STATEMENT OF WORK

For

METAL TREATMENT REQUIREMENTS

1.0 SCOPE. This Statement of Work (SOW) sets forth the Government's requirements for the metal treatment of products fabricated by WXT Machine Shops.

1.1. BACKGROUND. The Surveillance and Electronic Support Systems Division (WXT) at Naval Surface Warfare Center, Crane Division (NSWC Crane) supports the Navy's EA-68 and EA-18G aircraft, as well as additional Department of Defense (DoD) platforms/requirements. In order to provide adequate support, WXT requires various machined items to receive surface treatments, including, but not limited to, plating, thermal heat treating, corrosion preventative treatments, etc. This SOW cites the Government's requirements for the treatment of machined items, with these machined items ultimately assisting WXT in supporting the Navy's EA-68, EA-18G, and other DoD platforms/ requirements. Furthermore, additional divisions at NSWC Crane may meet their requirements for metals treatment of machined items in accordance with the requirements cited in the SOW, on an as needed basis.

2.0 APPLICABLE DOCUMENTS . The documents cited below form a part of this SOW to the extent specified in the subsequent sections of this SOW. The convention used in this SOW is to reference all appropriate revision letters/numbers and/or date of issue for each document listed below only in this section, while only the applicable document abbreviation will be cited in the remaining sections of the SOW.

Furthermore, the documents listed below merely denote the currently known requirements that the contractor shall adhere to in the performance under this SOW. However, additional documents may be cited in the individual delivery orders to be placed against this contract as necessary to further define the requirements (e.g., a more specific SOW, design specifications, product drawings, etc.), and these additional requirements shall have the full force and effect as the documents listed in this SOW.

2.5 Order of Precedence. In the event of a conflict between the text of this SOW and the references cited herein, the text of this SOW takes precedence. Nothing in this document supersedes applicable Federal, State or Local Laws and regulations unless a specific exemption has been obtained.

2.6 Availability of Documents. One source for Government specifications, standards, and handbooks is the Document Automation & Production Service, 700 Robbins Avenue, Building 4/D, Philadelphia, PA 19111-5094 (www.assistdocs.com). Additionally, one source for Non Government Publications is the American National Standards Institute, located at 25"' West 43"' Street, New York, NY 10036 (Telephone: 212-642-4900, www.webstore.ansi.org).

3.0 REQUIREMENTS.

3.1 General. The contractor shall provide all facilities, personnel, equipment, materials, parts, supplies, and tools necessary for performance under this statement of work. In the performance of the subject tasking under this SOW the contractor shall comply with all the Government's requirements cited in Paragraph Two and the individual delivery orders.

3.2 Fabrication. In the surface treatment of products ordered by the Government under this SOW, the contractor shall comply with all the Government's requirements cited in Paragraph Two as well as any additional requirements (e.g., a more specific SOW, design specifications, product drawings, etc.)

necessary to further define the requirements under each individual Delivery Order.

3.3 Place of Performance. Surface treatment of all items under this SOW will occur at the contractor's facilities, unless otherwise directed by the Government. If it's determined that surface treatment needs to take place at Government facilities to complete a specific Government requirement, the Government shall provide an opportunity for all contractors under this contract to conduct a site visit to the Government facility prior to required submittal date of the Contractor's proposal for the subject delivery order. The Government understands that not all Contractors can perform all requirements of this SOW with respect to the types of surface treatments required. Therefore, offers for individual applications will be accepted.

The Contractor location shall be located within 250 miles of NSWC Crane to allow for same day services.

3.4 Performance Timeframe. The period of performance will be defined by the individual delivery order.

On occasion, the Government will require same-day processing. Therefore, the Contractors shall be able to provide "while you wait" services, as defined by the individual delivery order.

4.0 GOVERNMENT FURNISHED EQUIPMENT & PROPERTY.

4.1 Government Furnished Equipment (GFE) or Government Furnished Property (GFP), referred to as parts, will be required for performance under this contract. The specific GFE & GFP necessary to perform the requirements will be listed in the applicable delivery order.

5.0 SECURITY

5.1 It is not anticipated that the contractor will require access to classified information to perform under this SOW. If any individual requirement under the Delivery Order requires access to classified information, DD254s will be executed prior to providing any classified data.

52.216-19 ORDER LIMITATIONS (OCT 1995)

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $1500.00 (insert dollar figure or quantity), the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor -

(1) Any order for a single item in excess of $150,000.00.

(2) Any order for a combination of items in excess of $150,000.00 ; or

(3) A series of orders from the same ordering office within 30 days that together call for quantities exceeding the limitation in paragraph (b) (1) or (2) of this section.

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 7 days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.
