INDUSTRY QUESTIONS

Question 1: The minimum and maximum order quantities for the P-VPS are set forth on Page 10 of Solicitation N00164-19-R-JQ57. As stated, the Maximum Quantity for each Delivery/Task Order is 2,000.00 EA.

The delivery schedule for all CLINS are set forth on Pages 24-25 of the solicitation. As stated, “Delivery for the first order will be in accordance with FAR 52.211-8 Time of Delivery”. FAR Clause 52.211-8 on Page 25 states that delivery of the first order will be 120 days after date of order (ARO), with subsequent orders delivered within 90 days ARO.

These combined minimum order and delivery period clauses in Solicitation N00164-19-R-JQ57 will technically require delivery of up to 2,000 EA of the P-VPS within 120 days ARO for the initial order or 90 days ARO for subsequent orders. Is this the intent?

Answer 1: The Delivery Information in Section F and 52.211-8 have been updated to add a phased delivery schedule.

Question 2: Technical Subfactor (D) Small Business Participation under Solicitation N00164-19-R-JQ57 requires completion and submission of the Small Business Participation Data Form (Solicitation Attachment 04) in addition to requesting a detailed description of how the offeror will ensure that the requirements of FAR Clause 52.219-14, Limitations on Subcontracting, will be met for each delivery order.

Do the small business participation requirements apply to an offer from a small business? Further, FAR Clause 52.219-14 Limitations on Subcontracting typically applies only to contracts awarded under a small business set aside. Since Solicitation N00164-19-R-JQ57 is an unrestricted procurement, and not set aside for small business, we request clarification of the applicability of FAR Clause 52.219-14 to this procurement.

Answer 2: Small business offerors are required to provide response to all solicitation factors as outlined in the solicitation to include Technical Subfactor D Small Business Participation and Attachment 04 Small Business Participation Data Form.

FAR clause 52.219-14 does not apply to this solicitation. References to 52.219-14 have been removed from Proposal Requirements in Section L and from Attachment 04 Small Business Participation Data Form.

Delivery for the first order will be in accordance with FAR 52.211-8 Time of Delivery.

Early deliveries are acceptable at no additional cost to the Government.

If 1-100 units are ordered, they will be delivered 90 days after receipt of order. If more than 100 units are ordered, the first 100 units will be delivered 90 days after receipt of order and the remaining units will be delivered at a minimum rate of 100 units every 30 days.

52.211-8 TIME OF DELIVERY (JUN 1997)

(a) The Government requires delivery to be made according to the following schedule:

REQUIRED DELIVERY SCHEDULE

Delivery for the first order will be 120 days after date of order.

For the first order, if 1-100 units are ordered, they will be delivered 120 days after receipt of order. If more than 100 units are ordered, the first 100 units will be delivered 120 days after receipt of order and the remaining units will be delivered at a minimum rate of 100 units every 30 days.

Subsequent Delivery Orders:

Within 90 Days After Date of Order Item No. Quantity of Contract: CLINs 0001-0015 If 1-100 units are ordered, they will be delivered 90 days after receipt of order. If more than 100 units are ordered, the first 100 units will be delivered 90 days after receipt of order and the remaining units will be delivered at a minimum rate of 100 units every 30 days.

CLIN 0016 will be delivered in accordance with CDRLs, DD 1423s

The Government will evaluate equally, as regards time of delivery, offers that propose delivery of each quantity within the applicable delivery period specified above. Offers that propose delivery that will not clearly fall within the applicable required delivery period specified above, will be considered nonresponsive and rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when an offeror offers an earlier delivery schedule than required above. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.

OFFEROR'S PROPOSED DELIVERY SCHEDULE

Item No. Quantity of Contract

(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor's date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term "working day" excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.

The cover letter shall identify all enclosures being transmitted as part of the proposal. The letter shall reference the solicitation number and acknowledge that it transmits an offer in response to the solicitation. The cover letter shall be no more than 2 pages. Contractor shall inform the Contracting Officer of any planned or actual sales and international export to foreign concerns/governments of the same/very similar items procured on this contract.

It shall state:

• Solicitation Number (N00164-19-R-JQ57)

• Commercial and Government Entity (CAGE) number,

• Duns Number,

• Taxpayer Identification Number (TIN),

• Name, address and telephone number of the cognizant DCMA Office (can be found at http://www.dcma.mil/ )

• Proposal validity through 30 September 2019.

• Names, telephone numbers and email addresses of persons authorized to conduct negotiations, as well as the names of the official authorized to bind the offeror’s organization shall be clearly identified,

• Any exceptions taken to any requirements of the solicitation, to include but not be limited to technical exceptions, clauses and or provisions. The cover letter shall indicate in which volume and on what page of the offeror’s proposal the exception is addressed.

• A copy of the offeror’s SAM registration information from the SAM website. This does not count towards the page limitation of the cover letter.

• Written concurrence for disclosure of proprietary information to non-Government participants in the source selection process (see paragraph i below).

(d) VOLUME II - Written Technical Proposal.

1. The written technical proposal shall be submitted as Volume II and shall address the information required for each of the technical subfactors described below (100 pages max); a Performance Specification Compliance Matrix (no page limit); and all relevant System Operation and Maintenance Manual(s) (no page limit).

2. The technical proposal shall not contain any pricing information.

3. Offeror shall submit a P-VPS Performance Specification (PS) Compliance Matrix (Solicitation Attachment 03) to summarize compliance with the technical requirements to the paragraph in the Offeror’s written technical proposal that demonstrates the Offeror’s ability to meet the requirements listed in the Performance Specification. Technical explanations/discussions should not be repeated in the matrix, but it should instead act like a checklist/index. Proposal’s shall indicate (i.e. a “”) if the proposed item will meet the threshold and objectives listed in the specification. This indication of meeting a requirement (either threshold or objective) is binding if the proposal is selected for award; however, for evaluation purposes, proposals that inadequately describe in sufficient detail how the proposal meets the threshold may be deemed a deficiency by the Government; furthermore, for objectives listed in the specification inadequate supporting data may prevent a strength from being assigned for the subject requirement regardless of a “” in the objective column. The attachment (P-VPS PS Matrix) will be NOT included in the page count.

4. Each technical proposal shall enable Government evaluation personnel to facilitate a thorough evaluation and arrive at a sound factual-based determination as to whether or not the proposal will meet the Government’s requirements. Each technical proposal shall be specific, detailed, and complete as to clearly and fully demonstrate the degree of the prospective contractor’s knowledge and understanding of the requirements. The technical proposal shall be used as a method to determine if the proposed solutions to technical problems are valid and practical. Statements that paraphrase the Specification and/or Statement of Work or attest that "standard procedures will be employed” are inadequate to enable the Government to evaluate and do not allow the Government to determine if the proposal complies with the requirements of the SOW or Specification.

Unsupported promises to comply (i.e. checking a requirements matrix to indicate compliance with a threshold requirement) with contractual requirements will not be sufficient. Failure to thoroughly describe (i.e. test data, test methods, design/drawings, etc.) how the proposed items meets a requirement will result in a negative evaluation in regards to the subject requirement. If the technical proposal is deficient in supporting data, the Government may assign a deficiency for the subject requirement regardless of any indication in the requirements matrix of conforming to the subject requirement. Proposals must contain supporting rationale for any statements related to proposed performance. No assumptions will be made by evaluators regarding areas that are not addressed in the Offeror’s written proposal.

5. Electronic and hard copy of the following Technical Documentation in response to the factors and subfactors described in the solicitation in such detail to allow the Government to evaluate the proposal. This shall include:

TECHNICAL SUBFACTORS – (A) Product Sample Capability Evaluation

i. Describe if there are any threshold requirements that the proposed product samples do not meet and identify the performance specification (PS) paragraphs containing that threshold requirement. Include a description of the non-compliance to include how the product sample is non-compliant as well as why it could not be made to comply before proposal submission.

8. Contract award date

9. Contract type

10. Awarded price/cost

11. Final, or projected final, price/cost

iii. The Offeror shall also provide the above required information for any and all contracts under which it has been terminated in whole or in part, for default or cause during the past 10 years, to include those currently in the process of such termination as well as those which are not similar to the proposed effort.

iv. Offerors shall provide an outline of how the effort required by the solicitation will be assigned for performance within the contractor's corporate entity and among proposed subcontractors. Information required in the above paragraphs shall be provided for each proposed subcontractor who will perform a significant portion of the effort. "Significant" is defined for these purposes in terms of criticality of the subcontracted work to the whole. With regard to prime contract assignments that will be performed by the Offeror and not a proposed subcontractor, the Offeror shall indicate:

1. what internal corporate bodies/divisions will accomplish which portions of the effort,

2. whether or not those divisions were responsible for performance under the previous contracts for which the Offeror is providing information under the instant proposal, and

3. if those divisions have relocated since the accomplishment of previous cited contract efforts, a description of any changes arising from that relocation in terms of responsible personnel, processes, facilities and equipment.

v. Offerors shall include in their proposal the written consent of their proposed significant subcontractors to allow the Government to discuss the subcontractor's past performance assessment with the Offeror during negotiations.

vi. Note: Offerors are reminded that both independent data and data provided by Offerors in their proposals may be used to assess Offeror past performance. Since the Government may not necessarily interview all of the sources provided by the Offerors, it is incumbent upon the Offeror to explain the relevance of the data provided.

The Government does not assume the duty to search for data to cure problems it finds in proposals. The burden of providing thorough and complete past performance source data remains with the Offerors. Proposals that do not contain the information requested by this paragraph risk rejection or high performance risk assessment by the Government.

vii. For the purposes of this solicitation, recent contracts are defined as those on which performance occurred during the last three years from issue date of this solicitation. In determining relevancy, the Offeror should consider the size, content, and complexity type and value of the contract, and the type of requirement compared to this solicited requirement. The Offeror should also consider the level or amount of effort. Only past performance associated with variable powered scopes or related technology will be considered relevant. If a Past Performance reference is based upon “related technology”, the Offeror must provide explanatory details including how the “related technology” is applicable to the solicited effort. Should the Offeror not explain how the related technology is applicable, the reference may not be considered relevant. If an Offeror has no current or relevant past performance information for itself, its predecessor companies, its responsible personnel who will perform this contract, or its major or critical subcontracts, the Offeror should so state that in this volume and explain.

viii. Each Offeror shall submit present and past performance information for itself on projects of similar size, scope, and technical complexity. The Offerors may choose to submit present and past performance information for major or critical proposed subcontractors, team members, or joint venture partners that have experience in projects of similar size, scope, and technical complexity with its proposal. The total number of past performance references for each Offeror shall not exceed five (including any references submitted by subcontractors, team members and/or joint ventures). This volume shall provide a list of current and relevant contracts on which the Offeror has performed in the format requested in the Proposal Requirements portion of this document. This information, as well as other information the Government may obtain elsewhere via Government databases (CPARs, PPIRs etc.) and other government agencies (DCMA, DCAA etc.), will be used to evaluate the Offeror's past performance. The Government reserves the right to solicit feedback beyond what is identified in the questionnaire. NO CLASSIFIED PAST PERFORMANCE SUPPLEMENTS WILL BE ACCEPTED. The Offeror may submit performance on classified programs as long as that information can be verified. If the Offeror intends to submit in this manner the information that is classified (customer, contract number, etc.) should be marked “reserved” and the description/write up of the work performed shall remain unclassified. If the Offeror cannot describe what work was accomplished in an unclassified manner the Offeror cannot submit that program for Past Performance evaluation. Offerors are notified that the Government will evaluate the data provided in this volume and data obtained from other sources that is determined to be current and relevant to the effort at hand in the development of its performance risk assessments.

5. Past Performance Matrix - Offeror shall provide a Past Performance Matrix (Solicitation Attachment 05) for each of the Past Performance Questionnaire (PPQ) sent out listing the following:
