About this file
This is a Justification and Approval (J&A) for use of other than full and open competition for a sole source contract award.
Naval Surface Warfare Center, Crane Division seeks to award a firm-fixed price contract to Torrent Photonics, located at 8060 Bryan Dairy Road, Largo, Florida 33777, for ninety-six (96) 30mm Sight Alignment Tool Kit Bullseye Reticle units (30mm Boresights). The boresights will support the United States Marine Corps' Amphibious Combat Vehicle 30mm (ACV-30) program, led by the Program Manager for Advanced Amphibious Assault (PM-AAA). The primary function of each boresight is to align the 30mm MK44 stretched cannon with the turret's electro-optical reticle. These components will be integrated into each produced ACV-30 with designated storage space. The procurement is classified as a one-time buy under Procurement, Marine Corps (PMS) funding.
Torrent Photonics is the Original Equipment Manufacturer and sole source capable of providing the boresight that has been tested and validated for the ACV-30. The J&A justifies sole source procurement under 41 U.S.C. 1901 (Simplified Acquisition Procedures), citing that qualifying an alternative boresight would require extensive engineering analysis including Finite Element Analysis and Failure Mode and Effects Analysis, with estimated costs exceeding the procurement value, plus schedule delays and additional costs for vehicle redesign, manual updates, and training curriculum modifications. Market research confirmed other companies offer similar items, but none can assure equivalent form, fit, and function without prohibitively expensive testing. NSWC Crane has no current plans to compete future contracts for this supply type unless another potential source emerges.

JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Surface Warfare Center, Crane Division (NSWC Crane), Code 0253.
2. Description of the Action Being Approved.
The use of other than full and open competition to award a firm-fixed price contract on a sole source basis to Torrent Photonics, 8060 Bryan Dairy Rd, Largo, Florida 33777 for a quantity of ninety-six (96), 30mm Sight Alignment Tool Kit Bullseye Reticle (30mm Boresight) in support of the United States Marine Corps’ (USMC) Amphibious Combat Vehicle 30mm (ACV-30) led by the Program Manager for Advanced Amphibious Assault (PM-AAA).
3. Description of Supplies/Services.
The Government's requirement is to procure ninety-six (96), 30mm Boresights to support the fielding of PM-AAA ACV-30 Program. The primary function of the 30mm Boresight is to align 30mm MK44 stretched cannon with the turret’s electro-optical reticle. These assets will be on board each ACV-30 that is produced and have an allocated storage space designed into the ACV- 30 Platform. The funding type is Procurement, Marine Corps (PMS) totaling for a one-time buy of ninety-six (96) 30mm Boresight.
4. Statutory Authority Permitting Other Than Full and Open Competition.
41 U.S.C 1901, Simplified Acquisition Procedures.
5. Rationale Justifying Use of Cited Statutory Authority.
Torrent Photonics is the Original Equipment Manufacturer (OEM) and the only source capable of providing the 30mm Boresight that has been incorporated into the ACV-30. The ACV-30 is a 30mm cannon-armed variant of the US Marine Corps' (USMC) 8x8 ACV and is engineered for high survivability and amphibious, over-the-horizon operations.
The Torrent Photonics Boresight was tested and validated for the ACV-30 during the Roadside Improvised Explosive Device Blast Testing that destroyed ACV-30 (test asset Number 302.) It should not be expected to destroy another ACV-30 test asset to prove out a different boresight, but it would require at the minimum a comparative analysis of the boresights. This will require engineering comparison study that will include at a minimum Finite Element Analysis and Failure Mode and Effects Analysis. The estimated cost for this study would be roughly and a program delay of . Any Government-initiated delay to the prime contractor’s production line could surpass the roughly estimate for ninety-six (96)

Boresight.
The change will also require the ACV-30 to allocate a different space upon the ACV-30 as Torrent Photonics utilizes a round storage case compared to all others that use a square or rectangular type storage case. The cost of having the Prime Contractor redesign a new storage location in the ACV-30 would cost approximately . This may only have a minimal schedule slip as this could be done concurrently, but any slip of the production schedule would be the fault of the Government due to procurement of a different Boresight. Additionally, it is estimated that the cost for Government administration and oversight for this change would add approximately in additional cost.
Other associated costs would be the ACV-30 user/operator manuals and training curriculum. The estimate to change the ACV-30 user /operator manuals is estimated at in total. A quick breakdown of the estimated cost of is as follows; to make the changes to the manual, for in-house review and to test out the changes with USMC personal (travel, documentation etc.).
The last change would be to the training curriculum, estimated cost to implement is .
The breakdown would be as follows; to make the changes, for in-house reviews, and another to implement all curriculum physical assets.
The total estimated cost of the changes would be at a minimum of and a delay which will have additional cost due to delaying a Production Contract for the ACV-
30. The list of known changes above does not encompass all the issues that would be involved with going with another boresight. Other issues not identified above will arise and cannot be foreseen and none of the costs would be recouped via competition.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Market research has been conducted, and other companies offer similar items to the Torrent Photonics Boresight. Minor technical reviews were completed and while some of the boresights can meet the same aspect as the 30mm Boresight from Torrent Photonics, there is no way to assure the other Boresights would meet form, fit and function as the 30mm Boresight from Torrent Photonics without conducting the testing identified in paragraph five (5) above.
This action will utilize a combined synopsis/solicitation in accordance with FAR 12.202(b) and therefore will not have a standalone sysnopsis.
7. Determination of Fair and Reasonable Cost
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NSWC Crane has no plans at this time to compete future contracts for the types of supplies covered by this document. If another potential source emerges, NSWC Crane will assess whether competition for future requirements is feasible.
