JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, NSWC Indian Head Explosive Ordnance Disposal Technology Division (NSWC IHEODTD), Contracts Department Code 02. This requirement is in support of the Systems Engineering Department.

2. Description of the Action Being Approved

Award of a sole source firm-fixed-price contract to Mocana Corporation for the purchase of a Security Software Library.

3. Description of Supplies/Services

NSWC IHEODTD has a requirement for a Security Software Library that can be used to provide program encryption on an embedded computer system. The software library is an encrypted application that will operate on a computer dedicated to that application exclusively.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open

Competition

41 U.S.C. § 1901 – a sole source acquisition under the authority of the test program for certain commercial items, as implemented by FAR Subpart 13.5.

5. Rationale Justifying Use of Cited Statutory Authority

The required Mocana security software is the only encryption software used in . The Mocana software was selected by the

, and currently is the only encryption software supported by the . All software upgrades must be compatible with this software.

NSWC IHEODTD provides a supporting role for software, BIT, Embedded Training, Firmware and Net-Enabled functionality for . No other alternative will meet the JCREW 3.3 requirement since Mocana is the only Real-Time encryption software supported by .

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

This requirement was synopsized on the Federal Business Opportunities (FEDBIZOPPS) website on 08 July 2014 and no other vendors expressed an interest in this requirement.

Northrop Grumman, Mocana Corporation is the only vendor who can provide compatible software.

7. Determination of Fair and Reasonable Costs

The Contracting Officer shall determine that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable in accordance with FAR Part 15.4.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraphs 5 and 6, NSWC IHEODTD has no plans at this time to compete future contracts for the types of supplies covered by this document. If another potential source emerges, NSWC IHEODTD will assess whether competition for future requirements is feasible.
