JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Division.

2. Description of the Action Being Approved

This justification establishes an indefinite delivery indefinite quantity (IDIQ) contract to BAE Systems, 164 Totowa Road, Wayne, NJ

07474. This is the final contract and it is critical due to a risk reduction prototype system in support of the Carrier Based Tactical

Support Center (CV TSC) program using prototype hardware being installed at Naval Station, Point Loma, CA. This system will be using hardware from the Software Compliant Architecture (SCA) Common Data

Link (CDL) family. Availability of support from vendor is critical to the performance of time-sensitive testing. Support to include hardware, software, performance enhancements, and maintenance in a timely manner is imperative to the success of this program.

This requirement is a follow-on to contract N00178-13-D-3003 with BAE

Systems Information and Electronics. This is a Performance-Based acquisition. Performance will be formally assessed through the use of

Quality Assurance Surveillance Plan (QASP).

3. Description of Supplies/Services

The proposed procurement is for the acquisition of BAE SCA CDL products to fulfill NSWCDD’s mission to support the Office of Naval

Research (ONR) High Throughput Networking Infrastructure (HTNI) program. NSWCDD currently owns twenty-five (25) assets in the BAE

SCA CDL family, worth $1.2M.

This IDIQ is critical for the successful system installation at the

Surface Airborne Interoperability Laboratory at Naval Air Station, Patuxent River, MD, which will be using hardware from the BAE SCA

CDL family. Support in a timely manner is crucial to the success of the program. An IDIQ contract issued to BAE will allow a flexible and timely approach by providing an immediate solution to satisfy

NSWCDD’s requirement.

Although ceilings are not established for individual Delivery

Orders, the following projected costs are expected based on the equipment to be supported.

The estimated dollar value of this contract is $8,999,109. RDT&E funding will be utilized for this requirement. The table below provides a breakdown of the funding:

YEAR 1 YEAR 2 YEAR 3 YEAR 4 YEAR 5 TOTAL

LABOR

ODC/TRAVEL

TOTAL COST 8,999,109

4. Statutory Authority Permitting Other Than Full and Open

Competition

10 U.S.C. 2304 (c) (1), as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority

Full and open competition is not possible for this contract, as the equipment to be procured is required to meet the Government’s minimum requirements for a system that is compatible with the BAE

SCA CDL family of products. Transition to another product line would be cost prohibitive for the reacquisition of replacement assets, retraining of personnel, and reintegration into existing HTNI systems, and is not possible as there are no other products meeting

HTNI system requirements.

The issuance of an IDIQ will provide a mechanism to procure BAE SCA

CDL products which will enable performance of time-sensitive testing that is critical to NSWCDD’s mission needs.

Delivery and Task orders under this IDIQ will be awarded on a non-competitive basis under FAR 6.302-1(a) (2) (ii) (A), since only one responsible source can satisfy the requirements.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

Pursuant to FAR 5.201, a notice was synopsized in the Federal

Business Opportunities (FEDBIZOPPS) website on 10 July 2015, notifying the public that a sole source IDIQ will be established to allow recurring requirements for the acquisition of BAE SCA CDL products. Market research was not conducted as previous procurements warrant that BAE Systems manufactures the BAE SCA CDL family of products and is the only known source capable of performing the requirement.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the supplies and services covered by this

J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

NSWCDD has no plans at this time for future contracts of this type, as the HTNI program is scheduled to be completed at the end of FY

2021, however, the HTNI program has had a transition agreement signed that will likely extend the program or cause a follow-on program to cover the timeframe anticipated for this IDIQ. If a future requirement should arise, a reappraisal will take place to determine whether competition is feasible.
