JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center (NSWC) Crane, Spectrum

Warfare Contracting Division.

2. Description of the Action Being Approved

Award of a Firm-Fixed-Price, Indefinite-Delivery, Indefinite-Quantity supply contract with an ordering period of five-years on a sole source basis for AN/SPQ-9B Rotary Joint/Slip Ring Assembly new manufacturing and testing to Continental Microwave & Tool Co Inc., DBA Cobham Antenna

Systems.

3. Description of Supplies/Services

This new requirement is the result of the AN/SPQ-9B Radar system being officially assigned to the

NSWC Crane Radar Restoration program in FY17 by PEO IWS 2. The AN/SPQ-9B rotary joint/slip ring is used in the AN/SPQ-9B Radar Antenna System. It is a subassembly accomplishing two primary functional areas. The rotary joint portion of the subassembly allows Radio Frequency transmission between the rotating and stationary portions of the antenna system. The slip ring portion of the subassembly allows for electrical connections between the stationary and rotating portions of the antenna system. A new manufacturing supply Contract Line Item Number for rotary joint/slip ring assemblies will be included. The PSC is 5985.

The contractor will be required to deliver completed test data sheets with the manufactured rotary joint/slip rings, showing conformance to performance requirements of document number 6868537, Revision J.

NSWC Corona tracks and reports failure rate and demand received from the fleet to PEO IWS 2.0 and the In-Service Engineering Activity (ISEA). Delivery schedules are based on historically-known demand/failure rates for the rotary joins/slip rings. Demand rates/trends are continuously being updated each fiscal year. The contract ordering period is anticipated to be based on the known steady requirements over the next five years.

This procurement will be for a maximum of $1.46M over a five-year period and funded with appropriations from Operation and Maintenance, Navy (O&MN), Shipbuilding and Conversion, Navy (SCN), and Other Procurement, Navy (OPN). An estimate of the proposed funding by appropriation is listed in the following table.

Deliveries will be delineated in each individual delivery order. The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(1), only one responsible source and no other supplies or services will satisfy agency requirements as set forth in FAR 6.302-1.

5. Rationale Justifying Use of Cited Statutory Authority

The only approved source for the manufacture of AN/SPQ-9B rotary joint/slip ring assemblies is

Cobham Antenna Systems & Microwave Components, 596 Lowell Street, Methuen Mass, 01844.

The PEO IWS 2.0 and ISEA budgets would need ot be increased to approve additional sources.

In accordance with the qualification plan for AN/SPQ-9B Rotary Joint/Slip Ring Assembly

Overhauls, #89 PLN 17 9872, the ISEA requires full environmental testing of the complete AN/SPQ-

9B Antenna System as part of new source approval. After approval, the vendor is added as a suggested source to a NSWC Crane generated vendor item control drawing in accordance with

American Society of Mechanical Engineers Y14.24. Additionally, the ISEA requires a shipboard evaluation period as part of any new source approval effort. The design, environmental testing, and shipboard evaluation cost is in excess of . The total duration for design, mandatory

Government milestone reviews, environmental testing and shipboard evaluationis plus the time required to award a contract for the new source design effort. The Government owns the rights to the overall performance specifications for the rotary joint/slip ring assembly. Only Cobham has the detailed documentation for manufacturing processes for the rotary join/slip ring assembly.

The program does not have the required funding to establish another source. In addition, the program cannot encounter a delay, which is the estimated number of months to establish another source. It would seriously jeopardize installation schedules and fleet readiness. These rotary joint/slip ring assemblies are an integral component of the AN/SPQ-9B radar antenna. Without the radar antenna, the multiple ship platforms would be vulnerable to missile attack because there is no operational anti-missile search radar. The rotary joint/slip ring is a "single point of failure.”

Therefore, if the joint fails, the radar fails to detect any enemy incoming missiles. There are no equivalent backup systems aboard United States Navy ships that are equipped with AN/SPQ-9B radars that provide protection/detection. The table below details the estimated duplication of cost and lead time to establish an additional source.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Market research is conducted by the requiring technical activity (RTA) on a continuous basis, including contacting knowledgeable individuals in the Government and industry, reviewing previous procurements and in-house contracts, product catalog and literature reviews, and internet searches.

Based on market research and relations within the industry, it is the technical representatives’ judgment that there are no other sources certified in manufacturing the AN/SPQ-9B Rotary Joint/Slip

Ring, and therefore no other source that are capable of satisfying the Government’s current requirements.

In an effort to broaden competitive resources, a Request for Information (RFI)/Sources Sought was posted on the Federal Busienss Opportunities (FedBizOpps) website on 26-SEP- 2017, in accordance with (IAW) FAR 15.201, exchanges with industry before receipt of proposals.

The proposed contract was synopsized via posting on the FedBizOpps website on 05-FEB-2018, IAW FAR 5.2. Inquiries regarding the synopsis are not anticipated; however, the RTA representatives will investigate and consider the possibility of a competitive procurement should responses be received. To date, no responses have been received.

7. Determination of Fair and Reasonable Cost.

This requirement will exceed the certified cost or pricing threshold; therefore, certified cost or pricing data is required. Because it is required, we shall use cost analysis as well IAW FAR 15.404-1(a)(3).

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NSWC Crane has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If other potential sources emerge, NSWC Crane will assess whether competition for future requirements is feasible.
