About this file
This document is a Justification for an Exception to Fair Opportunity (J&A) for a delivery order under the NASA Solutions for Enterprise-Wide Procurement (SEWP) Government-wide Acquisition Contract. The Naval Surface Warfare Center, Dahlgren Division (NSWCDD) seeks to procure a specialized RF Signal Testing Suite from National Instruments Corp (NI), consisting of multiple components including an 18-slot PXI Express Chassis, Xeon 8 Core Controller, FPGA Co-Processor, data storage modules, rack mount equipment, power supplies, cables, and software licenses.
The justification highlights that no alternative vendor's products are compatible with the existing system without significant additional time and cost. Market research determined that switching to another manufacturer would require over $1,500,000 and more than 12 months to reconfigure, reprogram, and retrain personnel. The procurement will use Fiscal Year 2025 Capital Improvement Project funds, with the total estimated cost redacted. The contract will be solicited through NASA SEWP GWAC authorized resellers, and the Contracting Officer will determine fair and reasonable pricing using FAR procedures.

certifying technical and requirements personnel.
The estimated cost of the proposed contract action is . The type of funds to be used for this procurement is Fiscal year 2025 Capital Improvement Project funds.
4. Identification of Exception to Fair Opportunity Process
41 U.S.C. §§ 4101 4106, as implemented in FAR 16.505(a)(4);
Requirements for use of items peculiar to one manufacturer.
5. Rationale Justifying Use of Cited Statutory Authority in accordance with Office of the Chief of Naval Operations Instruction 3430.23D, requires multiple RF signal generators to
The procurement of a holistic RF Signal Testing Suite RF signal generators with auxiliary/support equipment is required to meet both existing and future . The system must be compatible (form, fit, J&A Number: DN-25-0074 and function) with the current system. N would be compatible without additional time and cost. In addition, procuring these specific specialized RF Signal Generators with signal testing suite from another manufacturer would present unacceptable performance, quality and schedule
The cost of securing another brand of equipment would be upwards of $1,500,000.00 and would require in excess of twelve (12) months to research, procure, reconfigure, reprogram software code and retrain personnel on a different system. This additional cost could not be recovered through full and open competition.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
Extensive market research by the engineering team has been conducted to find expert resources to meet the needs of the
. Market research included reviewing online product literature published by manufacturers, vendor demonstrations and discussions as well as consulting with Department Subject Matter Experts. An Analysis of Alternatives (AoA) was performed by , which included the review of two (2) other systems with requirements. Firs -Emitter Environment Test Signals produce a high-fidelity RF signal but has no compatibility with existing simulations used by the for system, was researched which produces a Pulse Descriptor Word (PDW) that aligns with the same intelligence content used to
. The PDW output is not tailored for use by the and would require software adaptation to be used with the system. This market research has shown that no system without additional time and cost. In addition, internet searches have confirmed that the required brand-name supplies are available from multiple authorized resellers under the NASA SEWP GWAC and solicitation will include all authorized resellers based on the required brand name products.
7. Determination of Fair and Reasonable Costs
The NASA SEWP GWAC does not establish the price for the required supplies. Therefore, the NSWCDD Contracting Officer will
J&A Number:
determine, using the procedures in FAR 16.505(b)(5), that the order is fair and reasonable to meet the Government's needs.
8. Actions to Remove Barriers to Competition
The proposed order uses the NASA SEWP GWAC and will be solicited and awarded in accordance with FAR Subpart 16.5 and the NASA SEWP ordering procedures. For the reasons set forth in Paragraph 5, compete future contracts for the type of equipment covered by this document. If another potential source emerges, the Contracts Department will assess whether competition for future requirements is feasible.
