JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department

2. Description of the Action Being Approved

Award of a firm fixed priced contract on a sole source basis for critical equipment to be used by the Gun and Electric Weapon

Systems Department , High Power RF System Development Branch

, manufactured by Teledyne E2V Limited.

3. Description of Supplies/Services

The has tasked the

Naval Surface Warfare Center Dahlgren Division’s (NSWCDD)

. The required components, manufactured by Teledyne E2V, are as follows:

The Government's minimum needs have been verified by the certifying technical and requirements personnel.

The estimated cost of the proposed contract action is

$342,136.00. Fiscal year (FY) 2017 Research, Development, Test, and Evaluation funds will be provided for this procurement.

4. Statutory Authority Permitting Other Than Full and Open

Competition

5. Rationale Justifying Use of Cited Statutory Authority

The

. The current E2V systems have several technical specifications that have not been found available through other

Modulator and Magnetron System Vendors. These specifications are

Output Power, Variable Output Power, Pulse Width, Pulse

Repetition Rate, and Duty Cycle. These E2V components have been identified as front running solutions to drive and increase the overall output of an existing 5MW RF source higher, and achieve an output of 7-8MW.

These components must be compatible (form, fit, and function) with the currently installed components in the systems while meeting the required specifications. The E2V modulator and magnetron are the only known components to meet all specifications and maintain compatibility within the systems to be utilized. E2v developed this proprietary hardware that matches the required technical parameters and is the most mature example of this technology in industry. Due to the complexity of system operation and proprietary rights, E2V is the only company that can provide this proprietary equipment.

The Government has invested over $284,500.00 in the evaluation of these components to include testing and labor. In addition, the investment the program has made is estimated to be more than $3.9 million over a 3 year period. This investment would not be recovered through full and open competition.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

The has been conducting market research and design studies since the origination of the program in 2015. Extensive market research was conducted in an attempt to find other sources for the Modulator and Magnetron Systems that would meet the current design requirements, and providing confidence in system reliability and design maturity to minimize life cycle costs.

Market research was conducted via peer review, current known manufacturer capabilities, Requests for Information submitted to

FedBizOpps and internet research. To date there been no responses that meet the required specifications.

The proposed contract was synopsized on the Federal Business

Opportunities (FEDBIZOPPS) website on 08 March 2018 and only E2V expressed interest in this requirement. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than E2V to provide the required equipment.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, Dahlgren Contract

Department has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges, Dahlgren Contract Department will assess whether competition for future requirements is feasible.
