4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C.2304(C)(1), One Source or limited sources
5. Rationale Justifying Use of Cited Statutory Authority
Innoslate is a model based systems engineering tool that can model both behavioral and physical aspects of a system. It allows you to collaborate with your team, develop requirements, and create system models for all your projects on a secure network as a single solution that supports the entire systems engineering discipline. There is no need for plug-ins or multiple tools. Using Innoslate, NSWCDD teams can collaborate to work on the same project at the same time, manage requirements and analysis to modeling and simulation to verification and validation to operations and support and program management.
Many systems engineers use the Naval Systems Engineering Resource Center (NSERC) for collaboration and integrated data environment capabilities utilizing this software product. This procurement is also required to enable adequate protection of valuable Navy hardware assets. Without this software and maintenance, this network infrastructure supporting thousands of end users would be at risk for failure to operate as expected and business continuity of operations could be severely impacted. This product provides ease of use to manipulate data, metrics, and reports, in comprehensive views that would take days, weeks, or hours to produce manually. This provides a cost savings for its collaborative use because it saves travel and for its automation abilities thus saving time and reducing errors that come from manual methods. Utilizing another brand product would result in an estimated in duplicated costs and in excess of 12 months to train, certify and deploy a new system. In addition, a patent, copy right or proprietary data limits competition. SPEC Innovations is the original software publisher for this proprietary software with no authorized resellers available, therefore, proprietary data limits competition.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
Market Research was conducted and concluded that other company’s similar products cannot meet the needs of the agency. Additional market research performed through internet searches and through direct contact with the software publisher has verified that there are no authorized resellers for this proprietary software and support.
Pursuant to FAR 5.201, Sources Sought Notice was posted on 03 October 2017 and no inquiries were received. The Combined Synopsis/Solicitation was posted on Federal Business Opportunities (FedBizOpps) website on 13 October 2017 to notify the public that a sole sourced FFP will be established for the acquisition of the Innoslate Software. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than SPEC Innovations to provide the required software and support.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the software and support covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, Dahlgren Contract Department has no plans at this time to compete future contracts for the type of software and support covered by this document.
If another potential source emerges, Dahlgren Contract Department will assess whether competition for future requirements is feasible.
