JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Indian Head Division (NSWC IHD), Contacts Code 026.
2. Description of the Action Being Approved
Award of a contract, on a sole source basis, to overhaul three 15-inch, 1070 tons extrusion presses, and one 15-in blocking press to:
Fulton Iron & Manufacturing, LLC 3844 Walsh Street St. Louis, MO 63116 Cage Code: 1QJG9
3. Description of Supplies/Services.
The 15-doublebase propellant manufacturing base currently used in production of 2.5-in and 5-in diameter propellant grains to support the Hydra-70 Rocket System, MK 85 RATO, MK 22 Rockets and MK 126 Rocket Motors. The presses have not had any significant refurbishment since their installation at NSWC IHD in 1948. The presses were manufactured by R.D. Wood Company and Watson-Stillman Company to design specifications written by A.B.
Farquhar Co. Fulton Iron & Manufacturing has now purchased all intellectual property from A.B. Farquhar for these presses.
Overhauling and upgrading these three presses is essential for to provide the capacity to support future production demand and surges.
The contractor will provide all support required for secure rigging necessary to crate, load, transport and overhaul three 15-inch, 1070 tons extrusion presses, and one 15-in blocking press located at NSWC Indian Head.
To further broaden market research and to satisfy the requirements of DFARS PGI 206.301-1(d), a Sources Sought notice was posted on SAM.gov website on 04/05/2024. The posting yielded two (2) results. Upon technical review of capability statements provided from vendors, one source was not able to meet the requirements outlined in the statement of work for the requirement, and the second respondent was the intended sole source contractor.
As required by FAR 5.203, a pre-solicitation noticed was publicized on the SAM.gov website on 05/01/2024. Zero (0) responses were received.
7. Determination of Fair and Reasonable Cost
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition
As the government continues to improve its facilities, should additional presses be required, at that time, there is the potential to look to new sources and buy new presses. If another potential source emerges at that time, a full and open competitive contract may be warranted. For the reasons set forth in Paragraph 5, NSWC IHD has no plans at this time to compete future contracts for press repair and overhaul services covered by this document.
