NSWCCD BWO

50 foot Workboat (50’WB) & Range Craft Barge (RCB)

Preservation, Inspection, Repair, and Maintenance (PIRM) Availability Statement of Work (SOW)

1. NSWCCD Detachment Puget Sound Bangor Waterfront Operations (BWO) owns and operates a 50’ WB and the RCB. Both vessels are critical infrastructure assets that directly support fleet requirements associated with the following evolutions:

a) The 50’ WB and RCB are vital for the deployment, recovery, and testing of various UUV's and ROV's the NAVY operates. Failure to perform a timely periodic availability on the two craft will have an immediate and negative impact on fleet readiness.

b) The 50’ WB and RCB are necessary to conduct on-water inspection and maintenance actions for various BWO marine assets that directly support the Research, Development, Test and Evaluation (RDT&E) mission. Additionally, the 50’ WB provides a means of propulsion and position keeping for the RCB when it is underway.

c) The Government will transit the 50’ WB and RCB to the contractor’s facility. When the 50’ WB and RCB are made up together, transit speeds are limited to 4 knots. The transit will occur during daylight hours (no more than 30 minutes prior to sunrise or 30 minutes past sunset). Based on these two constraints, the transit can take no more than 10 hours. Due to these restrictions, as well as crew commute time during the maintenance period, the contractor’s facility shall be located in geographic area highlighted by Figure 1.

Facilities outside of this range will not be considered.

Figure 1

d) The contractor facility must be able to complete the work described within 120 days ADC and the maintenance period shall take no more than 30 days.

2. The 50’ WB requires the following services:

a) Haul out the 50’ WB via marine lift, marine rail, or similar method.

b) Pressure wash and prepare the freeboard and underhull of the 50’ WB per the following specification:

a. Hand scrape or water blast to remove shell fouling.

b. High pressure water wash @3000psi to remove salt, etc.

c. SP-6 Spot blast all areas of corrosion and rust.

d. Sand sweep to ensure all existing antifouling is now a tight epoxy condition.

c) Conduct Non-Destructive Testing (NDT) below the waterline, in accordance with ABS guideline: Rules for Survey after Construction 2016 Edition Part 7; 7-4-1/1. The NDT report, CDRL A001, shall be provided within 48 hours of the completion of the test.

d) Prepare and paint the underhull per paint specifications and Dry Film Thicknesses (DFT):

For the underhull:

Spot Coat Bare steel overlapping 3 inches onto existing KHA303/414 Epoxy Red 5.0 mils DFT

Full Coat 2nd Coat (to build up system) KDA 302/414 Epoxy Gray 5.0 mils DFT

Full Coat Interspeed 6200 A/F Red 5.0 mils DFT

(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--

(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or

(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.

(b) The Offeror represents that--

(1) It is [ ] is not [ ] a corporation that has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability; and

(2) It is [ ] is not [ ] a corporation that was convicted of a felony criminal violation under a Federal law within the preceding 24 months.

(End of provision)

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (JAN 2017)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation.

Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.

Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. 52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

1.0 BASIS FOR AWARD

The Government intends to award a Firm-Fixed Price (FFP) order as a result of this solicitation in accordance with FAR Part 12 - Acquisition of Commercial Items, Part 13 - Simplified Acquisitions Procedures, and Part 15 - Contracting By Negotiation. Award will be made to the offer which is most advantageous to the Government utilizing a “Lowest Price, Technically Acceptable (LPTA)” evaluation process, taking in to consideration Factor 1 – Technical Acceptability, Factor 2 – Past Performance Acceptability, and Factor 3 – Price.

The Government intends to evaluate offers and award a contract/purchase order based on initial offers without holding discussions with offerors; therefore, the submitted offer/quotation should contain the offerors best terms from a technical and price standpoint. The Government may contact any or all offerors with questions concerning their responses as permitted under FAR 15.306 and reserves the right to conduct discussions if later determined to be necessary.

Selection of the contractor will be on an “acceptable” or “unacceptable” basis. Proposals are evaluated for acceptability but not ranked using the non-price factors. In order to be considered awardable, there must be an “acceptable” rating in every non-price factor. Receipt of an “Unacceptable” rating for Factor 1 or Factor 2 will result in an offer being assigned an overall rating of “Unacceptable”, rendering it ineligible for award. All offers/quotes shall contain sufficient information to allow the Government to perform an evaluation to determine acceptability. If insufficient information exists for the Government to be able to make a determination of acceptability, the offer/quote will be rated as “Unacceptable”.

As the award will be made on a LPTA-basis, no technical/price trade-offs will be considered and no additional credit will be given to offers/quotes exhibiting merits in excess of the qualifications of acceptability. The offer/quote determined to be technically and past performance acceptable and offering the lowest price will be selected for award in conformance with the requirements of the RFQ.

2.0 EVALUATION FACTORS

The following evaluation factors will be taken into consideration when selecting the LPTA offeror for award.

Factor 1 – Technical Acceptability. The technical portion of the submitted offer/quote shall clearly demonstrate to the Government that the offeror is capable of fully performing all requirements identified in Section C of the RFQ. The proposal will be evaluated for completeness and accuracy of information, and if the proposal addresses each specific area of the SOW. A signed copy of the SF 1449, or as authorized in FAR 52.212-1 - Instructions to Offerors, constitutes that the offeror’s intended approach will meet all requirements of the solicitation. The following rating table will be utilized in making the determination of Technical Acceptability.

TECHNICAL ACCEPTABILITY RATING TABLE

Rating Description

Acceptable The offer/quote clearly demonstrates that the offeror is capable of performing the effort detailed in the SOW.

The offer/quote meets all requirements as identified in the RFQ. The offer/quote demonstrates an adequate understanding of the required support services. A reasonable expectation of successful performance exists.

Unacceptable

The offer/quote does not clearly demonstrate that the offeror possesses the necessary capabilities to perform the effort detailed in the SOW. The offer/quote does not meet all requirements as identified in the RFQ. The offer/quote fails to demonstrate an adequate understanding of the required support services. A reasonable expectation of successful performance may not exist.

Offers/quotes found to be “Technically Acceptable” will continue to be evaluated for award. No further evaluation of offers/quotes found to be “Technically Unacceptable” will be performed.

Factor 2 – Past Performance Acceptability. Evaluation of past performance as it relates to the SOW requirements will be performed by the Government in determining the successful offeror. Past performance information will be used to evaluate the offeror’s actions under previously awarded contracts/orders. Reference information will be used to determine the extent to which an offeror is currently, or has previously within the past five years, performed work similar or related to the scope of work for this solicitation. Review of past performance information may include the offeror’s record of:

(1) Conforming to specifications and standards of good workmanship;

(2) Commitment to customer satisfaction and business-like concern for interests of the customer.

The Government may contact the provided references to ask whether or not they believe:

(1) That the offeror is capable, efficient and effective;

(2) That the offeror’s performance conformed to the terms and conditions of its contract;

(3) That the offeror was committed to customer satisfaction.

Additionally they may ask if given a chance would they select the same or a different contractor and/or other questions related to the offeror’s ability in the areas identified for this factor.

In addition to the past performance reference information provided by the offeror, the Government reserves the right to utilize information obtained from other sources in conducting the Past Performance evaluation.

Such sources may include, but are not limited to, the Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), and Electronic Subcontract Reporting System (eSRS).

The Government will consider the relevance of past performance information obtained in relation to the scope of this procurement. Past performance, either positive or negative, which is considered by the Government to be more closely related to the scope of this effort, will be given greater weight in determining offerors Past Performance Acceptability/Unacceptability. The following rating table will be utilized in making the determination of Past Performance Acceptability.

PAST PERFORMANCE ACCEPTABILITY RATING TABLE

Rating Description

Acceptable

The offeror’s past performance information demonstrates that the offeror possesses adequate understanding and experience performing the same or highly similar work to that required by the subject solicitation.

Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the performance record is unknown/neutral.

Unacceptable

The offeror’s past performance information does not demonstrate that the offeror possesses adequate understanding and experience performing the same or highly similar work to that required by the subject solicitation. Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort. Does not include instances where the offeror’s past performance is determined to be unknown/neutral.

In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have “unknown/neutral” past performance. In the context of acceptability/unacceptability, “unknown/neutral” shall be considered “acceptable”.

Factor 3 – Price. Offers/quotes shall contain pricing for all priced line items identified in Section B of the RFQ. Failure to submit a price for any such line items may result in the offer/quote being rejected as unacceptable. Pricing will be reviewed for the following:

(a) Completeness. All pricing information required by the solicitation has been provided, all mathematic computations are correct and the pricing application understood, prices are on an “all or none” basis, and failure to submit a price on an item or a number of items may cause this factor and the entire offer to be determined unacceptable.

(b) Reasonableness. Price analysis comparisons indicate the offered price to be fair and reasonable. No award will be made at other than a fair and reasonable price.

Offerors responding to this solicitation are advised that, prior to award, the government may request offers to submit information/data to support price reasonableness such as copies of paid invoices for the same or similar items, sales history for the same or similar items, price list with effective date and/or copies of catalog pages along with any applicable discounts. Failure to submit the requested information may result in the offeror being determined as non-responsive.
