4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION
10 U.S.C. 2304(g), “The property or services needed by the agency are available from only one responsible source or only from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency.” (FAR 13.106-1(b)(2))
5. RATIONALE FOR USE OF BRAND-NAME SUPPLIES/SERVICES
The training courses sought for NSWCCD’s requirement is for use of certain SolidWorks software that is proprietary software owned by Dassault Systemes:
MANUFACTURER:
Dassault Systemes’ HQ
175 Wyman Street, Waltham, MA.
(781) 810-3000
Because the SolidWorks software is proprietary software, Dassault Systemes provides a standard curriculum for each training course that NSWCCD seeks with its requirement. The standard curriculum for the desired training courses can be found at the link below:
https://www.solidworks.com/sw/support/805_ENU_HTML.htm
Additionally, Daasault Systemes manages the training courses for its products through the company’s Certified SolidWorks Resellers list. For companies to provide training for
SolidWorks software, such companies must be certified by Daasault Systemes.
NSWCCD Codes 60, 70, and 80 currently use the SolidWorks software products that is the subject of the requisite training courses to develop models, perform analysis, and to post-process and integrate NSWCCD’s solutions. Moreover, NSWCCD Codes 60, 70 and 80 engineers use a combination of network licenses of SolidWorks software to provide the capabilities required to perform these functions. Further, it’s important for NSWCCD to receive training for the
SolidWorks software that align to the topics and durations as defined by Dassault Systemes, given that Dassault Systemes is the original equipment manufacturer (OEM) of the software, and is intimately familiar with the features of its own software products
Therefore, in accordance with FAR 13.106-1(b)(2), the circumstances of this contract action deem only training courses for SolidWorks software that is provided by companies certified by
Dassault Systemes to be reasonably available for NSWCCD’s need.
6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY
OFFERORS AS PRACTICABLE
NSWCCD intends to issue a combined synopsis/solicitation pursuant to FAR 12.603, and the notice will be posted to the beta.SAM.gov website. The combined synopsis/solicitation is anticipated to be set aside for small businesses.
Additionally, NSWCCD conducted market research for the requisite training courses, and concluded that the brand name training courses are available in the commercial market place, but only through companies certified by Dassault Systemes to provide such training for the
SolidWorks software.
7. DETERMINATION OF FAIR AND REASONABLE COSTS
The Contracting Officer shall determine that the anticipated contract represents the best value (as defined in FAR 2.101), and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
8. ACTIONS TO REMOVE BARRIERS TO COMPTETION
https://www.solidworks.com/sw/support/805_ENU_HTML.htm
NSWCCD will likely have reason to solicit similar training courses in the future, once the anticipated contract that is the subject of this justifications expires. Because there are multiple companies identified as certified by Dassault Systemes to provide training courses for the
SolidWorks software, these companies may be considered in future solicitations. The circumstances surrounding the need to obtain the training courses on a brand name basis will be reviewed on a case-by-case basis by the Procuring Contracting Officer (PCO).
