J&A Number: CR- 19202 Code: GXT

P.R. Number: N0016419RGT10

JUSTIFICATION AND APPROVAL (J&A)

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

Naval Sea Systems Command, Naval Surface Warfare Center, Crane Division (NSWC Crane), Global & Enterprise Contracts Division (Code 022).

2. Description of the Action Being Approved

Award of a Cost contract (no fee) on an other than full and open competition basis for the procurement of research, design, development, and testing of a Mach 10 Quiet Wind Tunnel to Notre Dame University. The Mach 10 Quiet Wind Tunnel will be located at University of Notre Dame, Institute for Flow Physics and Control, Hessert Laboratory for Aerospace Research, Notre Dame, Indiana, 46556 (CAGE Code 5B002).

3. Description of Supplies/Services

Notre Dame shall design, develop, build, and test a Mach 10 Quiet Wind Tunnel capable of replicating low disturbance conditions at altitude that affect boundary layer turbulence transition and subsequent surface heating for hypersonic vehicle traveling at Mach 10.

The design and development effort will include preliminary design of a Ludwieg-tube configuration wind tunnel. Tasks will include development of prototype hardware, subsystem and system level requirements definition, integration of prototype hardware and subsystems to configure a Mach 10 Quiet Wind Tunnel, and test and evaluation of Mach 10 Quiet Wind Tunnel performance.

If successful, the design and development of a Mach 10 Quiet Wind Tunnel will provide expanded test capabilities and greater evaluation infrastructure for continued advancement of Hypersonics Technologies within the Department of Defense.

IN REPLY REFER TO:

NCH 53.6-2 (Apr 2019) 2

Based upon a detailed budgetary estimate received from Notre Dame;

the total cost of this effort , and is estimated to take to complete. Due to the nature of the developmental work to be accomplished, the inherent uncertainties involved, and

, it is requested that the threshold of this J&A be $13.5M to mitigate risks of requiring an addendum during contract performance. Currently funds are available to fund at the time of contract award. Remaining funds, if necessary, will be provided incrementally.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(3) and in accordance with (IAW) FAR 6.302- 3(a)(2)(ii), full and open competition need not be provided for when it is necessary to award the contract to a particular source in order to establish or maintain an essential engineering, research, or development capability to be provided by an educational institution.

5. Rationale Justifying Use of Cited Statutory Authority

The Mach 10 Quiet Wind Tunnel will build upon and join, the recently completed Mach 6 Wind Tunnel at Notre Dame’s Institute for Flow Physics and Control White Field Laboratory. The Mach 6 and Mach 10 Quiet Tunnel will provide a suite of hypersonic Wind Tunnels that have unique characteristics needed to address critical issues of turbulent transition and flight control required in the development of efficient hypersonic vehicles.

Notre Dame has performed extensive research and experimentation for

The addition of the Mach 10 Quiet Wind Tunnel at Notre Dame will provide test capability to perform testing at Mach 6 and Mach 10 laminar flow within a single facility. This project will ultimately result in crucial advancements in hypersonics fluid mechanics technologies. Other rationale includes the existence and

NCH 53.6-2 (Apr 2019) 3 dual use of Mach 6 Quiet Wind Tunnel subcomponets in the design of the Mach 10 Quiet Tunnel. Notre Dame will utilize existing 55,000 gallon vacuum tanks, air compressors and vaccum pumps, and air supply piping, and electrical; providing cost savings of , compared to the development of a stand alone facility.

Addditionally, the Office of the Under Secretary of Defense for Research & Engineering, ubmitted a memorandum for Statement of Urgency to NSWC Crane Command for Quiet Hypersonics Research and the building of a Mach 10 Quiet Wind Tunnel at Notre Dame.

Per this Urgency memorandum, NSWC Crane, in cooperation with the Notre Dame, are tasked to build a Mach 10 Quiet Wind Tunnel at the University of Notre Dame. This memorandum is included as an enclosure to this document.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Based upon the reasons discussed herein, it is not practicable to provide this requirement for full and open competition.

Additionally, a notice will not be posted to the governmentwide point of entry IAW FAR 5.202(a)(10), the proposed contract action is made under conditions described in 6.302-3, and advance notice is not appropriate or reasonable.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined the anticipated costs to the Government for the supplies covered by the J&A will be fair and reasonable prior to award. The Contracting Officer will use cost and price analysis to determine a fair and reasonable price.

NSWC Crane will analyze, evaluate, and negotiate based upon detailed cost or pricing data which will be certified by Notre Dame at the conclusion of negotiations.

8. Actions to Remove Barriers to Competition

NSWC Crane has no plans for future contracts for the types of supplies covered by this document; this acquisition is a one-time buy.
