4. . Statutory Authority Permitting Other Than Full and Open Competition
10 U .S .C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority
Annapolis Micro Systems (AMS) is the Original Equipment
Manufacturer (OEM) of the Ultra-Wideband (UWB) Recorder procured by the Naval Cyber Warfare Development Group for use with the program . The UWB recorder is an integral part of a National Security system , designed to meet and satisfy Fleet specific miss ion requirements.
Annapolis Micro Systems developed and manu factured the circuit card assemblies listed above for use in the UWB recorder. The AMS circuit card assemblies are currently used in the UWB Recorder
(part number RD-500), as part of the systems supported by CDSA DN . The AMS circuit card assemblies will be consumed as spare parts that are currently used in fielded UWB recorders supported by CDSA DN
The spare circuit card assemblies must be compatible in all aspects to the existing AMS circuit cards used in the existing UWB recorders to ensure valid form, fit and functionality as direct spare replacements during extended deployments or in the support of Fleet Casualty Reports
(CASREPs). Use of another vendor’s product, assuming a qualified vendor can be found, would require unbudgeted and unanticipated system integration , operabil ity, functionality , and form fit re-design and testing .
6. Description of Efforts Made to Solicit Offers from as Many
Offerors as Practicable
The CDSA engineers conducted market research previously via the internet, published trade journals and catalogs of three major
RF Recorder manufacturers with no comparable UWB RF Recorder
DL : 13758
models found to meet mission requirements. The selection of an alternate other than the AMS UWB RF Recorder would not meet specific mission requirements while maintaining the interoperability, functionality, compatibility and form factor with the current Systems held in inventory and deployed units. Market research has also shown that a patent, copy right or proprietary data limits competition.
Annapolis Micro Systems, Inc. as the original equipment manufacturer continues to have no authorized resellers available for these proprietary components.
A Sources Sought Notice was posted on the Federal Business
Opportunitie s (FEDBIZOPPS) website on 14 August 2017 and there were no vendor’sthat expressed an interest in this requirement.
The proposed contract will be synopsized on the Federal Business
Opportunities (FEDBIZOPPS) on 5 September 2017.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the software and support covered by the
J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, Dahlgren Contract
Division has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges, Dahlgren Contract Division will assess whether competition for future requirements is feasible.
