About this file
This Class Justification and Approval (CJ&A) document supports the establishment of a five-year Basic Ordering Agreement (BOA) with BAE Systems Information and Electronics for $22,450,000. The BOA covers two primary programs: the Maritime Patrol and Reconnaissance Aircraft (MPRA) Mission Crew Workstation (MCW) and the Persistent Maritime Unmanned Aircraft (PMUAS) AN/DPX-7 Identification Friend or Foe (IFF) Reduced Size Transponder (RST).
The agreement will support engineering services, repairs, spares, and system upgrades for the MCW and Combat System Mission Control Workstation (CS-MCW) for P-8A aircraft, including sub-assemblies like the Combat System Display Processor and Power Supply Unit. For the PMUAS program, the BOA will support technical data, repairs, and establishing an organic repair depot for the AN/DPX-7 IFF RST used on MQ-4C Triton aircraft. The contract is sole-sourced to BAE due to their unique technical capabilities and is justified under 10 U.S.C. 2304(c)(1), with the authority to act expiring on 13 December 2028.

CJ&A No. CR-23037
CLASS JUSTIFICATION AND APPROVAL (CJ&A)
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Crane Division (NSWC-CR), Expeditionary Contracts Branch (0233).
2. Description of the Action Being Approved
Establishment of a five year Basic Ordering Agreement (BOA) on a sole source basis in the amount of $22,450,000 to BAE Systems Information and Electronics, 450 Pulaski Road, Greenlawn, New York 11740, in support of the PMA-290 Maritime Patrol and Reconnaissance Aircraft (MPRA) Mission Crew Workstation (MCW), Combat System Mission Control Workstation (CS-MCW), CS- MCW sub-assemblies Combat System Display Processor (CSDP) and Combat System MCW Power Supply Unit (CS-MCW PSU), and PMA-262 Persistent Maritime Unmanned Aircraft (PMUAS) AN/DPX-7 Identification Friend or Foe (IFF) Reduced Size Transponder (RST) requirements.
Authority to act under this class justification expires on 13 December 2028.
3. Description of Supplies/Services
The MPRA and PMUAS programs provide the Warfighter with the latest state-of-the-art Special Missions Equipment (SME). The resultant BOA will be in support of all program phases of the MCW and for the procurement and support of the CS-MCW and following CS-MCW sub-assemblies: CSDP and CS-MCW PSU. Support tasks will include engineering to overcome obsolescence issues, incorporation of developmental upgrades and software patches, integration, installation, testing, training, fielded-systems engineering support services, repairs, spares, and sustainment of MPRA MCW and CS-MCW systems. The MPRA MCW and CS-MCW are maintained in a sustainment/readiness posture sufficient to meet Chief of Naval Operations force requirements.
The resultant BOA will be in support of PMUAS acquiring all necessary technical data, spares, repairs, engineering services, drawings, schematics, Special Test Equipment (STE), and training supporting the activation and sustainment of the Organic Repair Depot at a Government designated location for the AN/DPX-7 IFF RST.

required to support and maintain the MCW for the P-8A platform, and therefore, the original contract was not competed. The P-8A Increment 3 Key Performance Parameters (KPP) created a requirement for a CS-MCW capable of interfacing with Combat Systems Hardware on three P-8A platform variations. As of 31 October 2022, BAE, in Greenlawn, New York, is unwilling to sell a production level technical data package (TDP) for the CS-MCW systems. Given the complexity of the CS-MCW, only the Original Equipment Manufacturer (OEM) BAE possesses the required skills, software documentation, test fixtures and stations, quality and performance acceptance test procedures experience, and data necessary to directly manufacture and perform the required engineering support and repair actions.
If another system were procured, the cost to re-tool the line, reverse engineer, generate acceptance test procedures, perform first article testing, acquire flight certification, perform electrical load analysis and stress analysis, and revise publications and documentation for part number changes to master drawing package would exceed $18.9 million. This estimate is based on three P-8A platform variations.
NAVAIR estimates, based on the time it took BAE to do work under the original contract, that it would take at least five (5) years for an alternate source to design, develop, build, test, and certify another source’s CS-MCW for operational flight status. This would result in unacceptable delays and failure to meet MPRA P-8A Increment 3 KPP requirements referenced above by 2027 timeframe. Each platform variation of P-8A currently has a total of six MCWs installed. To meet KPP requirements, each P-8A requires the replacement of quantity two MCWs with quantity two CS-MCWs. MPRA must meet KPP requirements within the next 5 years for their entire fleet of P- 8A aircraft. BAE is the only vender that will be able to produce CS-MCWs to meet the MPRA installation deadline stated above and any competitive procurement would result in unacceptable delays in fulfilling the PMA-290 requirements.
The current PMUAS AN/DPX-7 IFF RST (P/N: 8449385-3) used on all MQ-4C Triton aircraft will require a capability upgrade due to recent Federal Aviation Administration (FAA) requirement changes. The FAA FY-2025 mandate of IFF RST Global Positioning System (GPS) capability will require a change to the AN/DPX-7 IFF RST (P/N: 8449385-6). Given the complexity of the AN/DPX-7 IFF RST, only the OEM BAE possesses the required skills, software documentation, test fixtures/stations, quality/performance acceptance test procedures experience, and data necessary to directly manufacture and perform the needed engineering support for establishment of organic depot capability in this timeframe. This depot capability is required due to the AN/DPX-7 IFF RST being a congressionally deemed Title 10 U.S.C. 2460 “Core” logistics item. BAE is unwilling to sell a production level TDP for the AN/DPX-7 IFF RST essential to develop organic depot capability. It took PMA-262 with the support of BAE over three years to set-up current AN/DPX-7 IFF RST (P/N: 8449385-3) organic depot capability. BAE is the only vendor that will be able to meet PMUAS FY-2025 AN/DPX-7 IFF RST (P/N: 8449385-6) organic depot capability support requirements.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
A request for information (RFI) announcement was posted to the Government Point of Entry, SAM.gov website, on 09 November 2022. The RFI/sources sought closed on 30 November 2022 with no responses received. The proposed contract was synopsized on the SAM.gov website on 06 December 2022. To date, no other potential sources have expressed an interest in this requirement.
Each Job Order issued under the BOA will be synopsized on the SAM.gov website. Any responses received will be considered.
7. Determination of Fair and Reasonable Cost
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this CJ&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, NSWC-CR has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWC-CR will assess whether competition for future requirements is feasible. As this is a follow-on for supplies and services previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a)(S-70)(i), the prior CJ&A was provided to the approval authority for review. Approval of this CJ&A signifies that the approval authority has made the determination required by DFARS PGI 206.304(a)(S-70)(ii).
