UNITED STATES MARINE CORPS PROGRAM EXECUTIVE OFFICER

Land Systems Marine Corps

2200 LESTER STREET

QUANTICO, VIRGINIA 22134-6050

IN REPLY REFER TO:

CT 028 PM AAA

J&A No. 19,169

JUSTIFICATION AND APPROVAL (J&A)

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity

Marine Corps Systems Command

2200 Lester Street

Quantico, VA 22134

2. Description of the Action Being Approved

The use of other than full and open competition to award a sole source, Firm-Fixed Price (FFP) bridge modification to extend the current period of performance of the Program Manager Advanced

Amphibious Assault (PM AAA) support contract N00178-14-D-7687

Task Order MU62 (the “Contract”) with Davis Defense Group (DDG), 475 Aquia Towne Center, Suite 401, Stafford, VA 22554 for a period of 180 days. In accordance with NMCARS 5206.303-1(S-

90)(a), request for authorization of a bridge contract, #19,168, was approved prior to executing this J&A.

3. Description of Supplies/Services

The proposed contract action is to procure non-personal services in support of Program Executive Officer Land Systems PM AAA by awarding a bridge modification to extend the current support contract for 180 days. The bridge modification will extend the contract period of performance to allow for continued services that are required to successfully manage and execute tasks associated with programs assigned to PM AAA. The current contractor assists in developing tailored analyses and conducts structured reviews of Government and Prime System Contractor data, develops and maintains acquisition management tools and data bases, facilitates the development and completion of specified acquisition documents, provides administration support, conducts engineering analysis, reviews Engineering

Change Proposals (ECPs), develops logistics support plans and processes, witnesses testing to verify compliance with requirements, and witnesses vehicle manufacturing to verify compliance with manufacturing and quality processes.

The contract effort supports the Assault Amphibious Vehicle

(AAV) Sustainment efforts which include life cycle support

J&A No. 19,169 management for the AAVs with a focus on retaining or improving the aging vehicles. The AAV program is responsible for extending the life of the AAVs and addressing safety concerns and vehicle limitations through ECP modifications. These activities continue to be critical for the program despite the recent Marine Requirements Oversight Council’s decision to divest of the Assault Amphibious Vehicle Survivability Upgrade program. As a result, PM AAA must continue to maintain the nearly 50 year old AAVs currently in the fleet since the

Amphibious Combat Vehicle (ACV) will not be available to replace them for several more years.

The contract effort also supports the ACV program which is currently in the Low Rate Initial Production (LRIP) phase.

During this phase the program will support critical activities such as Full-Up System Live Fire and Initial Operational Test and Evaluation, and other discrete test events. In accordance with the Assistant Secretary of the Navy Research, Development, and Acquisition, Decision Memorandum, dated 8 January 2019, PM

AAA is continuing the development of the ACV Mission Role

Variants (i.e., ACV-C (Command), ACV-30 (30mm), ACV-R

(Recovery)) to provide them as part of the original ACV Full

Rate Production Decision. These ACVs, along with the Personnel

Variant, will form the ACV Family of Vehicles.

If the bridge modification were not awarded PM AAA would be hampered in their ability to continue the requirements referenced herein, which would then negatively affect fielding in 2020 of the ACV, causing cascading schedule breaches which could also increase costs to the ACV program. Further, as previously discussed, delay of these activities would impact the ability to sustain the AAVs until the ACV is fielded. Continued support is essential to PM AAA’s ability to meet the warfighter’s mission.

The estimated value of this modification is . FY18

Research, Development, Test and Development (RDT&E) funding will be used to fund this interim period.

Funding Type FY18

RDT&E

Performance will begin upon contract bridge award on 20 March

2019 for continuing Program Office engineering, technical, logistical, acquisition and business and financial management support. All deliverables made under this extension will be complete no later than 19 September 2019.

4. Statutory Authority Permitting Other Than Full and Open

Competition

The statutory authority permitting use of other than full and open competition is 10 U.S.C. § 2304(c)(1) as implemented by the

Federal Acquisition Regulation (FAR) 6.302-1, “Only One

Responsible Source and No Other Supplies or Services Will

Satisfy Agency Requirements.”

5. Rationale Justifying Use of Cited Statutory Authority

This bridge modification is necessary to prevent unacceptable delays or service gaps in fulfilling the PM AAA requirements, and allow time to competitively award a new contract. Source selection activities are ongoing but have taken longer than originally scheduled to complete. A gap in support would negatively affect the cost and schedule for the AAA programs.

The bridge modification is a limited term follow-on contract for the continued provision of highly specialized services. It is highly likely that an award to any other source for the 180-day extension would result unacceptable delays (e.g., time and resources required to train a new staff, transition of all PM

AAA documentation, obtaining personnel clearances, the badging process and issuance of computer assets to perform the work on the Government network) in fulfilling PM AAA’s mission as described in Section 3 above.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable Sources

The original task order was competitively awarded on 20 March

2015 by Marine Corps Systems Command utilizing the SeaPort

Multiple Award Contract. This effort will be a modification for a 180-day extension of that award.

The follow-on contract is still being competitively awarded and is currently in process. Market Research was conducted for the follow-on contract by issuing a Request for Information (RFI) under RFI number M67854-17-R-0262 on FedBizOpps on 9 August 2017 and a subsequent Industry day event was held for interested parties on 18 April 2018 for the follow-on effort to this contract. Based on the market research, the Contracting Officer concluded that the follow on contract could be competed.

7. Determination of Fair and Reasonable Cost

The Contracting Officer will determine the cost of the services covered by this J&A will be fair and reasonable based on previous competition and historical prices paid.

8. Actions to Remove Barriers to Future Competition

A follow-on requirement is in the process of being competed as a total small business set aside under SeaPort's Zone 2, the

National Capital Region.
