J&A Number: 17-015.1

Code: JXVN

P.R. Number: N0164-17-R-JV13

CLASS JUSTIFICATION AND APPROVAL (J&A)

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Crane

Division (NSWC Crane), Expeditionary Integration Contracts Branch, 0233.

2. Description of the Action Being Approved

Alter the planned award contract type of N00164-17-R-JV13 from

Indefinite-Delivery, Indefinite-Quantity (IDIQ) contract to a

Basic Ordering Agreement (BOA). The acquisition is to be awarded and order under the BOA issued on a sole source basis for the procurement of the USQ-149, spares, repairs and engineering services in support of and the

Weapon Replaceable Assemblies

(WRA) and Shop Replaceable Assemblies (SRA) to Harris Corporation

7821 Orion Avenue, Van Nuys (formerly Exelis, Inc), Van Nuys, California. The alteration in contract type is a result of acquisition planning discussions conducted with Harris. Based on the nature of the repairs being completed under this effort, the vendor is unable to reasonably estimate standard fixed costs for these efforts over the next five years. Additionally, due to the aging of the system and parts, the required repair efforts will increase as the system ages. Finally, the required repair quantities for each year cannot be reasonably estimated as many of the WRAs and SRAs identified as potential items for repair will begin to sunset over the next five (5) years. Based on the uncertainty of future requirements resulting from these constraints and IAW FAR 16.703(b), a BOA has been determined to be the most appropriate contract type. All other information provided in the original J&A, including estimated dollar values, remains the same.

J&A Number: 17-015.1

3. Description of Supplies/Services

The award of a five (5) year BOA with maximum ceiling of

$8,000,000 across all Job Orders and CLINs is anticipated.

Items on the Job Orders under the BOA will include CLINs for

Spares, Repairs, and Engineering Services. The engineering services CLIN will cover tasking such as: obsolescence issues, incorporation of developmental upgrades and software patches, procurement integration, installation, testing, training, Re-

Certification & Accreditation (C&A) as required, , fielded-systems of the USQ-149.

BOA orders will be fully funded with appropriations from

Aircraft Procurement-Navy, Operations & Maintenance-Navy and

Research, Development, Test and Evaluation funding as stated in the Estimated Dollar Value table provided in J&A 17-015.

4. Statutory Authority Permitting Other Than Full and Open

Competition

No alterations were made to this section from J&A 17-015.

5. Rationale Justifying Use of Cited Statutory Authority

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

An amendment to the synopsis posted on 14 November 2016 was posted to FEDBIZOPPS on 24 April 2018. The addendum addressed the change in contract type as well as the requirements to be procured under N00164-18-G-JV13REQ0001. No responses were received in response to the original or amended synopsis. All orders issued under this BOA will be synopsized on the FBO website in accordance with Federal Acquisition Regulation (FAR)

7. Determination of Fair and Reasonable Costs

The Procuring Contracting Officer (PCO) will determine the anticipated costs to the government for the requirements covered by the J&A will be fair and reasonable. The contracting office will use cost and price analysis to determine a fair and reasonable price for each order. As cost or pricing data is required for each order, Defense Contract Audit Agency and

Defense Contract Management Agency may be utilized to analyze, evaluate and assist in negotiations based upon detailed cost or pricing data which will be certified at the conclusion of negotiations.
