailor in his or her command. OPNAV has identified that the need by Sailors for this training has increased significantly in the past year. This program was determined by the Vice Chief of Naval Operations to be one of the most important ones currently being taught in the Navy. As such, the Navy requires an increase in support services under this order. An additional two teams are needed to meet this influx for this Option I (17 September 2013 through 16 September 2014) and next Option II (17 September 2014 through 16 September 2015). The total estimated cost of this additional effort is inclusive of both option years. FY13 OMN funds will be utilized for the Option I.
4. IDENTIFICATION OF THE JUSTIFICATION RATIONALE AND/OR DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS: The statutory authority which permits not providing each awardee a fair opportunity to be considered for each order exceeding $3,000 issued under a multiple award contract is 10 U.S.C. 2304c, as implemented by FAR 16.505(b)(2) and, for orders exceeding $150,000, DFARS 216.505-70(b)(2).
The justification for limiting sources is
(iii) The order must be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order;
N00189-12-D-Z020 Task Order 13 was solicited on a full and open, competitive basis resulting in best value award to GDIT in the total amount of $4,695,340.47 on 11 September 2012. Five quotes – URS, GDIT, Camber, LSI, and Techsoft – were received in response to the Request for Quotes. Under a previous contract (N00189-08-D-Z034), GDIT actually developed the training program and under this contract/order they have been performing this training effort for the past year satisfactorily. In the interest of economy and efficiency, the order should be modified to increase the support as it would not be advantageous to compete separately amongst the nine MAC contract awardees. It would not be conducive to have two separate contractors provide the same training support needed for the sake of competition especially given that the requirement was competed less than a year ago and resulted in competitive pricing and a best value award where GDIT was the highest technically rated at a minute price premium compared to the other offerors (as technical was more important than price). As such, the order should be modified for the additional support services. This is the only modification for additional work that has been done under this task order and it is not anticipated that another modification for additional work will be done in the future.
5. DETERMINATION OF THE BEST VALUE: The contract did establish the prices for the services to be fair and reasonable at time of contract award based on adequate price competition and historical price information. The NAVSUP Fleet Logistics Center Norfolk, Philadelphia Office, Contracting Officer will determine, using the procedures in FAR 15.4, that the modification to this order represents the best value to meet the Government's needs. The total price of the order was determined to be fair and reasonable at time of issuance of the order based upon adequate price competition and historical price information.
6. DESCRIPTION OF MARKET RESEARCH: This task order was originally solicited on a full and open, competitive basis where five quotes were received. As stated above, a modification to add new work to N00189-12-D-Z020 TO 13 would be advantageous as the work is interrelated. GDIT has been performing satisfactorily, within costs, and without delays per the COR.
7. ANY OTHER SUPPORTING FACTS: This procurement uses a MAC and will be solicited and awarded in accordance with FAR Subpart 16.5. In accordance with FAR 16.505(b)(2)(ii)(D), this LSJ will be posted to Government Point of Entry (NECO) within 14 days of issuance of modification.
8. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION: All future requirements will be handled on a case-by-case basis.
9. CONTRACTING POINT OF CONTACT: The point of contact at NAVSUP Fleet Logistics Center Norfolk, Philadelphia Office is Adelina LaCroce, Code 270.3A, at DSN 442-9603, commercial 215-697-9603 or by e-mail at Adelina.lacroce@navy.mil.
