JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, NSWC Indian Head Explosive Ordnance Disposal Technology Division (NSWC IHEODTD), Contracts Department Code 02.

2. Description of the Action Being Approved

Award a one-year contract on a sole source basis for the procurement of MK 258 Mod 1 30mm x 173mm Armor-Piercing, Fin-Stabilized, Discarding-Sabot, Tracer (APFSDS-T) Cartridges to General Dynamics Ordnance/Tactical Systems

(GD-OTS),

3. Description of Supplies/Services

30mm x 173mm MK 258 Mod 1 APFSDS-T Cartridge

The MK 258 Mod 1 APFSDS-T Cartridge is one of the main 30mm x 173mm ammunition items used with the MK 46 Mod 2 Gun Weapon System (GWSJ on the U.S. Navy (USN)

Ships. This ammuQition is employed to combat surface targets with a hydro-ballistic tip, short time of flight, lethality of target, and narrow sabot discard pattern.

The Government has funding available for this contract in the amount of $12.452M and will procure an estimated production cartridges. This estimate is based on anticipated cartridge unit costs. The number of cartridges received may vary slightly to account for the actual unit cost. Delivery of the cartridges is anticipated to occur .bY

. The Government's minimum need~ have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open competition

The statutory authority cited for this sole source procurement is 10 U.S.C. 2304 (c) (1), "One source or limited sources" as implemented by Federal Acquisition Regulation ( E'AR) 6. 302-1 entitled, "Only one source and no other supplies or services will satisfy agency requirements."

5. Rationale Justifying Use of Cited Statutory Authority

The 30mm x 173mm MK 258 Mod 1 A~FSDS-T cartridge has only been built for test assets and GD-OTS is the only manufacturer with a qualified design that meets the hydro ballistic tip 1 high velocity, and narrow sabot discard capability requirements that will interface directly with the Navy's MK 46 GWS.

Prior market research showed that there was another interested vendor, Alliant Techsystems. (ATK), but ATK does not currently have a design that meets the Navy's requirements of hydro-ballistic tip and narrow sabot discard pattern. If ATK develops a design that meets all requirements, qualification of the design would take months and require to $ to procure test articles, perform qualification tests, and provide engineering support throughout the qualification. There is no guarantee that ATK would be able to meet the qualified MK 258 Mod 1 APFSDS T design requirements.

authority prior to award.

A full development program for 30mm x 173mm MK 258 Mod 1 APFSDS-T was also considered; however, development and qualification of a new design would take approximately years to complete. Based on current data from similar design efforts, the estimated cost from design through qua~ification would be to .

Consequently, GD-OTS is the only option available to meet the Navy's immediate need for 30mm MK 256 Mod 1 APFSDS-T anununit.ion.

6. Description of Efforts Made to Solicit Offers from as Manz Offerors as Practicable

The USN maintains active communication with members of the ammunition manufacturing industry. Based on meetings with company representatives, the USN has determined that there are no other qualified sources of supply that can meet all the Navy's requirements for the MK 258 Mod 1 cartridge of hydro-ballistic tip, narrow sabot discard pattern, high velocity, and lethality of target. Additionally, a sources sought notice was posted on 20 March 2014 to the Federal Business Opportunities website requesting responses from manufacturers of this cartridge. GD-OTS was the only vendor who responded to the 20 March 201q sources sought.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable.

Lesser quantities have been built by the offerer in the past as test assets to provide additional performance assessment, maturity prove-out, and to suppoit design and producibility enhancement efforts. Cost and pricing information was received on those fabrications. The Navy also procures ammunition with materials comparable to the MK 258 Mod 1, which will be used in determining reasonable material costs.

This information should allow the Government to determine whether the cost proposed is fair and reasonable.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5 1 NWSC IHEODTD Contracting Department, Code 022, has no plans at this time to compete future contracts for the types of

If another qualified vendor emerges, Nl'lSC IHEODTD Contracting Department 1 Code 022, will assess whether competition for future requirements is feasible. Additionally, the Navy may be able to leverage new development work at the Office of Naval Research to allow for competition on a similar ammunition type in future years.
