FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Contracts Division (NSWCDD) .
2. Description of the Action Being Approved
Award of an indefinite delivery, indefinite quantity contract with issuance of firm-fixed-price and cost-plus-fixed-fee completion type delivery orders for a period of performance of sixty (60) months on a sole source basis to Applied Systems Engineering Incorporated (ASEI), 1480 Hickory Street, Suite 106, Niceville, Florida 32578.
3. Description of Supplies/Services
The proposed contract will provide failure analysis and repair of damaged Advanced Tactical Navigator (ATACNAV) receivers as necessary and allow for current ATACNAV receivers to be upgraded and delivered with Selective Anti Spoofing Module (SAASM) and High Accuracy (HA) capabilities.
Additional tasking includes training sessions on ATACNAV receivers during testing and integration events as required.
The total estimated value of this effort is $4,005,100 and will utilize funds as indicated below:
Type FY13 FY14 FYlS FY16 FY17 Totals
PROC $400,000 $601,275 $1,001,275 $1,001,275 $1,001,275 $4,005,100
The Government's minimum needs have been verified by the certifying technical and requirements personnel.
J&A Number:
4. Statutory Authority Permitting Other Than Full and Open Competition
13142
10 U.S.C. 2304(c) (1), as implemented by FAR 6.302-1 (a) (2) satisfying a requirement for unique services and supplies available from only one source.
5. Rationale Justifying Use of Cited Statutory Authority
The BMS program currently utilizes and fields the capabilities of the ATACNAV receivers to retrieve position, velocity, and altitude of the fixed and rotary wing aircraft platforms. The current requirement is to upgrade and deliver Government owned ATACNAVs with SAASM and HA capabilities and to provide failure analysis and repair of damaged ATACNAVs as required.
Analysis of the degraded GPS mode resulted in a requirement for the HA capability for some of the G32 and G34 BMS programs. The SAASM capability completely ensures that the ATACNAV is transmitting the position, velocity, and altitude to the particular BMS platform. The SAASM requirement is the minimum requirement needed and is required on all future GPS receiver systems that the military uses in theater as mandated by the Chairman of the Joint Chiefs of Staff Instruction (CJCSI) 6130.01C dated 31 March 2003.
The current BMS program design transmits information through the ATACNAV, which has already had extensive design and design reviews to become a tested, fielded, and functional mass-produced system. All software, hardware, network configuration, and mechanical design has been designed, tested, and finalized by NSWCDD engineers, BMS program management, and BMS sponsors.
ASEI is the sole manufacturer of the ATACNAV receivers.
There are no other manufacturers of GPS receivers that have the current form/fit/function or mechanical design footprint of the current BMS program design. Efforts for integrating the ATACNAV into the BMS configuration have been ongoing for approximately three years. It would take a minimum of another three years to develop the technology and train another source to meet the current BMS program design. This would result in detrimental schedule delays, as well as a full redesign of BMS programs that are already in the field and being used by the warfighter. Awarding this effort to another
J&A Number: 13142 contractor would result in substantial duplication of cost which is not expected to be recovered through competition as it would require extensive redevelopment of the fire control system configuration (approximately $4.4 million) and redevelopment of the SAASM and HA configurations that ASEI has already developed (approximately $2.2 million).
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
This proposed contract was synopsized on the Federal Business Opportunities website on 23 October 2012 with no responses.
No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than ASEI to provide the required items.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the supplies covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, NSWCDD has no plans at this time to compete future contracts for the items covered by this document. If another potential source emerges, NSWCDD will assess whether competition for future requirements is feasible.
