6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Pursuant to FAR 5.202(a)(2), this action will not be synopsized at the

Government point of entry, Beta.Sam.Gov.

In 13 March 2019, a Sources Sought was posted on Federal Business

Opportunities (FEDBIZOPPS) to identify other potential offerors who could support the BMS requirement. Two capability statement responses were received, from Applied Systems Engineering, Inc. (ASEI), 1480

Hickory Street, Suite 106, Niceville, FL 32578-9780, and from CyQuest

Business Solutions, Inc., 1005 Virginia Avenue, Suite 230, Atlanta, GA

30354. Both capability statements were forwarded to the Technical

Point of Contact (TPOC) for evaluation. The evaluation was completed on 1 May 2019 and concluded CyQuest did not provide information

, and only provided logistics and business administration capabilities. Based on the

TPOC’s review, CyQuest was determined not to be a viable candidate and therefore ineligible to participate in the requirement. Notification of this determination was sent in writing to CyQuest Business Solutions on 14 May 2019.

ASEI has been producing the ATACNAV and its predecessor units for various DoD systems since 1993. There are no other manufacturers of having the current form/fit/function or capabilities with the mechanical design footprint of the current BMS program design.

ASEI currently has the proprietary rights of the firmware being used on the fielded units already in use in the fleet, therefore the effort is inherently noncompetitive. Market research has not yielded any other providers that could support the BMS requirement, due to high cost, high risk, or inability to provide the custom development of to meet BMS requirements.

An award of this requirement to another contractor would cost BMS programs an estimated additional $28M after redevelopment cost and replacement of currently fielded units in the fleet. Additionally, it would cause each BMS project to fall critically behind schedule across each of the fleets, and it would take an estimated six (6) years to redevelop the system.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government of the services covered by this J&A is fair and reasonable.

8. Actions to Remove Barriers to Competition

The Naval Surface Warfare Center, Dahlgren Division has no plans at this time to compete this requirement in the future due to the proprietary nature of the effort. NSWCDD did not purchase the rights to the proprietary firmware required to foster competition. ASEI is the sole manufacturer of the ATACNAV. ASEI does not have any authorized resellers and is the only authorized organization to perform repairs and upgrades to current ATACNAV systems. There are no other manufacturers of in existence having the current form/fit/function or capabilities with the mechanical design footprint of the current BMS program design. Moreover, ASEI has the proprietary rights of the firmware that is used on the fielded platforms.
