J&A Number: CR-180016 Code: 0233 P.R. Number: N0016418RJV24
CLASS JUSTIFICATION AND APPROVAL (CJ&A)
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity.
The Naval Sea Systems Command, Naval Surface Warfare Center (NSWC Crane) Expeditionary Integration Contracting Branch, Code 0233.
2. Description of the Action Being Approved.
Award of a Basic Ordering Agreement (BOA), and issuance of orders under the BOA, on a sole source basis to DB Control, 1120 Auburn St, Fremont, CA 94538-7328 to procure repair/upgrade/rework and maintenance, spares and replenishment, engineering support services, test and evaluation, redesign and modification, system training support, data collection, and logistics support services, as required. This requirement is in support of a Multi-Mission System used on manned platforms in support of the Maritime Patrol and Reconnaissance Aircraft program office, . Authority to act under this CJ&A expires on 10 August 2023.
3. Description of Supplies/Services.
The required supplies and services covered under this CJ&A are for procurement and support actions consisting of, but not limited to spares, repair actions, calibration, assembly modification, design upgrades, depot piece-part lay-in, engineering support, training services, hardware and software support, and system related logistics services of the Traveling Wave Tube Amplifier (TWTA) utilized in a Multi-Mission System.
The support will ensure the Platforms are Fully Mission Capable in which they will be able to perform their current and assigned missions. These platforms are the primary operated by the and the duties include
The PMA-290 platforms are currently deployed in theater of operations in supporting the warfighter.
The Job Order’s (JO) will be funded with appropriations from
Exact amounts of each type of funding will be dependent on mission requirements and programmatic decisions. The estimated dollar values for FY18 through FY22 are

identified in the table below. The Government’s minimum needs have been verified by the technical and requirements personnel.
Estimated Dollar Value
FY18 FY19 FY20 FY21 FY22 Total
Total $10,500,000
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), Only one responsible source.
5. Rationale Justifying Use of Cited Statutory Authority.
has directed the use of the TWTA in a Multi-Mission System, for which DB Control is the original equipment manufacturer (OEM), to meet theater commander requirements. The BOA will provide for the interim support for this system. The Multi-Mission System in which these TWTAs are installed is an capable of producing
. It provides and enables the operator the ability to
The TWTA provides high power output, approximately at its peak. The TWTA consists of a Traveling Wave Tube and a High Voltage Power
Supply.
DB Control is unwilling to sell the Level III technical data package for the Shop Replaceable Assemblies (SRA) used in the Multi-Mission System. Therefore, the U.S. Government does not have sufficient data rights to support a full and open competition of the system or support thereof.
DB Control is the OEM and/or is the prime integrator and is the only source that possesses the technical data required to produce, repair, support and maintain the SRA’s installed in the system described above. Given the complexity of the system, only DB Control possesses the required skills, experience and data necessary to perform the required support for the SRA’s. The lack of documentation, test fixtures/stations and technical data including quality/performance acceptance test procedures prohibit any other source from directly manufacturing the components for the system in performing the required engineering support and repair actions.
If the Government were to procure a different system from another supplier, the cost to procure, re-tool, reverse engineer, generate acceptance test procedures, perform first article testing, acquire flight certification, and perform stress analysis would exceed $7,517,096. In addition, the approximate development time for the system would be five (5) years. The development time would be even greater if another company needed to reverse engineer the system components. The development of a new system would add the following cost and schedule delays:
Task Dollars Months Re-tool of Line $260,000 12 Reverse Engineer and Test Procedures (x2 Platforms) $1,213,576
First Article of Test (x2 Platforms) $1,541,520 3
Tempest Certification(x2 Platforms) $420,000 6
Electrical Load Analysis(x2 Platforms) $130,000 6
Stress Analysis(x2 Platforms) $30,000 6 Publications/Reoccurring Costs (x2 Platforms) $12,000 3 Flight hours (P-3 rate used) x2 Platform 72 hours each $2,160,000
Ramp Fees per platform x2 $1,750,000
Included in Flight Hour Calculation
Total $7,517,096 60
The schedule requirements to provide support of the TWTA on the Platform are immediate or there is risk of losing this capability for the warfighter. DB Control is the only source that would be able to meet this schedule. Based on the above stated information, the substantial duplicative costs associated with an award to a source other than DB Control are not expected to be recovered through competition. Award to a source other than DB Control would result in unacceptable delays in fulfilling requirements.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
A sources sought for the proposed contract was synopsized on the FEDBIZOPS website on 02 November 2017. No responses were received from companies other than DB Control. Based upon the market research, and for the reasons discussed in Section 5, it is not practicable for any vendor other than DB Control to provide the required supplies and services. All orders to be issued under this BOA will also be synopsized on the FBO website in accordance with FAR Subpart 5.2. Any responses received will be considered.
7. Determination of Fair and Reasonable Cost
The Procuring Contracting Officer (PCO) will determine the anticipated costs to the Government for the requirements covered by the CJ&A will be fair and reasonable. The contracting office will use cost and price analysis to determine a fair and reasonable price for each order. As cost or pricing data is required, Defense Contract Audit Agency and Defense Contract Management Agency may be utilized to analyze, evaluate and assist in negotiations based upon detailed cost or pricing data which will be certified at the conclusion of negotiations.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NSWC Crane has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWC Crane will assess whether competition for future requirements is feasible. The circumstances surrounding the need to obtain the required supplies/services covered by the CJ&A will be reviewed annually by the PCO.
