SOLE SOURCE JUSTIFICATION FOR SIMPLIFIED ACQUISITIONS

Subj: SOLE SOURCE JUSTIFICATION (Acquisition of Micro Auto Gasification System Version 8 Upgrades)
1. DESCRIPTION OF REQUIRED SUPPLIES/SERVICES, ESTIMATED VALUE, AND
DELIVERY REQUIREMENTS
The Environmental Engineering, Science, and Technology Branch (Code 633) at Naval Surface Warfare Center, Carderock Division (NSWCCD) requires procurement of materials and services to upgrade the Micro Auto Gasification System Version 8 (MAGS VA) to the latest design that has improved operation and increased reliability. The estimated value is to be approximately
The recommended vendor, Terragon Environmental Technologies Inc. (the OEM), is to provide updated technical manuals, a set of updated drawings, spare parts kit, and materials and services to upgrade the MAGS V8 to the manufacturer’s latest design configuration. Completion date is required 45 days from the date of award.
2. SUPPORTING DOCUMENTATION FOR SOLE SOURCE BASED ON
CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION
Upgrading the MAGS V8 at NSWCCD will bring it in line with the Terragon Environmental Technologies Inc.’s (the OEM) latest design. The upgrades will improve operation and increase reliability of the system, aligning with Navy interest and justifying the continued evaluation of the Mags V8 as a candidate for shipboard application. The upgrade is not available from a commercial source other than Terragon Environmental Technologies Inc. because it is the proprietary owner of the technology and patents. Therefore, in accordance with FAR 6.302-1(b)(2), the agency’s minimum needs can only be satisfied by unique materials and services available from Terragon Environmental Technologies Inc.
3. MARKET SURVEY
A survey of the commercial market conducted by NSWCCD Code 633 did not identify other vendors that could upgrade the MAGS V8 to Terragon’s latest design due to the proprietary technology of the upgrade. The MAGS V8 was originally procured from Terragon under a competitive commercial SAP.
4. ADDITIONAL FACTS
Impact if upgrades are not completed – If the upgrades to the MAGS V8 located in the Thermal Destruction Test Facility (Building 63) are not completed, system testing will stop and the MAGS V8 will no longer be considered as a candidate to process solid waste materials on future Act to Prevent Pollution from Ships (APPS) complaint ships. This will negatively impact the Afloat Environmental Quality Program and needs of the Fleet.
