LIMITED SOURCE JUSTIFICATION FOR MAC ORDER (above SAT)
1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY: This is a Limited Source Justification. The requiring activity is the Naval Education Training Center (NETC), located in Pensacola, FL; the contracting activity is the NAVSUP Fleet Logistics Center Norfolk, Philadelphia, Office.
2. NATURE/DESCRIPTION OF CONTRACT ACTION: This acquisition is conducted under the authority of 10 U.S.C. 2304a through 2304d. This is a limited source action to be awarded as a modification of an existing order to Sonalysts (other than small business concern) identified in paragraph 3 below. The order is a cost-plus-fixed-fee type with a fixed priced line item. The order was issued to Sonalysts on a best value, competitive basis where 8 quotes were received in response to the RFQ.
. As a result of the evaluation, Sonalysts’ quote was determined to be most advantageous and the order was issued on 29 September 2012 in the total amount of $1,534,345.63.
3. DESCRIPTION OF REQUIRED SUPPLIES/SERVICES: The proposed acquisition is to add similar and interrelated work to the existing order issued to Sonalysts. It is intended to acquire a support for development of an Instructional Media Design Package to include high level storyboards to the already being developed IMDP under tile order. In addition, support needs to be provided to develop common software engine capable of replicating front panel operation of various apprentice technical training systems (an increase from 50 to 75 hours). The order's current period of performance will change with a completion date of 21 August 2015. This is a completion type order where the contractor will develop an end product, in this case curriculum software, and the government will receive the completed end product at the end of the order. If Sonalysts completes the additional work under this order the estimated IGE for this additional work is . If the additional work is competed as a new requirement, the Government estimate is $850,000.00 at the least. FY13 OMN funds will be utilized.
4. IDENTIFICATION OF THE JUSTIFICATION RATIONALE AND/OR DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS: The statutory authority which permits not providing each awardee a fair opportunity to be considered for each order exceeding $3,000 issued under a multiple award contract is 10 U.S.C. 2304c, as implemented by FAR 16.505(b)(2) and, for orders exceeding $150,000, DFARS 216.505-70(b)(2).
The justification for limiting sources is
(iii) The order must be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order;
N00189-12-D-Z023 Task Order 04 was solicited on a full and open, competitive basis resulting in best value award to Sonalysts in the total amount of $1,534,345.63 on 29 September 2012. Eight quotes – URS, Raytheon, Camber, GDIT, LSI, Kratos, Techsoft and Sonalysts – were received in response to the Request for Quotes. The effort entailed support analysis and modularization of course content for various advanced electronic courses taught by Naval Education Training Centers (NETC) Learning Centers. This training development effort also includes Job Task Analysis and detailed IMDP followed by a blended learning development effort. As of this date, Sonalysts has completed almost half of the development of the course content. The additional work requested is development of 90 hours of blended learning in AIM Learning Object (LO) module to be added to the development already completed under this order.
The additional work would add high level storyboards to the already being developed IMDP under the order. Since Sonalysts has completed almost half of the course development for this, they would be able to utilize the work already performed and apply it to the additional IMDP for lesson completion. If this new work were to be competed amongst the nine contractors, they would be starting from the beginning with the IMDP. In addition, they would have to integrate the work already completed by Sonalysts for this lesson into their effort. This would result in duplicate effort because the new contractor would be starting from the beginning whereas Sonalysts has done the work already. It would result in delays because instead of receiving the end product by 21 August 2015 it could take another 6 months after that date for the contractor to deliver the end product. Lastly, it would result in duplication of costs in that it is estimated that it would only cost Sonalysts for the additional work whereas it is estimated that it would cost $850,000.00 for another contractor to perform the effort. By having Sonalysts perform the additional work under TO 04, they can apply the work they already have done to the additional work thus realizing significant savings in effort, time and costs. This is the only modification for additional work that has been done under this task order and it is not anticipated that another modification for additional work will be done in the future.
5. DETERMINATION OF THE BEST VALUE: The contract did establish the prices for the services to be fair and reasonable at time of contract award based on adequate price competition and historical price information. The NAVSUP Fleet Logistics Center Norfolk, Philadelphia Office, Contracting Officer will determine, using the procedures in FAR 15.4, that the modification to this order represents the best value to meet the Government's needs. The total price of the order was determined to be fair and reasonable at time of issuance of the order based upon adequate price competition and historical price information.
6. DESCRIPTION OF MARKET RESEARCH: This task order was originally solicited on a full and open, competitive basis where eight quotes were received. As stated above, a modification to add new work to N00189-12-D-Z023 TO 04 would result in significant savings in effort, time, and costs as the work being done by Sonalysts under the order is interrelated to the new work and thus making it a logical follow-on to the work being done already. Sonalysts has been performing satisfactorily, within costs, and without delays per the COR.
7. ANY OTHER SUPPORTING FACTS: This procurement uses a MAC and will be solicited and awarded in accordance with FAR Subpart 16.5. In accordance with FAR 16.505(b)(2)(ii)(D), this LSJ will be posted to Government Point of Entry (NECO) within 14 days of issuance of modification.
8. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION: All future requirements will be handled on a case-by-case basis.
9. CONTRACTING POINT OF CONTACT: The point of contact at NAVSUP Fleet Logistics Center Norfolk, Philadelphia Office is Adelina LaCroce, Code 270.3A, at DSN 442-9603, commercial 215-697-9603 or by e-mail at Adelina.lacroce@navy.mil.
