About this file

This document is a Questions and Answers (Q&A) for Solicitation N0017325RML01 for High Assurance Computer Systems Security services. The solicitation is a re-compete effort for the current contract N00173-21-F-2015 awarded to Arcfield, Inc. (formerly Peraton, Inc.).

The Q&A addresses questions related to Clause H-10 on Current and Pending Project and Proposal Submissions, which uses language typically associated with grants and research agreements rather than federal contracts. The Contract Specialist confirms that this clause is specifically related to National Security Presidential Memorandum 33 and cannot be changed, but implementation details will be discussed after award. The Q&A also confirms that the term "Principal Investigator" is synonymous with "Program Manager IV" labor category for this solicitation. Additionally, the Q&A clarifies the requirement for major subcontractors to provide information at the same level of detail as the prime contractor, as stated in Section L-7.

NRL High Assurance Computer Systems Security RFP N0017325RML01 Questions & Answers

Document/Section Section Contractor Question Contract Specialist Answer

Solicitation -

N0017325RML01

Section H, H-10 Current and Pending Project and Proposal Submissions, We are seeking clarification of Clause H-10—Current and Pending Project and Proposal Submissions. In reviewing the clause, we noticed it uses language like “Performer” and “Applicant,” which are traditionally used in grants, SBIRs, and research agreements and not in federal contracts of this nature.

In addition, the clause mentions a “Principal Investigator,” which is not a labor category in the current solicitation. While the clause references current and pending support, which would seem to be associated with OCI transparency, it does not explicitly reference OCI or other conflicts of interest. Further, the level of detail requested in the clause, particularly the requirement to provide comprehensive information on “all current and pending support for ongoing projects and proposals” requires approvals for disclosure and potential classification handling and storage coordination from government to government that is outside the control of a potential contractor. Is the intent of Clause H-10 specifically related to identifying and mitigating OCIs? If so, will the Government consider removing this clause or, in the alternative, modifying the clause so as to only apply to ongoing work at NRL and related contracts?

H-10 specifically relates to National Security Presidential Memorandum (NPSM) 33 and is applicable upon and post-award.

For purposes of this RFP and future award, Principal Investigator is synonymous to Program Manager IV. The language within this clause cannot be changed.

Implementation will be discussed after award, however, additional information can be found here:

Section L-7, Volume V, paragraph 2 (pg 58)

The new question, based on the Amendment and answers to questions, is as follows: The last sentence of Factor 7 states that "It is the responsibility of the Prime Contractor to ensure that ALL SUBCONTRACTORS provide information at this same level of detail regardless of the subcontract pricing arrangement." In light of Amendment 0001 requiring subcontractor proposals for only major subcontractors, will the Government confirm this sentence should now read, "It is the responsibility of the Prime Contractor to ensure that Major Subcontractors provide information at this same level of detail regardless of the subcontract pricing arrangement."

Confirmed. See Amendment 0002, page 58 of the RFP with updated language.
