About this file

This is a Justification and Approval (J&A) document for an exception to fair opportunity procedures, issued by the Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD).

The document justifies a firm-fixed-price delivery order under the NASA Solutions for Enterprise-Wide Procurement (SEWP) Government-wide Acquisition Contract (GWAC) for brand-name computing hardware on a limited source basis. The required supplies are manufactured exclusively by SMART Embedded Computing and Mercury Systems. The order includes four line items: eight ATCA Processor Blades (ATCA-7540-C06), four ATCA Switch Blades (ATCA-F140-C06), eight additional ATCA Processor Blades (ATCA-7480-C07), and four RES XR6-3U M6-M1 20" Rear I/O Servers. Delivery is required as soon as possible after order receipt. The estimated contract cost is redacted, and funding will be provided through Fiscal Year 2026 RDTE funds. The rationale for the exception to fair opportunity is based on 41 U.S.C. §§ 4101-4106, implemented in FAR 16.507-6, citing proprietary data and technical compatibility requirements that limit competition to these two manufacturers. Market research confirmed no other manufacturers can meet government minimum requirements without additional cost and risk. The document notes that brand-name supplies are available from multiple authorized resellers under the NASA SEWP GWAC. The Contracting Officer, Kimberly S. Curtin, and supporting technical and legal personnel have certified the justification's accuracy. The primary point of contact is Keith Aubert.

5. Rationale Justifying Use of Cited Statutory Authority need these materials

These materials are representative of the computer infrastructure currently present

These computing components must also be identical to the components Without these components, there would be delays that would ultimately have a negative impact on deliverables and the fleet. The cost of losing these additional testing capabilities is estimated at up to which would affect the program’s ability to meet its mission. Proprietary data limits competition. No other brand can satisfy the government’s requirement without additional cost and risk to the government.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Market research was conducted through internet searches, consulting with subject matter experts, and obtaining a market research quote. This market research has shown that SMART Embedded Computing and Mercury Systems are the only manufacturers capable of meeting the Government’s minimum requirements.

The required brand-name supplies are available from multiple authorized resellers under the NASA SEWP GWAC and solicitation will include all authorized resellers based on the required brand name products.

7. Determination of Fair and Reasonable Costs

The NASA SEWP GWAC does not establish the price for the required supplies. Therefore, the NSWCDD Contracting Officer will determine, using the procedures in FAR Subpart 15.4, that the cost is fair and reasonable to meet the Government's needs.

8. Actions to Remove Barriers to Competition

The proposed order uses the NASA SEWP GWAC and will be solicited and awarded in accordance with FAR Subpart 16.5 and the NASA SEWP ordering procedures. For the reasons set forth in Paragraph 5, NSWCDD’s Contracts Department has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges, the Contracts Department will assess whether competition for future requirements is feasible.

9. Contracting Point of Contact

The point of contact for this requirement is Keith Aubert, keith.m.aubert2.civ@us.navy.mil, 540- 742-8886.
